You should be getting it within the next week if you have not yet. i was in the same situation and I just got mine!

Do not worry. If you explain it in writing (4-5 sentences and briefly), it should not be a problem. They are very understanding, I am sure they have experienced this before.

They did not update my status when they sent me the oath letter. Can you temporarily forward your mail? Make sure USPS forwards government mail though.

You should not worry. Same thing happened to me. You will receive and interview letter pretty soon and it will ask you to bring bunch of stuff as well. Wait about 2 weeks, I got my interview date letter in about 2 weeks after the yellow letter.

This is way too complicated for me, typically in situations like this with an overstay, USCIS wants that person to return to their home country and start all over again. As a three year old, your wife didn't have much say in her overstay, guess all you can do is to see what happens.
With immigration attorneys, not stuck with typical attorneys that can only practice in your state, the USA is open to you. When I started all this, found one of the largest firms in the USA and really checked out my attorney. Accustomed to stuff like this in the corporate world. Yeah, all those new forms were too much for me at the time. Seems simple now, but highly complex back then.
You are wrong. As long as your initial entrance was legal, you may adjust your status based on marriage without returning to your country.

get there 30 minutes early so when you check in you will be ahead of some other people. This may increase your chance of getting an afternoon oath.

I applied in january and had my interview today in dallas. i passed it but somehow FBI has not finished background checks of individuals who have applied after jan. 8th, so they are not making the final decisions. They tell you that you should receive your oath letter within the next two months. Man, was not I excited
Heads up fellow applicants!

yes she can apply for adjustment but you have to apply for I130 along with that.
Thanks for the reply. What is the basis of your answer? Would you please quote a USCIS source?
I would like to clarify that I know the process on how to apply for adjustment of status. My curiosity is limited to whether or not we can apply for it in a country where she is present as a tourist that is neither US nor her country of citizenship!
Thanks.

Hi,
I have read that parents can apply for adjustment of status while in US with a regular visa, and can also apply in their country of citizenship. My question is can she apply for adjustment of status while she is in a third country as a tourist if she is staying there for 6-12 months?
Thanks,
Can two seperate individuals file i-130 for the same individual?

We are going to file i-130 for my sister. My mother has a GC and I am a US citizen. Waiting time if my mother files is less than what it is if I file. There is a slight chance my mother may go back to her home country and we do not want to risk it. So my question is can two people file I-130 for the same individual?
Thanks.
