  7. Asylum I assume is balance of probabilities. Anyway you still have the issue of how do you process Billions of applications and let us say you have a 75% refusal rate that is still hundreds of millions who would be eligible. And nothing to stop the refusals using the current route.

  12. Refugees are handled by UNHCR, as they are outside, the Countries have control over who and how many they take. Not sure how many US has taken recently but normally seems to be around 100,000 or so, manageable. Asylum is a different ball game and goes back to the 1951 agreement and is supposed to be a process for those in a safe country when something has happened in their home. Well that seems to be the way it has been historically. The words used to describe Asylum can of course be interpreted in different ways, and have been, certainly subjective and of course difficult to substantiate and very easy to be schooled to say the right things. Using a generous interpretation I wondered if I would qualify. Big advantage with Asylum is that the asylum seeker chooses the country to seek asylum in, they just need to get to it. Anyway if it was dealt with like a B2 I would think Billions of people would be able to apply taking a middle of the road definition of qualification, so the only limiting factors would be processing and transportation.

  14. I am not sure where you got the impression I was comparing anything, I was making the comment that getting a job offer should be quick and easy. Biotech or otherwise. What case is very strong?
  15. You can apply for a B, if they determine there is misrepresentation that would be a life time bar, at the Consulates discretion they could recommend you for a D3 waiver.
  16. Good news is that I have seen some recently filed EAD's come through pretty quick. Expediting is effectively just part of the process now, you do not seem to have a strong case but you never know and I have seen some odd approvals. It is free so give it a go. Job offers are easy to get, certainly where I am all the Supermarkets seem desperate for staff. Lawyer or not as always is a personal choice, your money, this is a DIY site but obviously there are situations where legal help is needed. This does not seem to be such a case. Be aware that Lawyers have staff and it would be odd for a Lawyer to deal with a simple case. Assuming you are comfortable dealing with the paperwork it will inevitably be quicker if you do it yourself, a Lawyer is not going to have it as their prime focus.

  21. Probably not a work visa, not usual for a Nurse to get a work visa, more likely an EB3 Immigrant Visa.
