  1. I had thought of that and would add the following. She is in Germany so they would need to marry and then he would need to move to Germany. Norway, Iceland and Liechtenstein are equal partners in the internal market, on the same terms as the EU member states. This includes having access to the internal market's four freedoms, the free movement of goods, persons, services and capital. I do not know her skill set or when her time in Germany is up. She could of course move to Norway, now I have no idea about how long that would take, probably much quicker than a spouse moving to the US. She is an AuPair, not sure how easy it would be to get a short notice job offer that Frankfurt would buy.
  2. Simple route Get married asap She files the I 130 She finds a Joint Sponsor, Parent is usual. You arrive in the US as a Permanent Resident good to work get a DL etc Say 18 months from filing I also did a K1 back when it was a more logical option and still would do that again with the benefit of hindsight.
  3. I have seen people waiting for over a year on Pakistan for an interview
  4. How many times have you net
  5. https://www.usatoday.com/story/news/nation/2023/12/31/biden-work-permits-for-migrants/71931816007/ U.S. Citizenship and Immigration Services recently set up a pre-registration program – pioneered in Brownsville, Texas, and replicated in El Paso and San Ysidro, California – to more quickly process work permits for migrants who present at the border using the CBP One app appointment system, operated by U.S. Customs and Border Protection. Two months later, USCIS has made steady progress, the agency told USA TODAY. The median processing time for CBP One-associated work permits is approximately 30 days. Previously, migrants reported waiting four or more months from the date they applied. The agency is also providing on-the-ground work permit registrations in New York City, Chicago, Boston and Denver – resulting in nearly 5,000 work permits, USCIS said. It's a fraction of the 1,450 individuals per day, nearly 45,000 a month, who are processed via CBP One appointments at ports of entry from California to Texas. Unclear when this will be rolled out to other PoEs and other bases of entry. Of course there was a time when you could get a stamp that acted as a temp EAD, I think they stopped doing that about 20 years ago.
  6. Is this someone you have previously met or a first visit. I think most people would avoid the K1 and go CR1.
  7. 20 minutes to go
  8. Sort of interesting to speculate what the process will look like that far in the future. Surely it will be very different?
  9. Not sure what you mean by evidence, you need to answer the questions truthfully, not that it will not be obvious that you overstayed.
  10. I doubt it, he may have that choice but I would expect he would want to interview in Canada.
  11. Absolutely agree, if it was me I would absolutely want to know where I am, certainly not clear, not externally funded.
  12. If it was me What sort of conversation did you have with the CO about this. Were there others you worked with who wee on a J1, were they subject to 212e Have you spoken to your Uni
  13. Sadly I am not as familiar with the INA clauses as I should be
  14. EAD is free so yes you apply for it. I forget now if a K2 can like a K1 get a SSN after arrival, the way I read it either way you need a SSN so EAD is usually the quickest route to get it otherwise you are waiting for a GC.
  15. 1. They can not refuse you entrance so nil, you can surrender your GC. 2. Well I have only seen this happen twice and one involved a lady who whilst at college in the UK funded herself by providing personal services. This was not the one but a related story: https://www.thedailybeast.com/why-ai-is-detaining-sex-workers-at-the-borderand-you-may-be-next
  16. All I can think of is Consulate error. EB2 suggest you have a Lawyer and I know they have a way of accessing the Consulate and advising them of their error.
  17. Is this the only J you have had?
  18. Lots of people do this, someone I know her husband will file for his daughter when ha naturalises, she will pop over get her US Passport and then go home.
  19. The visa in your passport will say if you are subject to 212e. What were you doing on a J?
