  1. Thank you. I think @JANETandLYLE is adjustment of status after a K1 (entry was done 15ish years ago), but it is my understanding that it is the same requirements. Am I correct?
  2. You really need to read the instructions for the affidavit of support: https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf Do you have an accountant to handle the taxes for your business? Maybe @pushbrk could help you understand better, and you could then submit your adjustment of status, it has been long overdue now.
  3. I went back to your history. Have you talked to someone about that persecution complex? Someone will find the exact statistics for you, but 90%+ of removal of conditions are approved. Just keep sending all that you have. No one is trying to get you.
  4. Yes, absolutely. You could have been traveling without access to the Internet and not even know the new card is in production. Some people have had trouble by discussing the status update with foreign check-in agents at the airport, since there is no need to confuse them (expired card+letter of extension=valid documents) "B. U.S. RESIDENTS — must provide one of the following: • Permanent Resident Card, Form I-551 • Expired Conditional Resident Card, Form I-551 accompanied by Original Form I-797, Notice of Action indicating the card validity is extended [...]" see page 10/92: https://www.cbp.gov/sites/default/files/assets/documents/2023-Nov/Carrier Information Guide ENGLISH.pdf
  5. Are you against adding each other as beneficiaries on financial documents? What about wills, living wills? Those things are important in life, not just for immigration... Are yours set up to someone else, or did you simply forget to set it up (wills, beneficiaries)?
  6. Wills, living wills? Without sharing accounts, aren't you beneficiaries on each other's accounts?
  7. There is nothing else anyone here can predict. Reapply when you want, but understand that you might never get another visa. Maybe time will help, maybe not. No one here knows what was noted on your file, and the consulate does not have to disclose it. The only certain thing is that if you do not apply, you will not know. Please come back and update us after your interview.
  8. Really dependent on the employer and/or position. Most jobs requiring only a GED or high school degree won't care or ask. Then, if you have years or professional experience, your most recent accomplishments/certification/whatever will weigh more heavily. College applications, again, it depends. I completed another graduate program after moving to the US and I did not have to have my courses/degree evaluated, and simply submitted my transcripts; but in other fields, I would have had to... I would not pay to have anything evaluated before I knew for sure it would be requested.
  9. Please read the guides and the instructions for each of the forms, that will answer most of your questions. If anything is unclear while preparing the petitions, do come back with more specific questions
  10. No need to notify anyone. If you want to include a note, you can always say something like: "As requested, please find enclosed: a) ...; b)..., c) passport (recently renewed)" - however, this is not necessary.
  11. I think you need to stop, think, discuss, and decide where your children will/want to live (are they in college? do they want to live with their other parent?, and other factors important to your family). If the plan is for them to live in the US, then having your spouse petition them asap is the quickest, most efficient, way to go. It they will continue to live in Canada, then they are able to visit you.
  12. Did the consulate tell you you have to go in for a second oath?
  13. https://www.visajourney.com/timeline/profile.php?id=478346 It will help members understand where you are in the process. What kind of applications have you filed? How many of them?
  14. Are the prison visits contact, or no contact? Are they exactly the same type as the people you know who were approved?
  15. Stay safe, especially if you are unsure how he'll react to the separation. Take care. https://www.thehotline.org/plan-for-safety/create-your-personal-safety-plan/
  16. After moving you need to file this form: https://www.canada.ca/en/revenue-agency/services/forms-publications/forms/nr73.html asking CRA to determine your residency status. When you get the determination, you can provide it to your Canadian employer with it (you might be EI or OAS exempt, for example). However, before moving, or making any decision, I would consult with a fiscal accountant.
  17. This was an interesting read; no idea about the accuracy though https://withoutmyconsent.org/50state/filing-pseudonymously/federal/#:~:text=In federal court%2C a plaintiff,a motion with the court.
  18. From the wording of the letter (hard to tell from how the cut is done), but it seems to be denied because of the two bullet point lines in the letter, failure to establish "bonafide..." and "... citizenship". I was asking about cohabitation, because @mallafri76 seemed to imply that physical contact/contact visit was a condition of approval in her post here:
  19. No need to tell us, but during those 12, or 8, years, have you ever cohabitated, or has he been incarcerated the whole time? Just wondering if that is their reasoning behind "Establish a bona fide relationship with the beneficiary". Hopefully, other members who have adjusted status while their partner were incarcerated will be able to provide guidance.
  20. Since you got your status through VAWA, you might want to ask @Sandra G. about the best next step, in this thread:
  21. As I said, you can travel by land with the enhanced driver's license. Mail it in, when your father receives it, drive back to pick it up and to enter on your visa. Now that you wrote that you have a TN visa, that might support your request to get a second passport. If you are in the US, you might want to reach out to the consulate for your area.
  22. As I said, you can travel by land with the enhanced driver's license. Mail it in, when your father receives it, drive back to pick it up and to enter on your visa. Now that you wrote that you have a TN visa, that might be useful to support your request to get a second passport. If you are in the US, you might want to reach out to the consulate for your area.
  23. If your province offers enhanced driver's license, get one and travel by land (to the closest US airport, if you need to fly). Another option is to request a second passport from Passport Canada, however, it might be hard to argue, since it is for a hypothetical one time occurrence.
  24. Thousands of possible reasons, can't say before you get the letter, unless you know from your situation where the hiccup could be.
