  1. Sorry, to clarify, he's 27--I mean adult guardianship (based on his disability). While I can get guardianship in his country, I realize that it would probably be counter productive to him getting a visitor's visa. So we are only looking into a visitor's visa. *Edit to add, he is Serbian so unfortunately the VWP doesn't apply.
  2. I'm afraid I already know the answer to this question, but I want to make sure there isn't something that I'm missing. My son, 18, was adopted from an Eastern European country as a child. He has a biological brother who was not able to be adopted at that time but that he/we have remained in contact with. His brother, an adult, is disabled and resides in an institutional setting. Because my son was adopted, their legal relationship is considered severed and he can not sponsor him as a biological relative. He also has a medical condition that requires medication and an intellectual disability that presents much like autism. He is verbal and able to communicate but would not understand complex questions. Is there any chance that he would be approved for a visitor's visa? We would obviously fly to his country and back with him, and we would pay someone to help him complete the paperwork/transport him to the appointments. Because he is an orphan and disabled, he has no real way to show ties to his country though. However, he does receive support from the country and would have documentation from his social workers that he has a home there, a "job" in his institute, and permission to travel. I've looked into obtaining guardianship for a more permanent move to the US, but while becoming his guardian would be easy to do in his country, there is no way we would be able to get a permanent visa. So, we're hoping to have the opportunity for him to visit a couple of times a year (he has asked us to come visit several times, and I really want to make this happen for him.) Has anyone had a similar situation and the individual was approved? I don't want to start the process and get his hopes up if the chances are zero.
