They have been married 4 years, how many cases do we see on here that do not meet the 2 year mark and have no issue removing conditions etc. Lets say there was an issue regarding Dowry payment and a prior marriage, something ICE will get excited about? Seems like a lot of work for something that is not even an issue in the US. And that would not be a marriage fraud issue anyway.
  2. So why would ICE have an issue with a text from a LPR saying he was going to India, and then did not? Possibly this may come up if he wishes to Naturalise, if he has an undisclosed Criminal History that could certainly be an issue. Obviously no need to Naturalise and we do not know if he has a record.
  3. Visitors buy Travel Insurance, Medical Expenses is part of the cover, arguably the most important section. I am assuming she has a 10 year multi entry visa bit not all are issued that way. I have seen them issued with a trip time restriction, but that is advisory to the PoE.
  4. What am I missing, he said he is going to divorce her and return to India. If he had a criminal history which seems a guess, why did it not appear on his record?

  6. Your situation is what it is and obviously you should have considered how this would look prior to taking this course of action. Too late now so you just have to see how it plays out.
  7. Most people seeking entry on the VWP are asked a couple of routine questions then let in. Obvious we tend to see the extreme cases more often here as most people travel with out a second thought.

  10. I am never one to suggest somebody does not use a Lawyer, having said that somebody here on a Student Visa, assuming they are not trying to get a GED, suggests that they can DIY.
  11. What 90 days?, I have seen no end of Students adjusting, I am not saying it is the most popular route to stay but must be up there.
  12. Well the onus is on them and the worst possible case would be a waiver and not sure I have seen that. They would have to show Misrepresentation. Lawyer and mention of 90 days suggests they do not know what they are doing.
  13. The only problem I can think of is if you forgot to mention you were married when applying for a Student Visa, having said that I do not know exactly what the process is for Canadians.

  15. I suppose the first thing to do is find out what happened to SERVIS. Will it look odd absolutely. Will you be quizzed about it, I would think but no way to know for sure. Are you going back for language or your Masters?
  16. Why did you not apply for a student visa to study English in the first place? Did you study your Masters degree at all?
  17. Somewhat odd to consider the issue now. Quite how F2a will move is anyone’s guess no longer current
  18. Then when they arrive and they have the I 551 stamp in their passport, nobody can forecast the future all you can do is put yourself in the best situation.
