  1. We are on page 162 of a thread where posters say otherwise.
  2. Look at it the other way around, imagine the outcry if PD progressed and the Consulate could choose not to acknowledge it
  3. That is true but a separate issue. https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2023/visa-bulletin-for-april-2023.html
  4. Agree but we are where we are. She should have held out for the GC and for him to adopt her children
  5. Just going back to the last post, there are lots of VAWA self help groups and mention of her spending a lot of time on her phone. From the OPs perspective her going home would be the best option. I just do not see a win win.
  6. I might check the other Consulates

  8. He has no say in her children, but unlikely a Court would allow her to take their child.
  9. The children can be included in her VAWA application. Assuming she wants to stay.
  10. https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2023/visa-bulletin-for-april-2023.html Seems to have just come out, well that is a major change, now I had seen people comment that it was coming. Obviously being just 19 or nearly 20 makes a difference, if you came on a K1 then you could have included children up to 21.
  11. You need to find the very best Divorce Lawyer you can. NOW From an Immigration perspective absolutely pull the I 864.
