    we got married way beyond the 90 days. but i was concerned about filing. i dont think the papers will be ready by the end of 90 days or a little over the 90. but of course we will try our very best to keep it within.

    but just in case it dont, i wanted some two cents.

    Filing outside the 90 days is not a problem. The only problem you may have is if you encounter a CBP officer while you are out of status they can detain you.

    Also if you wait longer than 180 days past I-94 expiration then DO NOT plan on traveling and using an AP document, having 180 days or more out of status will get you bared from re-entry even with an AP document in hand.

    i meant we got married within the 90 days. got here in march and married 2 weeks after.

    but the papers might take a little over 90 days. is that ok?

  2. ive read many posts and heard many opinions...

    so which is which?

    on a K1 visa, already in the US... the couple has to marry within 90 days? or marry and file within 90 days?

    ive been told to just marry in 90 days and file asap. if filing is beyond 90 days, its not much of a problem. as long as the couple has married in 90 days.

    but ive also heard that both marrying and filing should be within the 90 day period.

    your answers and opinions are greatly welcome and much appreciated.

  3. Hi! I know there's a recession going on and jobs are hard to come by. But in the several interviews I've got, I've been screened out not by my qualifications but by lack of US experience which is a total bummer. I mean, how can you get US experience if no one would hire you because you don't have any US experience. It's like being a fresh grad wherein companies would hire experience fresh grads. It's a catch 22 situation for me right now. Anyone care to share their experiences?

    we didnt have enough phonecall records, tickets or receipts together... etc. although we got an RFE.

    but we sent more of what we just had - more pics and emails and chat archives and just carefully provided the other requirements.

    and got approved - when all i had was a thin envelope of evidence and others had a whole stack of them.

  5. this is just strange. you probably met the requirements of presumptive death but still they werent satisfied with it.

    as for your title -- denied because of failure to establish that the two of us have met -- i think the whole presumptive death holds the bigger part rather than the establishment of meeting.

    its just wierd. you have all it takes to be approved. sorry to hear.

  7. Here is the short story:

    september 22: sent AOS paperwork

    october 7: received an RFE

    october 22 : USCIS received more evidence and updated my case:

    Response to request for evidence received, and case processing has resumed

    3 months and 3 weeks later(today) i got a letter of denial, because i had 87 days to submit evidence and i never did(#######???).

    So we sent all of the financial #######, but missed something.

    I've called them about 4 times in the last four weeks, none of them goddamn f**rs said anything about any papers missing.

    What's gonna happen now?

    Do we reapply? Do we pay another ridiculous fee for the AOS?

    Please, help, i'm desperate!

    same thing happened to us. and our file was put on "abandoned" status.

    we waited for an RFE that never came. and we kept calling and they kept saying wait for 30 days. but still no RFE.

    so he called and called and called... only to find out, our file was no longer inactive and was now an abandoned case.

    i dont know what he said but he was so pissed that he just cut them off.

    then lo and behold, a USCIS supervisor (he said he was) called my fiance back and apologized and told him that the would activate our file again.

    and when ask why it was on abandoned status, he said - because we never called USCIS to update our file.

    now #######. :angry:

    but oh well, we finally got the RFE in the mail which was total ####### cos they just wanted more pictures. we already sent tons when we applied.

    anyhow, i hope things get straightened out on your application.

    and yes, moving to MI. ive been on the secretary of state's website but it doesnt say much about getting a driver's lic.

    i always use my international driver's lic when i go there, but since im on K1 now. im just wondering if i can just get a license from the DMV.

  9. hi sis. good luck on your medical exam.

    best time to go is early, like maybe 6am so you can fill up the forms ahead of time. though the whole process starts at 7am but the guards will let you in at 6.

    and to be more specific, the initial interview will have you stand infront of a filipino officer. pre-interview they say. its just a window, much like when you talk to a bank teller or employee. this can be seen by anyone. cos you just come upfront a window.

    with the actual consul officer, you go inside a small room.

    and this is just you and the consul officer. youre provided a seat, and you are separated by a window from the consul officer.

    my pre-interview took about less than 10 minutes and so did the actual interview.

    its the waiting that takes long.

    on a round off... i got through the gates at 6am. they started calling priority numbers at 7am.

    by 9:30am i was out with the pink slip.

  11. I was doing research on this too, and the Social Security offices are supposed to be informed that K-1 Visa holders are able to work with the k-1 stamp even if they don't have the EAD stamp from JFK.

    I suggest tou call your local SS office and ask them if they are aware of this. They should give your fiance (e) a SSN with work authorization even before the marriage takes place and before the Visa expires of course!

    Depending on which U.S. airport you fly into (NY JFK) some will issue a temporary 90 day work authorization if asked for . If issued, the employment authorization ends on the day the K-1 expires. You will have to file for an EAD when (or after) you file for AOS. If you do not receive your EAD before your K-1 expires you must stop working until it is received.

    if asked for? and depending on the POE?
