  1. You can correct it at the interview. IF this were my case I would bring a fully updated support affidavit to the interview.

  3. Yes you should have filed an I-824. Send one in with the RFE reply and withdraw the I-485. Costly mistake. It happens.
  4. Then send in a reply with the RFE stating the beneficiary is not and never has been in the United States per the filed petition and send in a copy of the petition with your answer. Advise there is no arrival / departure information for this beneficiary. Advise that the I485 was filed in error per request and that the beneficiary will not be adjusting status.
  5. Then your mother in law must have stated in the petition that her relative is in the United States. This case is a mess. Get your MIL to sign up here and we can help her fix it. She needed to file a simple I-130 for overseas relative which would go to NVC/State Dept after approval. Somewhere she stated that her husband is already in the US. That needs to be fixed in writing. On paper it looks like your FIL is here illegally now because she said he is here and there is no record of him entering.

  7. You were not supposed to file I-485 for an overseas relative. They are now wondering how your relative got here because I-485 is to adjust status if you are already in the US.

  9. No we left the US once for 3.5 years and once for 4.5 years and moved back to the US together. Both times we had to go through getting a new visa and I had to prove intent to domicile and both times we flew out to the US together. So we have done what you guys are doing twice. It’s an old game for us.
  10. Assets are typically used to make up the difference (3X for a spouse) between actual and required income, but they are not required if not needed and if they do not make up the difference. Not sure about you but if you stole all my assets when I was in school you’d owe thousands and thousands. I’d suggest reporting your income as per your tax returns and leave the assets blank.

The list of “communicable diseases” is here: https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-6 I remember when HIV was on the list but that was taken off about 10-15 years ago. The other part of the exam that deals with inadmissibility issues is related to addiction, drug use, and mental health. Make sure you have plans for her insurance and care. Best of luck.
  12. I think you probably have enough. The tax return issue is easily fixed, all of us have to file returns every year if we make below the minimum threshold but overseas income is then “excluded” up to around 110k and you end up owing no taxes to the US anyway. More of a correction than anything. Let us know how it goes. We advise overseas couples all the time, learn something new almost every case. My wife and I “returned to the US” twice so I know what you folks are going through. Best of luck!

  15. We had to get one after entering on K3. We had a copy from overseas, the doctor pretty much just copied the copy 😡 then charged us for the whole puppet show. It’s a racket, hate to see this happen. As advised, schedule a new one soonest.
  16. I did this twice from overseas. You have enough. She does not have to travel ahead of you but she must at a minimum accompany you. The standard is “show intent to domicile”. Had you asked I would have advised step one is transfer your assets (bank account) to the US. You have lots of time to get this done. SS number’s on the tax return. They know she has one. What mistake on the tax return may I know? Advise if it is filing status?
