I am working on a K1 application and I don't know what to submit to show that my fiance's customary divorce happened. It has been several years since he divorced and nothing was filed for the marriage or divorce. The reciprocity schedule says (I added the bold for the part that applies to us): 1.)a.) Where there is no Customary Court in the area, a Magistrate Court may dissolve a customary marriage. The courts may dissolve a traditional marriage without one of the spouses being present or even knowing that the divorce took place. Do we submit affidavits describing the marriage and divorce? Does he file an affidavit with the court? Does he start a divorce proceeding even though the marriage ended years ago??
