    If you are in the US you are adjusting not applying for a visa. Assuming you are a USC then overstays are forgiven when adjusting, misrep could still be an issue, but that just delays adjusting

    On the medical side just supply evidence as to what the treatment was and how it is not available in the US. Presumably he has this from his US medical team who suggested he travel.
