    I just received my NOA1 today and an email varifying that my case has been accepted and routed to the California center from Texas.

    How long will it take to transfer it and finally reach California?

    Also, can someone give me a rough estimate of the processing time for the NOA2 from the California center?

    We realized one of the forms -the to be exact- asks for the beneficiary -or is it petitioner?- parents information.

    That's right.

    For us is an issue, being a same-sex couple, I haven't come out to my parents and thus, they have no idea I'm about to get married.

    Maybe take care of this first before filing any petition?

    Will the Consulate contact them in any way?

    It's possible, been known to happen, but very rarely.

    I mean why do they ask their information for?

    To verify your background and any connections to evil-doers.

    We're very nervous they might come to know about our relationship and purposes. it wouldn't be safe for me.

  3. When I sent my fiancee the paper work for interview (whenever I can afford it), I sent a month's worth of pay stubs. Now she is telling me I needed to send more. The pay stubs are online and I already paid $200 to send her the package of all paperwork. I can screen shoot them and she can find someone to print them for her.

    Only choice as I have no money. So my question is if more pay stubs really needed or not?

    Who is asking for more? The Embassy?

    I only sent about four pay summaries, plus had an employer's letter.

  4. When we originally sent off for our K1, my wife was 17, I was 20, she had to get a consent form from the courthouse and have her parents sign it, even though she was turning 18 before I actually got approved/went over to marry her.

    You needed that since you filed the petition when she was under 18 years old. If one waits until the person reaches their 18th birthday, then all that is not required.

  5. Good morning everyone, first and foremost I appreciate the effort you guys put into this project, helping people with their immigration questions and procedures.

    My situation is as follows, I am trying to bring my girlfriend through the K-1 process, I am a naturalized american citizen and she is from Venezuela, the first question I have is about her daughter, she is a minor and I could not find anywhere information about the traveling permit from the other parent of the minor ( her Dad) we already know it will not be a problem since my girlfriend already talked to the baby's dad about future traveling plans and moving to the states, so I need to know if they will require such a permit through out the whole process.

    This is Embassy-specific. Email the Embassy and ask, but most do require it. A notarized letter from the other parent works.

    The other question is about her divorce certificate, will it need to be translated and apostilled.

    Translated yes, can't answer the second part.

    And the final question will be in regards to my previous marriage, my ex wife got adjustment of status through me when we got married, it was a bonafide relationship, it was a long time ago, were married for around ten years and have a daughter together, it was not through the K-1 process, she came as a tourist and i proposed to her, it was not our intention to get married, i was just in love back then and proposed, everything went find and she got approved for her residence, she is already a citizen, so the question is, will it raise a red flag since this is my second time a person will adjust their status through me?

    No and especially since it was a long time ago.

    even if the first time was not through the K-1 process? The reason i ask is because if I am not mistaken i read on I-129F if you had petitioned somebody before, but i am not sure if what they are asking is through the K-1 process or not.

    There' a time limit and you didn't file a K-1 petition so it doesn't apply to you.

  6. So, I had my interview, last week on wednesday. My status change on friday for administrative processing. I don't understand. They told me after the interview tha my visa had been approved and that I would get it in 2 weeks or less.

    So, what's going on? Is the administrative processing just normal?

    Yep, everyone undergoes AP.

    Just more background checks, comparison to terrorist lists, ensuring all library books have been returned....that kind of stuff.

  7. Do you receive your approval/denial for the K-1 visa the same day as your interview or do you have to wait? If you have to wait, how long to hear if you've been approved or not?

    Usually but sometimes they need to do further AP.

    If they keep the passport, that is good.

    Usually Kiev lets you know that day....but we've seen a couple needing to wait for a year (very unusual case).

    How soon after the K-1 is approved can my fiance visit me in the U.S.? Is there a waiting period or can she visit ASAP?

    As soon as she receives her passport with the K-1 visa affixed inside, she can hop on the plane that day.

    Correct, must meet in person before you file the petition.

    as well as obviously we really want to anyway. Our concern here is that she is not 18 as of yet, and will be april 30th, hence why waiting for the first week of may.

    Could meet sooner, can't file the petition until after her 18th birthday, or obtain notarized parental consent.

    While we do have phone records, skype messages and calls, as well as transactions between our bank accounts, as well as when she arrives i will be proposing and will keep that receipt for the ring as well,

    Don't NEED a ring, but all mentioned is good evidence.

    as well as what can we do to provide sufficient evidence of our relationship. The 129 package being the first thing to be completed, and our situation currently, has us very much concerned and afraid. Anything would be great, thanks in advance.

    All seems normal to me. No problems seen at this time.

    So i was wondering how soon i could marry my fiance when he arrives in the USA. Like is there a minimum amount of time that we have to wait? We wanted to get married within a week after he arrived. Is that ok? I know we have a maximum of 90 days but we wanted to get married as soon as possible. I just wanted to make sure this won't be an issue when applying for his greencard right?

    NO minimum. Get married when you can but within 90 days.

  10. I am absolutely new to this and my biggest worry is filing everything correctly, so the process is not delayed. I have thought about using a Service such as Rapid Visa.com, but after reading some

    reviews I have decided to go about it on my own.

    It's really not that hard. Just Read the Guides and Follow the Example Forms.

    My girlfriend/soon to be Fiancee of 1 year and a half are trying really hard to get her here. My concerns are what do i need to send with the K-1 form. She does not have children and I have a Job here and can support her until she starts working. However I only got my Job offer yesterday, and after studying in Greece for 6 years I dont have income to show on my tax returns (I read that this paper is a requirement).

    Not a problem. You and former students have a good excuse. Current income is key.

    I do not have a facebook, but I have PLENTY of pictures of us. What evidence would they require, any information would be great.

    You have your passport stamps and photos. What about receipts to places, or such?

  11. I am a traveling nurse and do 3-month contracts with multiple agencies. Thus, it will be difficult if not impossible for me to get a letter of employment to send with the I-134. My income far exceeds the poverty guidelines, and I have tax transcripts, copies of my contracts showing salaries and dates, and recent pay stubs. Will this be sufficient?

    Yes

    Also, I read on another post that a bank letter is not required as long as you have other proof of sufficient income. Can somebody verify this?

    I am wondering about co-sponsor age, is it ok if he is 87 years old? he is a grandfather of the main sponsor.

    Yes, he is eligible to cosponsor.

    Also, if he is a retired and gets a pension and have stocks and bonds and real estate, what documents would be good for co-sponsoring in this case? And would be that acceptable?

    If the pension income is sufficient, then the other is not needed.

  13. Hey there, I'm a full time college student who's never been employed, and I'm just wondering if that would be grounds for a denial even though I have a signed affadavit of support high above poverty line?

    Depends on the Embassy. Some do not allow or deal with those on a case by case basis. In general, no not an issue. There are many folks who are students or former students.

    Can affadavit be someone who's not family member such as step father or someone who barely knows me?

    Yes, but must be a USC.

The problem is that we need a SSN to apply for a marriage liscense, we are getting very worried about the hold up and not sure how to handle it as we have until april 7th however the weeks are passing by fast. Does anyone have any suggestions? Extremely worried that we are going to run out of time before he gets SSN.

    SSNs are NOT required for marriage, only the passport. Go to the local county clerks office and apply for your marriage license (takes about a week) then schedule a marriage with the county judge (usually within a week of scheduling) and voila you are married. Make sure you request (pay) for multiple copies of the marriage certificate since you need those in the future (usually takes about two weeks).

    My wife did not have her SSN when we got married.

  15. 1. Since our case is dealt in CSC, how long does it usually take to get the NOA2 after we reply RFE tomorrow? Can't say but we've been seeing about 1-2 months.

    2. My fiance has a graduation ceremony in the middle of June. Do you guys think I can get approved in time so I can join his ceremony?

    IT would be very close. Figure another month for NVC after NOA2 and the two months or so for the Embassy and to get to the interview.

  16. Hello everyone! I have several questions about financial side of the K-1 visa process. Our petition got approved recently. I know I need to get done interview in embassy and AOS.

    1. Is that alright if my US fiance's income is close to the lowest line in Poverty Guidelines? For example, his income is 22,000 and acceptable for 2 person (me and him) is 19,912 right now.

    2. Also, he lives in US but works for canadian company like independent contractor (self-employed) so he can't get a W-2 form and 1099, Canada had their own forms I guess. He just files his taxes on his own, using form 1040. Is this acceptable for AOS and embassy interview?

    Yes, obtaining the free IRS tax transcripts is best.

    3. Also, Moscow embassy wants to see bank statements, but my fiance doesn't keep much money there, he spends it, so they won't see much income there. Do they ask to prove somehow your income in tax return if you don't have a W-2 or 1099 form? or they just accept the income you filed to IRS?

    Bank statements are not required. Have him obtain the IRS tax transcripts which are free.

    So, I would go in embassy with copies of: 1.1040; 2.1040 schedule C; and 3. bank statements (how many mons do they need?) for the last 3-4 mons. ; 4. I-134 form

    Or even better the free IRS tax transcripts. He can apply for them online.

    I would want to bring tax transcripts but for my fiance this option will be possible in June.

    He can get them for prior years and then just use a letter from his employer stating his salary (if he can get it but not a show stopper) and copies of recent pay summaries.

    I am wondering if these documents will be enough for both embassy and AOS? obviously for AOS uscis wants I-864 form and AOS seems even easier because, like I understand, they only need copy of tax return or tax transcript, no bank statements, no employer letter.

    Employer letter would help but not required if he can not get it. And yes all the same for AOS.

  17. Hello Beautiful ones! I was doing some research and u came across this site today, and it's been very helpful! I pretty much comprehend the instructions, and I see that some questions I had you all have answered. I'm unsure about one thing right now, and that is the Avidavit of Support form and proof of income.. do you provide proof of income along with the I 129F form or does this come after?? Thanks in advance!
