  1. what if the parents don't want to make the child a US citizen ? if the parents don't ask for the child to become a us citizen its their right ? (that is just an example, not saying that is what they want of course)... I know the case with my husband's mother not being an american citizen, it makes him automatically a citizen of where she was born, and he does not want this citizenship (never asked for it)... ?

You don't want to be judged, maybe you do not want to get any advice from us regarding your relationship, but apparently we all care for your well-being, and this situation doesn't look like one. My mother married a turkish guy and he had a family in Turkey, once he had his french visa he dumped her like garbage and truly hurt my mom, she never wanted to listen to anyone in the family and she regretted it soooooooooo much.

    Now regarding the Consulate, nobody will buy it... he cheated on you with a local girl and is having a child with her... just tell them the truth to them, that there is a unborn child on the way, then let things go their way.

    Do you know how long it would take from the moment he applies for us and the moment we will be able to join him there? (should we start the process at the American embassy in France even if he has not found a job yet ?or is it better that he takes care of everything from America?).

    As proof that this time the marriage is solid, we married both under civil law and religious law also he is living in France under a family visa, we also have proofs of our unmarried relationship (travel flight tickets pictures etc). His previous marriage lasted about a year, we met when he was divorced but there was a lot of problem with the divorce papers they had to fill the papers again etc meaning that we were already in a relationship for about 2 years when his divorce was final for good.

    My husband and I have been in a relationship for 4 years. He's an american citizen and I and my daughter are french citizens.

    My husband moved to France july 2011 and we got married (under french law) on nov 4th of 2011. He now has his long stay visa for family matters.

    For work reasons, we would like to move all the family to the USA. My husband is currently looking for a job back in the USA and I am curious how we should work it out if he has a positive answer and has to go to the USA for work.

    My husband was previously married to an illegal alien in America. He applied for her to stay in America with her daughter, she now has her greencard and lives in the USA legally.

    My questions would be :

    1) Is this going to be a problem for us that he already married an illegal alien before ?

    2) If he accepts a job in the USA can we follow him and take care of all the papers there ? (he would first go and find an apartment, save some money for us to arrive while i'm quitting job, packing stuff etc)

    My daughter already has her own passport because we travelled to Miami this year, so the attorney said it's a good thing she already has her passport because he can't block her from travelling.

    As for the paperworks, I'm not sure how it's going to happen, he already wrote me a letter a few years ago when I travelled to Israel with my child, and I still have this letter, but I doubt I can re-use it for this case ? On this letter he wrote that I could bring my child abroad and didn't write any country, any dates...

    May I ask you about the content of the letter ? like what your ex husband had to write exactly ? so I can already think about asking her father about this letter ? When is the best time for him to write the letter ? now that my fiancé and I haven't done anything yet about the visa application ? or just before my interview at the Embassy ?

  6. Read the guides. Yes you will need a letter from the father stating the child can move to the US permanently. You will also need to get it notarized and attach copies of his passport signature and photo page.

    Have the letter made up so it covers the childs reloaction to the USA opermanently and allows you permission to travel in the future. DO NOT put any effective dates or "windows" of travel.

    what does the embassy really ask about the letter ? and when do i have to ask her father's to write it ? and what if he refuses ?

    I've got some reading yes, it sounds complicated with all the documents and paperwork to do. From what I read my fiancé will have to do almost everything to sponsor me ?

    Inky : do you know if there is a specific way to write the letter and if it has to be official like it has to be done with an attorney or just a simple letter from her father would be enough ?

    I just discovered this website, after many many many researches on internet about the fiancée visa.

    Actually I'm wondering what's the fastest way to obtain a visa to join my fiancé in America : spouse visa or fiancé visa ?

    When I say the fastest way, my plan is to move to America and get married next summer (my child is at school and I can't move until she finishes her year).

    Can anyone tell me how long it takes for the fiancé visa and how it works for my child ? Do I need a letter from her father that he's okay to let me apply for her visa and come to the United States of America with me permanently ?

    I'd love to hear your experience, I'm from France, if any frenchie here ?
