    Yesterday, we receieved an email from the NVC to say our expedite was accepted by the embassy. It's the first time our status has changed from "NVC" on the portal. So it seems like they've finally looked at our case and realised they've made an error in not giving us an IL earlier.

     

    We still haven't had an IL, but now that they've changed our status, we should hopefully get one when the next batch is sent out! Although, I'm not getting my hopes up too much yet.

     

    How is it for you? Any updates on your end?

    After you get DQ'd you should receive a letter that states you are in the queue and that the next communication from NVC will be an Interview appointment or a letter after 60 days to say you are still awaiting an appointment. This was not happening with my case after I switched to London from another embassy. I sent multiple requests to NVC over the last few weeks and finally got a reply that wasn't a generic copy and paste email. This then triggered the 60 day email. I'm hoping this means I will finally get the interview letter this month. 

    Thank you! I've just submitted another request, highlighting that we're not getting the 60-day emails. Hopefully this will back up what I've been trying to tell them for months.

     

    The generic emails are so frustrating, as even when I ask for a genuine reply, I get the same template.

    Hi, We didn't get an IL, no. That's what has prompted me to write this post and is why we're considering the writ.

     

    What are the 60 day emails from the NVC? We haven't been receiving any other than the same template responses to the public inquiries we're making.

     

    Our embassy is London, yes.

    Yeah, I agree, but unfortunately we don't really have the funds to get an attorney. We're also in a difficult situation in terms of jobs/accomodation - so we're considering suing as last attempt/to draw some attention to our case.

    Have any of you had any experience/understand of how exactly to go about filing a Writ of Mandamus?

     

    You may have seen my previous post about our case being skipped for the past 6 months. We were documentarily qualified on the 11th of April, and we still haven't received an interview letter!

     

    We have asked our congressman to submit queries, and we have also requested to expedite the case - the congressman received similar unhelpful template responses, and the expedite request was ignored.

     

    We now have no choice but to consider suing the NVC.

     

    How do we submit the initial writ? Do we sue the NVC and the embassy? How is it done from outside of the US, etc.? And what state would we file in? We are at the begining of researching the process, but any tips or advice would be much appreciated!

    I don't believe so. The representative we asked to contact the NVC received an email that differed from what we were told by the NVC. This is despite the representative asking the exact same questions as us. 

     

    I'm not sure the NVC always look at the facts of a case before responding (e.g., only respond to the subject matter [delay, etc]). The responses often appear auto-generated too.

    You can ask for an expedite, you can ask for status, I have no idea what look at you case more closely means.

    Judging from my current situation, I don't believe the NVC are doing what is asked. 

     

    When I email them, I received the same template responses, even when I ask for a response that isn't a template. I'm not sure that the NVC are looking at our case at all, only responding to the queries.

    Hi @Ceycey, do you have anyone who can pursue the IL from another position? To put more pressure on the NVC. We've reached out to my wife's congressman, but will also look to go down the legal route (writ of mandamus) if that doesn't work. 

     

     

    Like us, you might need them to look at your case more closely, but they refuse to when they think it's just a general enquiry about timelines

    I am, yes. Currently I'm travelling, but I will work out the full timetable when I return.

     

    We have contacted a congressman, and the NVC is sending the same copy and paste emails back to them too! Although, the NVC openly admitted in an email that they are processing DQ cases from June now - so we were definitely skipped (as DQd April). Hopefully that gives the congressman enough evidence to push back. @PACMAN82 maybe it's worth you trying to contact someone from a legal side if this is the case for you too?

    Odd if your spouse is a USC though. Standard case, you haven't transferred from another consulate or anything like that? And the date on your DQ email is definitely 11th April?

    Yeah, perhaps it's not the error on the system I thought it was. But either way, a ridiculous delay. 

     

    No we haven't transferred and we definitely got the DQ email on 11th April. 

     

    The congressman we reached out to has said that they'll contact the NVC again this week. Fingers crossed!

    @SourisMigratey, just checking but your spouse is a USC, not Green card holder? And your case won’t usually be transferred until after you have an IL, so don’t worry if it still says it’s at NVC. Normally it’s IL, then status changes to ‘in transit’, then finally ‘ready’. 

    @appleblossom My spouse is a USC, yep. Ah okay, I didn't realise that - that gives me some hope that it's just a delay rather than an error with the system (which could last forever). How long does it take for the status change to happen? Is it once you've selected an interview date it goes to 'ready'?

    I have queried with NVC and so far they have not bothered to even reply. I’m hoping someone has recognised the error and is sorting it, however I won’t hold my breath.

    I'm sorry to hear you're in the same position too - although it's good to know we're not the only ones, so hopefully when they realise, we'll all get issued the IL!

  13. Hi,

     

    We need any advice/help.

     

    I am an applicant for a CR1 visa, and we were documentarily qualified on the 11th April. We still haven't received an interview letter. This is despite others DQd months after us getting their letters. I am worried, because all of my documents/vaccinations will soon go out of date again.

     

    We can see on the portal that our case is still at the NVC, even though it should progress to the London embassy to begin the process of arranging an interview after a week or so (IL to be sent a month or so later). This indicates an error with the system or that our case is lost in someone's inbox, etc.

     

    We have tried emailing the NVC, but every email gets a generic template response - our situation looks too much like someone just complaining of a delay, rather than highlighting an issue with a lost case.

     

    I have also tried calling the embassy, but their reps are incredibly rude, and don't have much information or means of contacting the NVC.

     

    We have also informed our congressman, however, they are now receiving the same generic responses from the NVC/embassy as us.

     

    Is there anything else we can do? We are in a difficult situation regarding jobs, flat etc. alongside this!

    It's a CR1 spouse visa. When I check online, it's all accepted, and the last email we received was to say we were DQd. I've checked, spam, etc. and nothing. I did email the NVC and Embassy a week or so ago, and got an email from NVC to say we were DQd and to wait, and then a generic response from the embassy to check FAQs. Very frustrating, as we've been waiting forever now. I'm probably going to try to email the embassy again.

  15. Hi, Congratulations to all who have had their IL!

     

    We were DQ'd on the 11th April - is anyone else still waiting for their IL from the 11th or earlier? I've seen lots of IL go out to those DQd a little later.

     

    Also, does anyone know if the letters are sent out only at the begining of the month, or are they sent at intervals throughout the month?
