  2. Bummer. It's not your fault but I was very excited that I might have a chance. Today was a huge disappointment but I will manage it.
  3. That is what I understood but other members are telling me I have a 10 year bar to reentry. Can you clarify, please?
  4. I was never informed there was any bar to my entry.

  6. How do I find out if there is a bar applied to me? If there were wouldn't that have shown up at my last entry?
  7. I only just learned that I may be forgiven for my overstays as the wife of a USC. I admitted my overstays and the dates on my i-485. Does that then make me ineligible?

  9. Under general eligibility and inadmissibility grounds I answered "yes" to question 76. Since April 1 1997 I was unlawfully present in the United States as I was present after the expiration period of authorized stay. My original post was to clarify the USCIS wording regarding immediate relatives may be forgiven even if the applicant has EVER violated the terms of their nonimmigrant status. Is it the length or the amount of times that are a factor in the likelihood of having issues at AOS?
  10. I was admitted to the US on a B2 after a visit to Canada, I then went back to Canada a month later for a funeral and was admitted again. My B2 expired Sept 24 2024.

  15. The intent was to visit my mother however it turned out differently as life sometimes does. I wouldn't want anyone to read my post and think that my intent was to stay permanently. That was my bad phrasing. I tried to find the address to send my concurrent filing to on the USCIS site and failed to find it. Can someone point me in the right direction please?
  16. @EmilyW I was not asked if I was living with anyone at the border. At the Canadian/US land border they mostly just scan a Canadian citizens passport and waive them through.
  17. It seems too good to be true! Am I understanding correctly that "Certain bars do not apply to an immediate relative. An adjustment applicant applying as an immediate relative may be eligible to adjust status even if: -The applicant is now employed or has ever been employed in the United States without authorization -The applicant is not in lawful immigration status on the date he or she files the adjustment application -The applicant has ever violated the terms of his or her nonimmigrant status I came to the US from Canada in 2000 to live with my Mom who was an lpr. I met my now usc husband shortly after and we moved in together. I have lived here ever since. I went back to Canada to visit once a year and was always granted reentry to the US on a visitors visa. I was never questioned any further after answering the question "what is the purpose of your visit" with the truth. That I was visiting a friend (a life partner, business partner and roomate as well but that was never brought up) and was welcomed to America for another 180 days. By 2016 my husband and I had a thriving business, two dogs and a house. I started to get more nervous that if I visited Canada that I may not be able to return to my home so for about 7 years I didn't. I had not looked into immigrating as I assumed my overstay disqualified me. Since then I have traveled out of the country 3 times always with no problem coming back and the last time I returned to the US I again was granted an 180 day B2 visa that expired Sept 24 2024. My true love asked me to marry him and October 1st 2024 we finally made it legal. I have no criminal record and have financial proof I would not become a public charge. I would love to file and finally become a lawful permanent resident. In the experienced view of my fellow visa journeyers does my case look promising or am I missing something? It really does seem too good to be true.
  18. I don't think it got that far but unfortunately I only have some of the paperwork from that time. My mother sadly suffers from dementia and wouldn't be able to tell me. It's probably safe to say no.
  19. In 2011 My mother filed an I-130 on my behalf as the unmarried child of an lpr. When she began the petition she listed my address as hers as we were living together at the time. We received a notice in 2013 that the petition had been approved but I was not eligible to file AOS and the file was being sent to NVC for consular processing. In 2017 the approved visa was received. An interview was finally available in 2019 however by that time my mother no longer met the requirements for the affidavit of support and abandoned the application. So in part 4 of my current AOS (which my USC husband and I are filing concurrently with the I-130) do I answer yes or no to the question 1- "have you ever applied for an immigrant visa at a U.S. Embassy or consulate abroad?" My mother applied for me and we did not make it to the next stage. 2-"Have you ever applied for permanent residence WHILE in the United States?". The original petition had the U.S. address I was living at on it. Thank you for persevering with this wordy question and thank you in advance for any input.
  20. I have already check yes on the box asking if I engaged in unauthorized work. I'm just not sure what is the best language to use. What kind of explanation and circumstances are they looking for? "I needed to earn money" just seems a little basic.
  21. I began earning money in the U.S. while visiting my Mom on a B2 visa and was introduced to my current USC husband by her. He and I formed a business partnership and romantic relationship which continues to the present. Any input on if this is 1. An acceptable explanation of "events and circumstances" about my unauthorized work and 2. what others have experienced/ written for pg 10 question 16 of the 1-485, would be greatly appreciated!
  22. I have a lease on my winter residence in Florida and am a Canadian citizen for tax and all other purposes.
  23. Just to clarify my Canadian government and banking mail is sent to my sisters physical address where I live in summer. Would that not be my most recent address?
