    So a 20yo child in college who lives away from home and works is a partial dependant and the 18yo who lives at home and goes to high school is a full dependant. Or does all of this really matter is your income is above the 125% for a family of 5, my fiancee, her son, me and my 2 daughters?

    The 2009 Poverty Guidelines for the

    48 Contiguous States and the District of Columbia Persons in family Poverty guideline

  2. On my pay stubs I am listed as married with the maximum number of deductions allowed ( 8) ( of course I am divorced but with only 2 dependants) for the sole purpose of reducing my monthly federal tax as I have sufficient deductions at year end to overcome any tax liabilities.

    Should I be concerned about this when submitting my 134? Is this looked at? Or is the main concern just my income and how I do my taxes at year end not an issue?

    From what I have read here, if my current income is decently over the poverty levels, all I need to submit are my pay stubs, an employment letter and that is about it?

    Consul will look at your tax returns, copy of your W2 or transcripts. There he/she will know how many dependents your are really claiming. If you below the poverty line, you will need sponsor. If you are above the poverty line but barely made, you will need to present letter from your bank, employment verification with annual salary report, assets reports [if any].

    I would get all these documentation regardless..

    If your current GROSS income is sufficient, attach last year's tax return and recent check stubs. Nothing regarding your withholding makes any difference to the consulate.

    Thanks. Yes, current gross income is fine. I rememebr talking about last years tax returns which were pretty bad but I think you said that current is more important than previous. So that return and this years pay stubs should do it. Do I also need to submit a copy of all the W-2s for last year along with the return? got a lot of them. I had to do what a father has to do!!

    And all this gets sent to her for presentation at the embassy? Da? And Spasibo.

  4. leave it alone.. they can contact you if they need to... call NVC and ask if you are out of AP.. you should be out by now based on the call.. if not, they will probably call again and you will be out after the next call...

    Hi Scott. Never got a second call. Been a few days now. And as of this morning, I'm still there. I will give it another few days and then try again. I will say that calling the DOS rather than the NVC is a far nicer experience.

When I tried the number on my cell to call back, it said it was a non working number at DOS. My ex and I are on the same page , she knows what I am doing and am not concerned about her response. But they will never reach here (prolonging the process?) unless they have her cell phone number. Should I call them and give it to them, or just leave it alone?

    and what about the proofs of our relationship? i mean...i know this person since may and the only contacts we have is in chat and some call phones and nothing else...thats why im going there in december to met him in person and then i want to go again in march when hi has start k1 procees ....

    Many people here have given you some good advice. But what I am hearing is that you dont really know this person. You have never met him. He can not/will not/does not make an effort to see you. Yet you are already trying to make plans for marriage, some of which border on things which are illegal that may ban you from entering the US forever. Why such a strong desire to make such plans? If you really need to come to him, then visit on a tourist visa. Stay a few weeks. Get to know him. And then GO HOME. Think about what you experienced. If you want, come back again on another tourist visa. Then GO HOME. If you are truly happy that his is a good person who will make you happy, then make your K-1 plans like everyone else. Just my humble opinion.

  9. they have been doing it at the consulate for some time.. now I guess they are trying to get it out of the way at NVC when they can so its more streamlined at the consulate.. If anyone that got AP in NVC gets AP again.. please let the rest of us know...

    The NVC received my paperwork on Oct 21. When I called this morning, I was told that they are doing "some additional processing". No further explaination, no time frames, nothing. Just call back anytime. I understand that the normal processing time is about 5 days, it has only been 7, so I am not too concerned ( except for the fact that now who knows how long we will be there) so I just need to chill and start calling everyday. It would be great if they would at least tell you why.

  10. when a K-2 to follow shows up for his embassy interview ( after the mother has already received her visa months earlier), what can he expect? They cant ask the same questions and he is a derivative of the mother. So is he there to just present his medical, etc.. and prove he is the same person on the application?

    Anyone been through this before?

  11. The web site of the warsaw embassy seems to have some confliting information. Here are two items I pulled on the I-864. Am I reading this right or am I having a semi-senior moment here. :blink: I have sent them an email asking what are their requirements regarding financial support documentation in preparation for my fiancess interview there.

    Who completes the Affidavit of Support, Form I-864?

    The petitioner, that is to say, the American citizen or Lawful Permanent Resident who filed the immigrant visa petition on behalf of the visa applicant. The petitioner must complete an I-864 if filing a petition on behalf of a spouse, parent, child, or sibling, or if he or she filed an employment based petition or has a 5% or more ownership interest in the company which filed the petition. Further information is available from the Department of State's website. The I-864 will not be sent to the petitioner until the NVC has received the Affidavit of Support processing fee.

    The petitioner should return the signed original I-864 to the NVC. The I-864 will be forwarded to the Embassy once NVC has completed the administrative processing of the application.

    Financial Documents

    The Affidavit of Support form I-864 is not required for K visas. However, petitioners must provide proof of adequate financial support once in the United States to ensure the applicant will not become public charges. Documentation regarding financial support can be in any form so long as it contains enough detail and information for the consular officer to conclude that the beneficiary will not become a public charge. Petitioners may submit the form I-134 if they wish

  12. We recieved sms an email confirmation only on NOA2. Online status changed at same time. It was only email or sms we have recieved. Nothing from NVC except letter in mail, and with interview wednesday, no notice from consolate. :star:

    Same with me. Only one email when the NOA2 was approved.

    Can anyone tell me where to go to login to the NVC site?. I read that some people did this but I cannot find where. I used the phone, got a live operator who said my docs were there, but a few days later the automated response said they were not there. Hmmm. Anyone help me here? Thanks.

    To squeak in here. I received an email on Oct 15 saying that my NOA2 was approved. A bit early yet to do much of anything as I wait for the hard copy to arrive. But when does one contact the NVC to see if they have received the docs from the USCIS? Does the hard copy give you any info about this? Or the next steps? Are you supposed to get something from the NVC stating they now have your paperwork or is it up to you to call and find out your status? Not in a rush or anxious but would like to know. thanks for any input.

  14. i live in the US (kentucky) and my fiance lives in Canada (Toronto) and due to extreme situations she is going through at home I am going to have to get her an apartment. She currently doesn't have a job so I'm going to send her money. what is the best way to do this?

    The best way, if your bank will let you, is to send her an ATM card and let withdraw money. We did this for a while but then the bank cut it off, I understand some banks allow it. I could not add my fiancee to the account until she arrived here and went in person to the bank.

    Other than that, moneygram is cheaper than Western Union. I do a lot of cross border business and have in th past. Any kind of check or money order is held by banks as a "foreign check" and can delay availability of funds for up to 20 days. I hate to mail cash, but any bank in Canada will exchange it for her, or she can just deposit it. The current exchnage is almost par (YAY...big boost for Northern Vermont!)

    I agree with Gary. Before I left for Belarus, I opened another checking account, in my name, with a link to my main account. I advised the bank that this card will be used overseas for an indefinite period. I gave her the card, with a pin she had previously selected, and now she uses it whenever she needs it. I can monitor the expenses from here and transfer funds online, immediatley. She cannot use it for purchases as it is in my name, but only for cash withdrawals. Works great.

Since he is now in the army, serving his tour of duty (Belarus) he will not be able to join me or his mother until July 2010. He ages out, turns 21, on Nov 1. If he can ge his butt over to Poland for his interview ( medical exam would have been with his mother maybe in Jan or Feb 2010) in July or August and then hops a plane here to NY and I file for his AOS ASAP, even if it takes a few months, we might still be in process come Nov1. It would be great to have a warm and fuzzy knowing that I did not have to go to court if he is denied. Thoughts? And thank you for all the good info.

  17. Yeah, it's offensive.

    To get back on topic...TD bank bought out Commerce bank and and they were merging the two banks systems when someone realized that it they were not as compatible as they first thought. Hence all the error messages, downtime and so forth. You passwords are still good but when a sytem crashes, it crashes. I was in Belarus when this happened a week or so ago. I could not get any cash out. Not good. Fortunately I caught a break a few days when trying an ATM for the tenth time when everything worked and took out enough to last the rest of my trip.

  18. I don't think any of us can predict the USPS for you. I did notice when I sent my last package to them in August, there were no updates at all on the website until it'd actually been delivered. A lot of folks do priority but there's no way you HAVE to send it. You just have to take whatever waiting times come with the class you chose. Priority and overnight are faster than first, but first still isn't slow.

    It also depends on where you are and where you're mailing it to (looks like Vermont - but from where?). You've sent it certified so I sincerely doubt it's lost.

    Worst case scenario, if they don't get it, resend it (I presume you made an exact copy of what you sent, as this website suggests?).

    ETA: if you have no patience, this process will absolutely be the death of you. So finding some patience is probably a good idea...!

    I sent it from Houston, TX. I dunno why its taking forever. I have no problem with patience. Me and my fiance have been apart for the past 5 and a half years. So I think the eagerness of seeing each other is whats cuasing this impatientness. I am just worried if the USCIS received it or not. I dont mind resending the package all over again but that also means that my cashiers check is gone right?

    Hi Shabz,

    Has it been 5 1/2 years since you last saw your fiance? If so, it will be a problem if you don't have a very very very very very very very good reason for this, please tell me that you did send them a letter explaining why you have not met, and the circumstances that did'nt allow you to meet within the last two years.

    It took me about a 1 1/2 weeks to receive my NOA 1. Don't worry, and find the patience within you cause this process is ever so non-transparent, and it will eat you alive if you worry too much.

    Your cashiers check is not necessarily gone as long as you did'nt throw away it's receipt. Give it another week to 1.5 weeks for the NOA 1 to show up.

    I was kind of like you where I was getting worked up and crazy about why it's taking so long.. But, then I decided that I'm just going to be prepared for the worst and hope for the best... (it's working so far)...

    USPS is not great in updating their website. I had a package delivered and the people told me they had it and the website still listed as being in the post office I mailed it from. They do not scan as well as UPS or DHL. As far as patience goes, you are goning to need some more. Waiting 5 or 6 days is nothing compared to waiting 5-6 MONTHS. This is not a short process.

  19. if our point of entry is new york,or washington d.c.,and we are just connecting to our flight here to atlanta,do we have to pick up our lugguage,or will it just be transferred to the plane,and we will go thru customs,and immigration twice????

    Several things to consider here. First is the time frame for the connecting flight. Since anything can go wong, trying to make another flight only a few hours later is going to be stressful. Why put yourself through this? There could be weather delays, traffic delays, processing delays, and more. You waited a long time so another day before you arrive back to your home is not unreasonable. She will be tired and glad to see you. Spend the night in a local hotel and take a flight out the next day.

    The POE is where you go through immigration and customs. You only do his once.

    Think about this logically. If you wanted to spend a week in New York, and take a bus or rent a car down to Atlanta, would you go through customs again?

    I am not positive about this part, but If the connecting flight is the same airline, your bags are usually transferred to the next leg of your journey. You pick them up at your final destination. If the connecting flight is a different airline, you will need to get your luggage first, after clearing immigration, and lug them to the other terminal.

    I doubt anyone gives a hoot about luggage. Its the paperwork that is important when she enters the US.

  20. Hopefully, in the not too distant future, my Belarus Fiancee will need to travel to Warsaw for her interview. Am I correct in that she will need to apply for a Polish visa to travel to Poland? Has anybody been through this before and can give me some info as to how to proceed? I assume, for one thing, that we need to get a interview date first as visa have time limitations. Thanks.
