  1. Yes the delay is not on my end but could be on the employer end to hire me in US and do the transfer. I know they came up with some management approvals earlier and I am thinking if they do the same now indicating if it will take sometime to get through the hoops and rehire me in US. I was just wondering if I am ok to enter US and then wait for employer to do the internal work. I am willing to start immediately, its just the employer side I am not sure. And I don't want to keep waiting for them but enter and get my physical GC as soon as I can.

  3. Thanks AppleBlossom, You are greatly helping so many people. So I can land in US to do my landing and wait for my employer to transfer my international position and payroll to US even if it takes lets say 2-3 months for them to do so. There is no requirement for minimum timeline for me to join the position after entering US with the same employer.

I have EB2 interview in Montral next month and I wanted to ask if I should wait for my employer to shift my payroll to US from Canada before I can do entry on immigrant visa to get my physical Green Card. There could be little bit of delay and red tapism at HR and approvals needed to transfer and I wanted to make sure I get the landing done and get my GC while they get that started. I will most probably still work for the employer Canada location on Canadian payroll from US once in there physically while they transfer my position payroll to US. Appreciate any thoughts and suggestions. Thanks.
  5. Great advice and thought. My company lawyer is aware of it but they didn’t want to deal with it since its additional expense so I am hiring outside counsel for her. This lawyer can become representative for her using G28. Previous consultation with another lawyer suggested this approach to have her visa scheduled few months after as 601 waiver can only be given to family members of GC or citizens hence that approach. But I understand the perspective that consulate may say you willingly left her. Something I will discuss with lawyer tomorrow if she should attend interview with us or afterwards and how to go with 601 waiver just due to GC or Citizen clause for I-601 that applied.
  6. Thanks for the suggestions, very useful. Yeah she is not the main applicant. I am the main applicant. Any idea if consulate need to suggest her 601 waiver or they just reject and person can schedule interview again and also drop the waiver? We are talking to a lawyer tomorrow to check.
  7. Hi All, I am looking for some sample for "For employment-based visa applications: A letter from your U.S.-based employer dated less than one month ago." Appreciate if anyone who has already gone through consular processing can provide an sample indicating what should be included in this letter. I will be asking HR but wanted to provide maximum details so there is not a lot of back and forth going on regarding this. It has been mentioned that ask your lawyer and HR previously but I wanted to see if I can prepare a sample and send to them for validation. Please let me know. Appreciate any inputs. This is needed for EB2 consular processing Canada through employment.
  8. yeah she need to have a waiver filed like 601 for 212 6ci in past which they will not give until spouse is GC so only option. We are planning to go first myself and kids and then once we get GC she can file for waiver after interview, at least that is the plan right now.

We have been called for Immigrant visa interview and I wanted to reschedule my wife's interview to later date so we can get GC first and then she will accompany after a bit as she will need a waiver. Is it possible to do that in portal to reschedule hers first where I can go to interview first and I can reschedule hers for later on? Portal says the date has not passed and will be able to do it afterwards. is this true? Should she just not go to the interview and we can reschedule the interview afterwards. Appreciate any guidance on how we can reschedule hers for later date and remaining family on the date that consulate gave us. Thanks

  11. Hi All, We have a consular processing interview scheduled for EB2 and I wanted to check if I need any offer of employment in US from my employer at the interview. I have all the documentation including I-140 and documents filed and wanted to get more information if this will be needed so I can ask my employer. There has been some changes in our management and the process has become lengthy within company to get letters like this. Appreciate any thoughts.
