  1. When he was employed overseas his foreign earned income should have been reported then excluded on his tax return. US based income should be reported as self-employment income.
  2. They don’t expedite petitions for beneficiaries and care nothing about how much better off you say you would be in the US. They expedite petitions based on issues related to petitioners and nothing you describe here appears to solve or address irreparable harm to the US petitioner. Sorry dude.

We did not file until the SS card came in. You can also choose to exclude it based on pro-rated bonafide resident of home country test.

  11. Step 1 is for your wife to establish “intent to return” and come up with some kind of permanent US address. A family member worked for us. She needs to be up to date on taxes, open a bank account, transfer assets, get a state ID or drivers license, register to vote. They dont just hand out green cards. The USC sponsor needs to demonstrate full intent to establish residency and permanent ties to the US or you’ll get sent back from the interview until she does. Then she needs to file a petition for you. Is your little one also a USC? Might need petitions for both of you. Next she needs to come up with a way to sponsor you. She either needs to park about $100k in easily accessible assets in the US or she needs to have a job and make more than minimum income to sponsor you or you need a joint sponsor in the US.
  12. Mistake up there. File your taxes like you always have because you can make a million over the exclusion and it’s still ZERO income for immigration purposes. You attending the interview? They grill the USC on “intent to domicile” so prep up.
  13. Unless you are working for a US company and that income will continue your foreign earned income is (zero) for immigration purposes. It is completely discounted. They always do that notice on an asset-only case. It’s a flag for the CO to check your bonafides.
