  1. Its a simple matter of filing AOS before not after your I94 expires DL, job, etc you can still get. Clearance, etc? Gotta wait. The OP was asking about a license, not security clearance.
  2. She becomes an LPR immediately on entry as soon as her passport is stamped. Make sure the green card fee is paid, but she can arrive, turn around, and fly right back out if she chooses. Please advise her not to stay out longer than six months. She can leave and return on her immigrant visa (read the bottom of the visa) as it is equivalent to a green card for up to a year after it is activated on entry.

  5. So they told you to exit and re-enter on AP? LOL Everyone adjusting status is “authorized pending adjustment of status”. We already told you that. When you are authorized to stay and authorized to work you are also qualified to obtain a drivers license.
  6. NOBODY who is adjusting status has to leave and re-enter to re-set their status from “authorized to lawful”. Where in the world do you get this nonsense from?
  7. Your authorized stay is determined by USCIS and has nothing to do with whatever the IO at the airport typed in when you entered.
  8. You have a SAVE case number. Check it from time to time. There is something not updated. If you are pending AOS, have an EAD authorizing you to work, then you are legally authorized to stay. You have exactly what you need to get a DL. Unlike the Republic of Texae Ga DMV employees probably don’t know how to use computers.

  10. Home visits are extremely rare and it is even rarer for a working spouse to be at home during the day if they do visit. They would be looking for evidence he lives there. If there is one toothbrush, only ladies clothes in the closet, none of his mail or his things in the house, that would trigger interest or suspicion that you are not living as a married couple. Again, it is extremely, extremely rare for USCIS to visit a home.
  11. A USCIS I485 receipt, EAD card, and SS card are generally the “status docs” to obtain a DL. What state are you applying in?
