    Ok, so let me ask this: can we buy cheap return tickets for my kids, not use them, stay in the US within the 90 days ESTA limit, and then book tickets for all of us as originally planned? Would that stay within immigration requirements?

    It seems that would work. You merely call the airline and cancel the tickets (might be able to get partial refund or credit for other bookings).

  2. The K2s are pending - they have not been issued yet, and won't be until close to their expiration date - which, btw, I thought was the date my visa was issued and not the date of my medical. We're still waiting for paperwork for the visas, which is why they would be traveling on the ESTA for now.

    The reason why we don't have the return tickets yet is because I can't book an unborn person's ticket as I will be returning with them (and the baby) to get their visas done.

    Then you have a problem.

    Book the children's return tickets and then book a ticket for your newborn when they are born.

    You're really going to take a newborn on a plane trip?

    We are ready to send the packet but i havent done the filing form of i129f. We dont have a cheque, therefoee other option i believe is money order. But i saw that it says on the instruction of filing i129f, if you are not in the us contact the us embassy in your location.

    No, everything is sent to Texas. And a mere MO may not be sufficient, the funds have to be drawn from a US bank. Get a cashier's check from the local US bank.

    That's because they are not involved at this stage. it is USCIS not the Embassy, two different entities.

    Quick question...for the proof of ongoing relationship in our I-129f we included

    1) photos together

    2) my I-94 travel form to show I've been to the US to visit numerous times

    3) statement of intent to marry

    Will this be enough? I always thought that the chat logs etc were to be taken to the interview?

    Sure, for now and for your country. Evidence of your discussions of you relationship are for the interview.

    I would like to know what happens after you sent the I-129F, I read that they will send a letter to your residence
    letting know the petition has been accepted.
    Is there any other way we can contact them to know that, can we call or email to them and ask?
    Yes you can sign up for email updates. Also you can go online and check the status.
    My fiance lives alone and he's a truck driver, so he wont be going home in a couple months and sometimes
    his mailbox gets so full that they start sending all the mail back to the sender.
    Then tell him to go online and fill out the USPS mail hold option. They will keep all his mail at the Post Office until the date he returns. He can specify that date and they will drop his box of mail on the date he desires...or he can tell them to hold it and he will pick it up at the PO>

    I am a greencard holder with two kids who have their K2s pending at the Embassy. I am also 34 weeks pregnant and now want them to travel to the US to stay with me for a few months, within the ESTA time limit,

    Wait, if they are to be given K-2 visas, then ESTA is not involved. The K-2 visa assumes that the children will be moving to the US. Is that the case?

    Why would they need return tickets if they are immigrating to the US? Your info is confusing.

    I know this makes things more complicated in terms of Border Control and as such I want to prepare a little info packet for them, to explain why there's no return ticket, and to give them what assurance we can that they will return to their home country and they will not overstay.

    The is no overstaying a K-2. The K-2 visa by the way must be issued before the one year anniversary of your K-1 medical.

    So, here's where your input and suggestions can come in handy. Here's what I had thought of putting in the info packet, so far:

    * On the travel authorization permit that both me and their dad will sign, stipulate the trip will not extend beyond 90 days

    * A doctor's note confirming my pregnancy and due date

    * A copy of my visa and original petition with their names on it

    * A copy of my greencard

    * A copy of my marriage certificate (because their stepdad will be picking them up at POE)

    * A statement explaining the return tickets have not been bought yet because the baby isn't born yet

    I wanted to get something regarding their pending case at the embassy, which expires in early June, but I don't know what to get...

    Also, as an aside question, they did an ESTA this past Christmas. Do I need to update it or anything like that, or is it valid as is?

    OK, so they are to come over to only visit for the baby's birth, then return and then later immigrate on a K-2 before June? Then why not purchase a return ticket? You can always change the flight date later.

    My ex fiance fiLed a fiance visa for me Last May2014 then he said he cancelled it December2014 whiLe waiting for the noa2(which makes me confused because he said he caLLed uscis&gave the case number for them to canceL the appLication) I thought no case number whiLe waiting for the noa2?

    You are correct. The case number is assigned by NVC. What he probably used was your A#, which is assigned to you at NOA1. However a potential problem could be that he merely called. That is not the proper procedure to cancel a petition; sending a notarized letter to USCIS is the correct way to do it. That all being said, with the time that has lapsed, that first petition should have expired by now.

    The thing is, my current bf wants to fiLe for a fiance visa for me on January2016 and I'm worried that my previous case wiLL affect our future apLication..

    any answers wiLL be greatly appreciated..

  8. I think I was unclear here. Some of my questions had to do with when we have our green card interviews later. I know we won't have things like wedding invitations, etc. for the K-1 interview, but when we are working towards his green card, I've read that having that kind of stuff can help to "corroborate" your wedding, though as long as you're legally married, I'm not sure why they'd need it. Regardless, we'll get over this K-1 hurdle first and then cross that bridge when we come to it :)

  9. First of all, we don't really have an engagement date.

    Not needed, only Letters of Intent.

    We talked a lot about it, and sort of just arrived at the decision that this was the right thing to do. It happened over several months, and I couldn't point to an exact date that we became engaged.

    Great, this shows the normal evolution of a relationship.

    I feel like it is likely he will be asked about this, but would it be better to figure out a date to point to as our engagement, or just be honest that it sort of happened gradually? (We would never plan to lie; our engagement date would just have to be retroactively determined.)

    That's how these things normally happen.

    The other thing is that, assuming we do get approved for K-1, we're only planning a very small civil ceremony to satisfy the marriage requirement, but will hold off on a wedding the way we want it until we've saved a bit and he's settled well into living here.

    Super plan; dovetails nicely with the visa requirements.

    We'd prefer not even to wear rings until we have our wedding the way we want it, but I understand that showing up to a green card interview without rings could be seen as pretty suspicious.

    Shouldn't really be planning any wedding yet, since you do not have the visa in hand. The Embassy would give you the same advice.

    NO....stop, do not do that. You would be creating more suspicion of pre-planning assuming the visa will be approved. You have to wait. The Embassy will tell you the same thing.

    That and lots of pictures, of course.

    There's no deception here, but I'm afraid that these things will be taken as signs that we're not genuine. I would very much appreciate any advice.

    Detailed wedding plans should not be included since the Embassy will tell you to not assume anything or any timeline for visa approval. Not having this shows you understand the process. Having this could show you do not understand the process or are being arrogant. Be humble and follow the process. It works.

    I believe have civil ceremonies at a courthouse or something very small.

    That's what we did. Didn't have any witnesses except the judge and our two year old.

    As long as you marry within the 90 days the type of wedding you and your fiancé chose to have doesn't matter. What's of most importance is the actual marriage certificate.

    Not really, it looks like your trying to hide something. Everything has to be transparent and in the open to allow the Embassy CO determine you have a legitimate relationship.

    Probably should act more adult-like moving forward since you must bare everything in order to allow them to approve the visa.

    Do they even read the letters in that much detail?

    Oh, yes....they even will check out your Facebook pages!

  11. Hello everyone, any suggestions/advice on what to take or expect at my biometrics appointment? How long does it take? whats the procedure?

    Bring your appointment notice and your passport.

    Depending on what time of day you go, it could take about an hour or more.

    You will fill out a form, then wait to be called, where you will be walked up by a rep to have your photo taken and your finger prints taken (some people have trouble getting good scans).

    Then you leave.

  12. I wanted your two cents. I am reading that they treat the I-134 with similar guidelines to the I-864 I am filing a K1 visa going through the embassy in Paris.

    My returns are as follows:

    I have been in college the past 5 years. I was filed as a dependent to my parents the last 2 years, making below the poverty level as a student.

    I graduated and in May 2015 began employment making $75,000 annually, as a full time employee. I can provide proof of employment, paystubs and letter of employment and such.

    My 2015 tax returns and w2 will show roughly $50,000 in income, which I currently have in hand.

    Under these circumstances do I need a sponsor to be safe due to the prior 2 years tax returns showing no/ low income due to being a student?

    No, you're good. Current income is key. Most former students don't have past incomes....because they were not working, they were students.

    There's only one and K-1 visas are hard to come by from your country.

    I will go to the regional and sniff around but if you could be a little more specific that would be wonderful

    Marrying first may be easier. For some Embassies, the K-1 is a slam dunk, for others, like yours, nothing is guaranteed.

    You need to read up on your own since your country is not my wife's so I don't pay too much attention to the details, but I do know what I read here on VJ. K-1s from China are not a slam dunk. Many denials.

    I cannot find anything about what she should bring. Am I missing anything? The online DS-160 is all?

    We'll have a package of K1 type information in case the CO asks for it,

    I'm going to tell her to be completely honest and transparent. It is a 1 in 1000 chance so do not worry about being denied.

    Read the Guides. She needs your 134 signed form and documentation. Your signed updated Letter of Intent. Her BC. Her updated Letter of Intent. More evidence of ongoing relationship.

    Now is not the time to get sloppyl You're an engineer, you know what she needs. Plan it out, make the plan and work the plan!
