And what Visa could she possibly have had had that was still valid 31/2 years later? The only one that fits would be the K3 but that seems highly unlikely. My money is her coming as a visitor with presumably 3 children, marrying, maybe filing to adjust, divorcing and then VAWA. She has EAD but not AP.

  13. Once you use your EAD then you are no longer F1 ,but you can still study. May be some confusion. I always think it is a good idea to maintain status and not be reliant on adjusting. I assume you had a study plan coming to the US.
