  1. Hi VJ friends,

Thank you for all your help. My hubby was approved his conditional GC on Friday. I thought I would share my experience as I am sure some of you might be nervous as we were. Our interview was in the immigration office in Los Angeles. Make sure even by mistake there is no camera in your purse otherwise they will not let you in. I made a mistake by carrying my camera in my purse as I forgot to take it out the night before. So, they told us to go back and put it in the car. So, I had to walk back to the big parking structure and find my car while my husband waited inside. Also,if your appointment says 9 or 9:30 does not mean they will take you at the exact time. We still had to wait for an hour before we got to go inside. Once you get inside there is a big waiting room and then they call you by order of the appointment letters they get. Your interview really depends on the officer interviewing you. We got an awsome officer and he only looked at our wedding pictures and had our AOS file that we originally sent in front of us. He was impressed that we did everything on our own. Joked around with us a few times and approved us. It did not take too long. I went through all the trouble to gather the other documents like lease, and bank letter. But it was not needed after all. I can't say that is the case with all because you could get a officer who might grill you. I guess we got lucky after all. If any of you have additional questions let me know.

  2. Ok so I have everything I possibly need now for the interview. Thank you everyone for your help. The only thing is the checklist requires petitioners birth certificate. I thought I had it, but I think I lost it during our move. I was born in India, and got my USC through citizenship. So, is the birth certificate for the petitioner really required??????????

  3. Here is my interview experience just a few weeks ago:We were called in on time. Very pleasant officer interviewed us but sitting behind her in the corner was another much sterner looking fellow. She asked for proof of our relationship. I gave her: 1 utility bill (comcast), life insurance policy showing my wife as beneficiary, a notarized letter from a friend attesting to our relationship, a letter from my bank saying we have an active account together and that was it.

After that she proceeded to ask my wife all the questions we had previously answered on the I-485. Then she asked my stepdaughter the same questions. She never asked for anything else and didn't ask me any questions.

After this, I asked them to stamp my stepdaughters Passport with the I-551 stamp because she needs to go back to Ukraine to take some exams for University.

The officer then said they needed to check some things and we should wait in the lobby until called again. About 10 minutes later she came out and showed us the I-551 stamp and said congratulations. She then gave us information about applying for the 10 year card in August of 2012.

    Thank you for sharing!

    Hi guys!

Just a bit worried about our AOS interview on Friday. Our interview is on Dec 3rd at 9:30 in Los Angeles. I have looked at the guides, but some of the required documents we do not have. We just moved into our apartment so I have not recieved any bills yet from the gas company or electricity. I have the lease documents which I will surely bring. Of course our wedding pictures as well, along with that I have a copy of the invitation. Along with the account information confirming our joint account. I don't have anything else. Can anyone share their experience on what they brought and how it went? Thanks again to all of you for answering my posts. Your information has been very valuable to us.

  5. Won't affect his AOS at all. He wasn't arrested so you don't need to mention it. It's kinda like getting a parking fine.

Thank you for your quick response. What relief! :)

you as a license driver you should know better, to let him drive with out a premit or driver license,to late now the damage is done.i don't know cali laws dmv,you most obay all the laws wile in the united states

Thank you! I agree I should have stuck to my instinct and not him drive.

  6. Hi guys!

Thank you for all your help in my previous topics. I hope everybody had a wonderful Thanksgiving weekend. Heres the sad story. My husband an unlicensed driver due to pending AOS got into an accident this Friday. I usually never let him drive my car, the times I have its been just moving my car from the parking lot. So, far everything had been great with his driving. So, trusted him to drive my car a few blocks down in a residential area. To make a long story short he lost control of my car and crashed the car into a fence and hit a parked car. I was not in the car with him was waiting for him a few streets down a store to pick me up. No one has been hurt he did not get a citation or nothing. We are going to pay the damages to the fence and the car. The police mentioned that he could get a misdemeanor, and it will not hurt him. But, our AOS interview is December 3rd. I am really worriedd. We reside in California. Will this hinder him from getting a license and will this affect our AOS interview on Dec 3. Somebody can you shed some light on this. Thank you!

  7. Hi guys!

I hope everyone is doing well, and moving along with their journey. My husband got his interview December 3rd. We both are a bit confused about the medical. He had his medical done in India before he came to US. They put everything in the sealed envelop which he already handed over to the the POE officer. But, on the list we got it said to bring medical information but in parenthesis it says unless alredy submitted. Also, we both are a bit scared about the AOS interview. As what we need to bring. Our wedding pics are not all developed yet we have a few that I can bring along with the invitations. We have both of our names on the lease documents of our place. We have not opened up a joint bank account, because they require ID. Can I still open without him having a license yet? Just a bit stressed. Any advice what to bring? Or anyone can share their experience? Also, what should I do about the medical.

  8. Jim - Thank you for the helpful information about the 693 forms. This has been very helpful to

keep in mind. I definitely do not want an RFE. I think I have had my share of those during the

    first initial process..lol

Menina- Thanks for letting me know about AP. I might as well do it. His I-94 expires on the 15th

the goal is to at least get it out tomorrow, and if it requires extra time I will get it done

    by Friday.

As far as assembling the packet. I was just going to paperclip it and seperate it in a manilla

envelope. I read the guides on the USCIS home page, and yes it states to use paperclips. So,

thanks for clearing that up Jim. How did you guys put your AOS packet togeter? Just want to

get some ideas so the officer reviewing our file is not lost..lol

  9. You need more than the bio page from his passport. You also need a copy of his visa, and you should also include copies of the entry stamps.

The wedding pics are not necessary.

You need to include passport style pics of your husband.

You need to include a copy of the NOA2 for the I-129F petition.

Did you get an I-693 from a civil surgeon?

Is his birth certificate in English? If not, did you include an English translation?

Whether or not you need to include bank statements has nothing to do with whether your income is below the poverty guidelines. It has to do with whether you need to bank statements to demonstrate regular income, such as if you're self-employed. If you have the tax transcripts, and they show you meet the guidelines, then you don't need to include any other evidence of income.

Don't use ACCO fasteners for the AOS packet. Use these guidelines instead:

Did you read the AOS guides?

    Hi Jim,

Thanks for answering my post so quickly :). I did the read the guids for AOS instructions

and it says to use ACCO fastners to assemble the paperwork so I got a bit confused. What is

the best way to put it in order. Thanks!

Yes he got his medical done in India, and according to what I read its still valid right? It has

not been a year yet. So, he should include the medical from India?

  10. Hi VJ Friends,

I am a bit late, but my AOS package is ready to mail out tomorrow. Yay!! I have included the

following and have questions. Please let me know if I am missing anything.

    I-485

    I-765

    G325A

copy of marriage certificate and his birth certificate

    copy of NOA2

check payable to DHS for 1010

one or two pics of wedding

    copy of 1-94

copy of husbands passport (biographic information)

    copy of his birth certificate

    1-864

    my employment letter

    tax returns for 3 years

Do I have to include employment letter in addition to paystubs? As I have all 3 years tax

returns. I just want to know what is the most important evidence of income information. My

income is above the poverty lines so its not a requirement to include bank info.

Please confirm and let me know if I am missing anything else as I am going to send it out

tomorrow. I am putting all this together in a folder with already acco fastners. Does it

    really matter how its assembled.

Thanks again for all the wonderful people that answered my prior questions.

  11. Hello everyone!

I am sorry I have not been frequently on so much. I come by and check on everyones progress, we

got married end of July, but have not applied for AOS yet. Planning on getting started this week

I just am so over all the paperwork that I am just happy my husband is here now. Anyways, all

of you are in my prayers and this AP will end. This AP is torture and I can understand the pain.

It will end, and there is a light at the end of the tunnel it just takes a bit longer ok.

  12. He came on a K1 visa, right? So, his visa expired the moment he entered the country. His I-94 stapled in his passport is valid for 90 days. At least in my state of CA, you cannot obtain a DL if your I-94 is expiring in less than 30 days. Even if you obtained the DL before that, it would expire along with the I-94. My husband was only able to get his DL once he got his green card. Our process was pretty smooth filing in January and green card by early April. So hopefully your husband can get his soon as well. I am not familiar with all states' rules, but some will allow the immigrant to drive with a foreign license. You will want to check the rules carefully because some states only allow visitors to do this and not immigrants who have filed for AOS and thus intend to stay permanently in the US. Good luck to with your AOS process!

    Hi Menina,

Thank you! Yes, I am in Cali as well. Its good to know it does not take long for the process. I guess the process before this has burned me out that now I am feeling a bit drained. But, just like the energizer bunny I have

    to keep going :).

    Star

    oh - everyone is confused...

that 'visa expiration date' is the last day he can enter the USA. It actually expired the day he came into the USA, and was given an I-94 document.

the expiration date on the I-94 is the last day on which you were to get married.

now, as for any drivers license - it varies by US State -

so - whats yer US State want to do about it?

With some exception, a US State will want to see -

    --green card or

    --ead card or

--visa with more than 120 days of validity on it.

He doesn't have any of those, so yer best bet would be , IMO, to cure yer tardiness.

Perhaps is good time to understand the licensing requirements for a 49.50 CC moped in yer state? Many US States do no require drivers license to operate (but do require this moped to be registered) and they're great for getting across town.

    Good Luck !

We are in California and the rules here are a bit different. But, they seem to be efficient

with the AOS process so I guess I have to get back on track. Thank you for the information

    its been very helpful.

  13. Hi there,

My husband got his SS# number, but it says only for work authorization with DHS approval. His

visa expires mid september. We got married end of July, and filing AOS end of this week. I know

I have been a bit tardy in filing all the AOS. So, today my husband went to get the license and

they told him since his visa is expiring they can not give it to him. Is this normal? At least

he wants to be able to drive. Is this such a problem to get a license at least. Anybody have

    the same trouble.

    Star

  14. Starlight! Great to see you back! I missed you. The SSN is dependent on legal status, so if his I-94 is about to expire, they will not issue it now. Once you have the EAD card, you can get the ssn with that. I only had to show my marriage certificate because I changed my name after marriage and wanted my ssn in my legal name. (I am the US citizen). Good luck with AOS!

Thank you Menina for your response it was helpful. Glad to be back :). I am glad that he still can get his SS number. His visa doesnot expire until mid September. So, I guess we still have some time.

  15. Hey Starlight!!

I just wanted to login and tell you Congratulations on getting the visa!! I'm one of the people who pop in periodically as I really don't have an up date other to say we are still in AP and we are hoping to get the good news this month!!

    Take Care...

    Dee

Thank you! :) I know being in AP is so frustrating, because I have been there. But, I can assure you that it will end soon and it will be all worth it once you both are together. Just hang in there, and everything will be ok. One thing being in AP has taught me is lots of patience :).

  16. Your co-sufferers in purgatory from the London Waiver thread will not be dropping off the weekly fruit tray today.

Given the failure to complete one single case in London since April 21st, we have opted to send a beer & whisky basket instead.

    Please excuse the half-empty bottles.

We might have cracked a couple already.

Thanks for dropping by as our luck here might rub off on you .

I am here just cheering my friends in AP on. As they all will be joining me to celebrate once their SO's get their visas as well.

  17. I agree with Treehugger. As that is exactly what happened to my fiance. 2nd interview he was told he was approved and they requested for his passport, and then got passport returned and told we were in AP. Don't book anything until you have your passport with visa. Just look at availability dates, but just don't put anything down until you have the visa.
