Sometimes I am just so swamped with work during the day that I cannot even find time to come here, even though I know it is super important for me to listen/understand/follow your advices. Those are different things" At the time I was creating the OP I did not know it was such a multiple choice: for most purposes in this country it is either you're married or single. So I thought Single would the status (but "Widowed" is just total bogus: my attorney couldn't have put it on the application). Even if they would've put Single on the CoN instead of "Widowed" it would've been so much better. ... And also: I want to thank each and every one of you for your attention to this case and thoughtful advices. According to what I got from the advices, I will not be giving up on this K-1 and will continue the struggle till the end. And only then, if my fiance is still not with me, we'll be going towards CR-1. And, in turn, IR-1. I've talked to my fiance, and we're determined to fight for our relationship and this case. And I understand that the most important thing now is correcting the error on the CoN first and foremost. This was perfectly explained. Now, with that additional information that I have given (that many people were asking, as to how I got my N400), I hope to hear the advices based on those details: how my circumstances change for this case in that context. The attorney's office was waiting for my feedback (explanations, more details, etc.) in response to the RFE concerns, and I just sent all I could yesterday after carefully listening everybody in these 2 threads what's important in this case, so I will not miss anything in my response to the lawyer. So the attorney's office is to contact me in the nearest future. "Did attorney know about naturalization certificate issue? Was this discussed when filing I-129F?" Frankly, I don't think they noticed it or had any concern about this being of any importance since all my divorce documentation was in order.

An attorney filed my K-1 I-129F petition. Everything was done properly, everything was included, with very good evidence of multiple meetings, photos, boarding passes, descriptions, etc. We expected rather an easy approval with no delays.

But I did agree with the statement that it might apply: "USCIS may never give your future spouse any sort of immigration visa if they're not happy about your naturalization" as the cause of these issues per se. For proof of citizenship a copy of your US passport is another option instead of a naturalization certificate" I was given the list of documents by the lawyers office which filed my K-1 petition. The list of documents contained both: CoN and Passport. My guess the Service requires CoN if the petitioner was naturalized. Again, thank you for clarifying this! This explains it all. More and more I get the sense that I am dealing with pure evil. And in it for a long haul (possibly years). How can they make people wait 1.5+ years just to respond to your FOIA request? Isn't it just pure evil? I naively thought that I could expect some human decency and justice, but I guess there's none there... I also guess I am in the same boat with other mentally tortured people (isn't it just mental abuse at least? to go through this). I meet the requirements, I know my fiance for a very long time, we've met countless times. I dearly love her, she loves me so sweet, but we hit a wall with a Punisher given sadistic powers. This is so absurd. I'm not a criminal, never had a problem with law, I make good living and generally consider myself a good person not doing harm to others. How am I in this Boat of the Unfortunate? Looks like even if I could produce them that imaginary Dead Person (which I cannot obviously: this is discussed in the original thread this one was split from), next thing they will ask is to bring that Dead Person back to life?? Pure insanity. Torture. Abuse. But made totally legal. And at the same time on the other hand they complain so much about "other people not being perfect". Hypocrisy at its core. Of course some situation might change regarding the set of documents I will have for the next filing and then I could file again. That said, please who knows, can you answer? Is it possible to apply for another CR1 once another CR1 was denied?

One thing in this battle against Dead Person nonsense that I think is important: If they deny our CR-1, can we file for another CR-1 or there is no way and we need to wait for IR-1?

Thank you for clarifying this. This is what we should have done a long time ago. We were meeting every 3 months and had no idea we could marry like this and right away go with spouse visa. We would have never done K-1 if we knew we could easily marry (usually to marry in most of the countries there is some waiting period and not even close to fit into a short vacation). I am waiting on my attorney's opinion, but it looks like K-1 is a dead end here already since we're in a long haul fighting providing a Dead Person that never existed (details are in the other thread). While we wait for the nonsense to clear we might be easily stepping into the IR-1 territory with the lawyer doing what he can.

It is perfectly clear. But it seems that application will be denied anyway (since there are real problems: they are discussed there). So I am seriously considering just not responding to that RFE and close that petition that way. But instead just to marry ASAP (and for what seems to be possibly years to come) to fight case after case (CR-1, then IR-1) to bring my wife to this country that way. Whatever it takes. The sooner she becomes my wife the better. But keeping that K-1 petition dragging for them just to deny it anyway after months and months (years?) seems to be just a huge waste of time, money, and everything else. Sooner or later I will be able to bring my wife into this country, if I apply again and again for her as my wife, bug Senator, Congressman and Assemblymen 's offices, call TV and Radio stations telling this truly crazy story and post on social media. It is important to realize: this might become a totally unbreakable loop: one Immigration office might refuse to correct the CoN asking for proof that I was not "Widowed" at the time (which I cannot see how it is possible to produce) and also since because it was 25 years ago, and at the same time the other Immigration office would deny petitions without the Death Certificate. Which makes me think my fiance and I need to marry (and actually as soon as possible) and start the countdown of "going through these circles of hell" as a married couple seeking to be together no matter the effort, money, and how long it takes. That said, I continue reading and reading posts on this forum day in and day out realizing that the sooner we marry the better, and also an attorney that I've talked to regarding this case says that spousal visa under these circumstances would have been preferrable. So if this K-1 drags on and they kill this K-1 petition (which is easy for them to do since I cannot magically produce a Dead Person for them) I don't want all this time to be wasted and my loved one to be away from me for undetermined amount of time. I really think more and more that I want to go the CR-1 route as soon as possible (i.e. marry as soon as possible and start the countdown for then, in turn, IR-1) just to put a stake into the ground, timewise, by marrying ASAP. If CR-1 will not work, then we go IR-1 and seek justice contacting frequently the Senator, Congressman and Assemblymen's offices. There's no skeletons in my closet. I say what it is: "Widowed" was printed in error. If it would not be in error, the simplest thing to do would be to get a Death Certificate and be done with it. But there is no dead person to get it, so no death certificate could be produced, period

Truly, no. They have not asked us to check the Certificates before the ceremony, and there were hundreds of us at that ceremony, otherwise I would've noticed the "Widowed" error, since I was single at the time. After I've received the Certificate and was either on my way home or even later than that I did not see an issue with it thinking why would it even matter? All 25 years I thought it doesn't matter. Until it did.

It just never was an issue of any kind before. So, it was a typo I thought, so what? Never bothered me. And I only need to act on this now because this issue came up for the first time in 25 years, first time ever
