  1. Thank you for the information.. I know it would be easier if he did it from there, but he won't.. What a mess for me.. I'll contact a divorce attorney and get things done from here, I just want it done! I kick myself every time I think of my stupidity.. I'm educated, good job, but fall for a liar! It can happen in the USA too, I'm just grateful I never did anything to bring him here (Thank God for that)!

    I appreciate you taking the time and I'll get to a divorce attorney from here asap! Of course, there goes money for my stupidity!

  2. As far as I know it wasn't recognized in the USA, I wouldn't know how it would be.. I didn't do anything here in the USA or there at any USA Consulate, Embassy, etc..

    Do you know how I would know if it is recognized in the USA?

    I don't know how to know if it is recognized or not.. I mean if it's not recognized in USA, then I'm not married according to USA law right?

    I so appreciate your time.. I feel like such a fool.. I'm sorry you got a divorce.. Happy for you and your child..

  3. I have a quick question.. Does anyone know how many times you can apply using the Fiance Visa I129F? It is with the same person.. Very quickly, we filed and were approved in 2009, interview 2010 with a 221(g), case closed due to expiration.. Reapplied June 3, 2010, received NOA1 and were denied NOA2 (due to not answering questions the way USCIS accepted).. It is a LONG, LONG story with many twists and turns (with Immigration here and abroad).. I was wondering can I apply WITH THE SAME PERSON using the Fiance Visa a 3rd time? I have not seen where there is a limit and I know I will need a Waiver, but anyone have any thoughts they are much appreciated.. Thank you all very much!

  4. I'd like to thank everyone for their help.. I've read my letter from USCIS for the last several days and think I know it my heart.. LOL

    I have a question, I need to file a waiver from the explaination (in the letter), it seems to be a simple paper, written/typed by me, signed and dated asking that the first petition (K1) be waived so the 2nd can be used; as for the RFE that is a different set of guidelines..

    Is there a certain way this waiver needs to be written? Or the best verbage to use.. I have noticed if you give too much that is bad and if you give not enough that is bad.. Thank you..

  5. I'd like to thank everyone for their help and suggestions.. The way the RFE is written is in 7 bullet points stating what he got right, wrong or not explained enough.. According to the attached letter I need to address each bullet point.. The questions asked were plain silly (distance from my state to California, what are my political views).. The important questions, what we have in common, names of family members, where I work, how does he feel about moving to a new country, were answered "in an acceptable manner" (exact quote).. Yes, the lawyer should have known the problem we ran into was we could NOT get a copy of the interviewers results (the 7 bullet points).. The visa was listed as "not denied, only sent for further review" and then 5 weeks after that letter the denial letter came with "case closed feel free to refile, etc." in the letter.. I addressed everything the lawyer and senators felt were possible issues, but I did not EXACTLY ADDRESS WHAT THE INTERVIEWER STATED and that is what I need to do now.. I was pretty much expecting an RFE to be honest, but thought it would be for more than geographical, political issues.. They give you 30 days to have your answers sent back to them from the date of the letter; the letter is dated November 3 and I received it November 9, I have 3 weeks to get all this together in an appropriate manner..

    Just to note, after further reading and speaking to my senator it is NOT a good idea to add tons of other evidence; Immigration ONLY wants an answer to their questions as stated in their letter to me.. Now, some of you could receive different requests (proof of ongoing relationship, continuing relationship), I did not.. I was instructed to just answer as requested..

  6. We got an RFE, you just need to address the exact circumstances of the RFE. Answer exactly what they want and don't try to add more evidence or info to your case when you send back the RFE

    I need to address the questions that the interviewer felt were not answered good enough.. Questions such as how he answered in regards to my job description, as I stated previously.. I am not quite sure how to answer those questions, i.e., what book am I currently reading, how far is my state from California.. Just how do I answer that? Wish us luck..

  7. As the topic title states - After 5 Months of waiting for NOA2, received RFE instead.. I am beside myself.. Little background, this is our 2nd filing of the Fiance Visa.. The first denied, closed and I received a letter stating I was free to refile.. I hired an attorney, had 2 Senators involved and passed everything by the 3 people mentioned.. I addressed everything the interviewer said was wrong.. Now I receive the RFE with more issues from the interview, one of wish was he did not know how far my state was from California and the other he could not describe my job "to the satisifaction of the interviewer" (directly quoted).. I read what was written about my job and my fiance told the truth.. Anyway, I'm venting, sorry.. I now have 3 weeks to address the RFE.. Has anyone experienced a RFE and if so, can anyone PLEASE offer any insite into this? Thank you so much for your time..

  8. My NOA1 is dated June 2nd and my papers have been touched 4 times, the last being November 3rd and still NO NOA2.. I called and was told give it another 2 weeks.. We are beyond frustrated! I see so many other who received their NOA1 around the same time and have received the NOA2, we are still waiting, hoping and praying for the best. I have called everyone I can think of and no one is of any help.. Immigration is their own island governed by whomever and whatever guides them! Sorry to vent.. God Bless Us All!

  9. It sure did change to June 18th!!! I don't look everyday and I last looked on either Friday or Saturday, it was 28th June!! That immigration timeline is updated from vj members updating their timelinme.. To the other poster if you can live with your fiance for 5 months go for it, but it won't speed things up.. This is only the beginning of a long journey..Depending on country, there are medical exams, shots, papers to be translated to English, then interview and of course praying to God for a VISA..

  10. Not to put a damper on your high hopes, but there are still people from May and June waiting for their NOA2.. My NOA1 is dated June 2nd, has been touched 3 times and I'm still waiting.. I filed in California and have called, was told they (California) are within their 5 month estimated timeline.. If you check the timeline on visajourney, California is now processing June 28th NOA1's and that is updated according to how people in VJ keep up with their timelines.. Relax we are all waiting 5 months and some more.. Good Luck

  11. It will be 5 months for our K1 also on November 2nd.. I called my Senator and the office checked on my status twice and those are the ONLY 2 times it was touched, I was told, by the Senator Office to wait and if I don't hear anything by the 5 month mark to call back.. To me, 13 October is close enough to 5 months and I am calling the office this week! As other posters have written, the Congress and/or Senator office really don't do much but inquire; I will say that they have gotten faster answers than I got.. Come to think of it they are the only ones who got an answer from USCIS. Good Luck to all of us waiting! I do not understand how some get approvals within 2 months (for the K1) and others are waiting 5 months and more!

I was wondering for those of us still waiting for our NOA2, does anyone know if because USCIS changed the address to Texas (at the time I filed it was still California), are we being left behind now? Will filing in Texas make their goes faster? I talked to a woman who is now filing her 3rd Fiance Visa and she told me that she now filed in Texas and USCIS said it would move faster, any truth to that does anyone know?

    I am still upset, anxious, etc., like all of us and I was wondering on people thoughts, suggestions, etc..

  13. I am with all of you.. As one poster stated, it is about 90% of people on VisaJourney waiting for NOA2.. My NOA1 was received and dated (hard copy) June 2nd and has been touched twice (last time August 17)! We both are so frustrated and anxious.. Now I read after 9 months of waiting one poster received an RFE.. What is going on with all this? I've called California and they said until is reached the 5 month mark, there is nothing they can do.. Good luck to all of us..

  14. The other poster is correct, there are so many postings about this I myself have one also.. I filed end of May, NOA1 dated June 2nd and my papers have been touched twice (June 15 and August 17) and I have heard nothing.. Things seem to be moving very slowly (I filed in California).. All I really know is that it is running in the 5 month mark, so I have until end of October, first week in November.. I have called California and was told they are processing within their 5 month timeline (as stated on the uscis.gov website).. I am so sad and frustrated..   15. I am reading where several have not received their NOA2 (approval) yet.. I feel so alone, anxious, nervous and impatient.. Anyone out there in the same boat as me? My NOA1 was dated June 2 and it has been touched twice.. I know, I know I have written this before, but I just need to know I am not alone..   16. I hope all of us who have our NOA1 from June (mine is June 2nd) receive an approval and the NOA2 SOON!!! I wrote some things and have no idea anymore what is right and what is wrong.. I've read things on this site and another that confuse me to no end.. Know that all of you are in my prayers! My Senator contacted USCIS (California) and maybe that put my papers on the bottom of the pile - Who knows with immigration anymore! I'm anxious for all of us, but it does help (a little) to know that I'm not alone in the wait.. Everyone have a great weekend!

  17. If you go to Visa Journey Home Page, click on the 2nd paragraph, Immigration Timeline section.. Then about the middle of the page, 2nd column labeled "Statistics", you can choose "Historical Trends".. You can also go same page (after click on Immigration Timeline) and the 3rd column is a brief (and not 100% accurate) quick look.. As for writing this paragraph, for CSC (California where I send my papers) they are processing June 8th. Hope that helps..
