  1. Call the 800 number. Calmly explain to the person on the line that this is your situation and tell them you sent copies of your Naturalization certificate along with a copy of the biographical page of your US passport. Then tell them your classification is wrong. She or he will give you a casde number and tell you 30 to 45 days.

    You might get a response via email the same day or couple of days later that they have resolved the situation. Remember be nice to whoever picks your call and calmly explain your situation. I have found that to be most helpful in getting things resolved.

  2. My fiance arrived in the US about a month ago on a K1 visa. Since her arrival things have gone DOWN HILL!. I found out she was unfaithful numerous times during our visa process and do not plan to continue our relationship. I guess my question is how do i get her to go home. I have offered to pay for her flight but she refuses to accept the offer. She acts like a child most of the time and cant seem to realize that we are not getting married. Any tips on how to get her home, i prefer not to report her to INS. I know shes legally allowed to stay for 90 days.

    I am sorry for your situation and certainly feel for you. Please follow the advice that have been given thus far.

    On another note, reading stories like this irritates me to the nth degree. I am baffled that K-1 visa will often process faster than an IR visa when on the one hand, there is a slight possibility the relationship will work and on the other hand, the folks have already met and gotten to know one another and have married. It is this type of wisdom that makes me shake my head and wonder why the policy of USCIS is pro K-1 and hard on IR visas.

    Anyway, please report her and take all measures to protect yourself and your integrity from being denigrated.

    I had to file an extension for my taxes 2009 since I was married in Dec 2009 in Sri Lanka. Now it's August and we've received letter from NVC (already paid the fee) to file my I-864 for my husband. Unfortunately I cant file my I-864 until I finish the most recent 2009 tax return.

    I need to know:

    1a) should I apply jointly and wouldn't getting an ITIN for him will delay the process plus does that mean he first have to apply for it from Sri Lanka and then wait 6 weeks for ITIN and at that point file for taxes or can I send my return with the W7 form for my husband along with a notarized passport?

    1b) I've already have notarized passport from him but it's not from US consulate and does it really have to be. I read something about Hague convention non participant countries have to get it notarized from the US consulate.

    OR

    2) should I file married but seperately and even in this case it still asks for a SSN/ITIN. And the new rule you cant put NRA or any other lettering there. So what should I do. Do i still have to apply for ITIN for my husband.

    Can I just print the papers and send a letter describing that he doesnt have an SSN and that I'm filing separately.

    Please let me know what would be the fastest and correct way to do this with out delay.

    The fact of the matter is that you will face some delay unless you file your taxes now as single (status). In the meantime, get the w-7 and fill it out. Scan it and email it to your husband. Let him print and fedex it to you. You will need him to send a copy of his biographical page with the form when he returns it. Have that passport page notarized and then file for an amended 1040X and change your status to married. Then along with the W-7, 1040X and the notarized copy of the biographical page of your husband's passport, you will send all it to the IRS ITIN Operation center in Austin Tx. It should take about six weeks for them to give your husband an ITIN and then maybe you receive a nice refund or lower the taxes that you may owe the government.

    On the other hand since you are already at the NVC stage, your husband may be coming soon and that means he will be assigned with a SSN. I will wait until he gets it then file an amendment to your return. As the IRS agent explained to me, one has three years to do that.

    In summary, if you do not want to wait, I will file now as single and take my time to amend it later. However, I am not a tax agent and I am sure there people more qualified than me. I will also encourage you to call IRS 800-829-1040 and explain the situation and see what they say.

  4. This post raises so many questions on a lot of levels. How were you approved by USCIS knowing that the woman had filed for three previous men? Where was their due diligence? I think getting a credit monitor is the best way to go. You can also call the credit reporting agencies and let them put a fraud alert on your account. The downside to that is sometimes if you qualify for credit and are applying you might be turned down.

    I always believe there is always two sides to a story and before we make judgment all sides needs to be heard. Something just does not seem right.

    For the other person who claimed the US citizen wife withheld his friend's card for six years so he could visit his wife and children in his country of origin, maybe your friend should be lucky she did not turn his butt in for fraud.

  5. Hey guyz I too am hoping we get some NOA2's soon here. I am worried, however, that interview dates will be pushed passed the holidays, but guess we can only wait and see. Is anyone filling out DS 3032 and 230's now?? My hubby just visited me from the UK and I had him fill them out now since I will be the agent. I had him type the responses and print in blue ink where it wouldnt fit in the typing. He also signed in blue ink. I have been getting mixed responses on whether this is okay. Some say black ink only and some say you have to type/print using capitals. Is there a specific way to fill out these forms?? Or are these just recommendations? I just don't want to send something that will come back as a petty RFE. Thanks!!

    I have also filled them out already. As a matter of fact I hope to receive them via EMS from my wife who signed but did not date it. I told her to sign it in blue ink but I think she responded she did it in black (SMH). As long as he used a pen that does not look at if it has been printed you should be fine. Of course for questions that I could not answer in the space I wrote in all caps "see attached explanation" Once I get the NVC number I will have her print those and sign and date them and send them to me so I can send it in the packet. I guess all we can do is make sure we are prepared for the next stage.

    I called IRS and explained that wife was not in the country and when the accountant was filing taxes he filed as single although I was married September of last year. He did it so that whenever she gets here, we can file jointly. IRS said it was a wrong move because I am married and cannot file single. They suggested I first of all fill a W-7 and have wife sign it and then file a 1040X (amended tax form) and file as married filing jointly.

    First of all, establishes we are married and I am sure it will boost my refund by a bit (praise the Lord). I am waiting for her signed w-7 to arrive along with a notarized copy of the biographical page of her passport and send it along with the amended tax to Texas. I am told the process should take about 6 weeks.

    I believe this csan be good (ITIN) as it shows further proof that we are truly married. How I wish I knew about this before filing my taxes in January.

  7. What I did was to create a very small photobook with soft cover. This eliminated the need to deal with lose photos. It also enabled me to add texts and use the pictures to tell the story of our life from when we met, through our engagement and finally our wedding. I hope this is helpful.
