  1. Where does it say that? The instruction says: You MUST attach a photocopy or transcript of your Federal income tax return for only the most recent tax year and complete Item Number 16.a. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years and complete Item Numbers 16.a. - 16.c. Type or print the most recent tax year and your total income for that most recent tax year. If the amount was zero, type or print “zero” or if you were not required to file a Federal income tax return type or print “N/A” for not applicable. Typ But my income is not sufficient regardless so additional returns won't help me much. Having said that, do we include the negative number or 0 (for no income)
  2. What does it matter if I'm using a joint sponsor? My income is not enough to meet the household requirement either way. (as a petitioner). I'm the joint sponsor, and I will be filling out all 3 years which shows consistent uptick in total income, but I'm asking specifically for the petitioner. A youtuber highly recommended here recommends to put N/A for amount if the total amount doesn't meet the household requirement for the last two years except most recent ones.
  3. Yes, I confirmed that it's a 2+1 setup, so three people in the household—not four like someone else had mentioned by mistake. Now I have a question—this is from the petitioner’s perspective; I’m just helping them out. Here’s what their income looks like: Expected income for 2025: $50,000 (just an estimate) 2024: -$50,000 (this is due to the spouse’s stock market loss. Should I list this as -$50,000 or just write $0 and attach the W-2 to show actual income earned?) The petitioner did make 50,000 in this year but tax return transcript shows -50,000. 2023: $50,000 2022: -$10,000 Do I need to include the income from 2023 and 2022 too, or just focus on the most recent year? If i just include the most recent year do i fill out the question for 2nd and 3rd most recent year or leave them completely blank? I don't want them to assume we did not file taxes for last 3 years. Also, should I attach tax returns for each year even if the income was $0 or negative? That part is a little unclear—any help would be appreciated.

  6. Hi everyone, I’m seeking clarification on how to properly fill out Form I-864 in this specific situation. Applying for parents and asking on behalf of a friend. In 2024, I personally earned $50,000, but due to my husband's stock losses, our joint income reported will show - $40,000. My current annual income for 2025 is also $50,000. For 2023, our total joint income was $40,000. For 2022, we had a total joint income of - $10,000 (again, due to stock losses). I’m using a joint sponsor whose income is consistent and qualifies on its own. However, I still need to complete my own Form I-864, and I want to be sure I do it correctly. My questions: Should I include a cover letter explaining that although the tax return shows negative income due to my husband's losses, my individual income was $50,000 in 2024? On the form, for the three years of tax history, should I: Include 2022 and 2023, even though they reflect negative income? Leave those years blank, since I’m not required to submit transcripts? Or write zero instead of a negative number? For my current income, should I just list $50,000 based on my job?

  11. Sorry new to this. I guess i put it in the wrong forum? How do i move it and where? I'm a US citizen. Acting as joint sponsor for a relative (also us citizen who is sponsoring parents to come over).
  12. I'm sponsoring someone, and my income alone meets the requirements. My spouse and I file taxes jointly, but he doesn’t want to be involved in the sponsorship for personal reasons and therefore wants to avoid sending his W2, etc.. I only want to use my income—not his. What’s the best way to do that? Should I send my W-2 along with our joint 1040, even though I’m only using my income? Is that enough? And for the part that asks for total annual household income, do I enter just my income or the total from the joint return? Will USCIS be able to tell that the total income is 100k, but we only got w2 for one person, so that must be their income ? Thanks!
