My mother was diagnosed with very aggressive cancer.. the doctors gave her a year or two. Would this count as eligibility? I would want to move back to the US with my spouse after my visit in June.

Hello! I am currently living in tirana, albania. I have been here for two and a half years and am a dual citizen (Albanian-American). My mother was recently diagnosed with cancer and I’m going back to the US to be with her. However, my partner will still be in Albania. I plan on coming back in June and am wondering if those 5 months I spend in the US make us ineligible to apply for DCF CR1 visa. I would apply now but I’m going back to the states right before Christmas and have seen most people take about 4 months for the process. So I guess the question is do I have to apply through the regular route or can I still apply for DCF when i return to albania in the summer. Thanks :)
