But: You wanna play immigration you go to Riyadh. Even SB1 when the CO’s know you and your family. They can offer off the record advice but can’t touch it.

  7. My recollection was a couple weeks the letter came in and it was about two weeks later she took the oath. Interview 11/17, oath 12/17. I sort of flagged your trip for comment because the whole puppet show might be missed. This was Houston, all the offices are different.
  8. He can use the green card to board but when he arrives he needs to advise that he is a USC. They are going to see a problem as soon as they scan it anyway. It’s invalid. Then let them deal with it.
  9. The law is very clear here. No matter what, it has been deemed that entering / exiting is a fundamental liberty to USC’s, not a privilege. CBP must establish a claim of citizenship and once established there is no law or penalty or action that can be applied that allows them to prevent you going on your way. Now, what they do with you while they are establishing citizenship? Not really something I’d like to test out. Between when you enter and they follow up they can pretty much do what they want. Thats something to avoid.
  10. Basically Once citizenship is established on re-entry he’ll get chewed out but there is nothing, at all, that immigration can do once citizenship is confirmed. Lots of case law on that LOL. The magic word is “citizen”. Unfortunately the proof of that is probably with the passport application. He won’t enter on that green card and he shouldn’t be using it. He’ll get held in a back roim until they “establish citizenship” and that might be a miserable experience that they make as miserable as possible on purpose to make a point.
  11. Very true but mostly on behalf of their US born children. OP’s in a tough spot but what to advise? The rules are clear and other than possible state programs or charities there isn’t much to suggest. I know in Texas he’d be out of luck from a public benefits standpoint but there are a lot of charity organizations he could check with. We plan for this for years. Decades. Lifetime USC’s with access to benefits have trouble balancing these things. To bring an elderly parent over without building any kind of safety net is irresponsible on so many levels.
  12. FYI our oath ceremony last year was about a month after the interview. Based on what you’re saying it would have fallen in the middle of your planned trip. At the interview it would be good to carefully explain your situation and ask for your ceremony appointment to be scheduled a few weeks out.

  14. Income from the same company is considered continuing income and is creditable. Income and assets of the beneficiary are creditable. Has his company advised in writing that his job will continue in the US on visa approval?
  15. Married. It’s your only choice. If you don’t owe any taxes you can wait as long as you wish to file and can wait for his SS number.
  16. FBAR terrified us working overseas. The penalties are steep. Intent to establish US residence is another hurdle. Job hunting is one thing on the list. It’s typically advised to open a US bank account and start moving assets over. Is there somewhere in the US you can temporarily address to? Family member? We used my parents once and my brother another time for this.
  17. Oh you may not have owed taxes but you assuredly had to file. I hope you haven’t (ever) been keeping more than $10k in your UK bank account. The penalties for not complying with FBAR are brutal. FBAR is the number one reason for people to dump their US citizenship. Your income in the UK is (zero) for immigration purposes however if you are doing an intra-company transfer it will count as long as it continues from the same source.
  18. I doubt he loses a moment of sleep. This is a crime that is nearly impossible to prosecute and prove. Once tagged a crime the perp gets a lawyer, a jury and can say absolutely nothing while the government has to convince the entire jury beyond a doubt that a crime was committed, having never stepped foot in the couple’s house.
