  1. Yesterday, we receieved an email from the NVC to say our expedite was accepted by the embassy. It's the first time our status has changed from "NVC" on the portal. So it seems like they've finally looked at our case and realised they've made an error in not giving us an IL earlier. We still haven't had an IL, but now that they've changed our status, we should hopefully get one when the next batch is sent out! Although, I'm not getting my hopes up too much yet. How is it for you? Any updates on your end?

  3. Thank you! I've just submitted another request, highlighting that we're not getting the 60-day emails. Hopefully this will back up what I've been trying to tell them for months. The generic emails are so frustrating, as even when I ask for a genuine reply, I get the same template. Good luck - I really hope you get yours this month too!
  4. Hi, We didn't get an IL, no. That's what has prompted me to write this post and is why we're considering the writ. What are the 60 day emails from the NVC? We haven't been receiving any other than the same template responses to the public inquiries we're making. Our embassy is London, yes. Thanks!
  5. Thanks, I'll review the guide. Yeah, I agree, but unfortunately we don't really have the funds to get an attorney. We're also in a difficult situation in terms of jobs/accomodation - so we're considering suing as last attempt/to draw some attention to our case.
  6. Hi all, Have any of you had any experience/understand of how exactly to go about filing a Writ of Mandamus? You may have seen my previous post about our case being skipped for the past 6 months. We were documentarily qualified on the 11th of April, and we still haven't received an interview letter! We have asked our congressman to submit queries, and we have also requested to expedite the case - the congressman received similar unhelpful template responses, and the expedite request was ignored. We now have no choice but to consider suing the NVC. How do we submit the initial writ? Do we sue the NVC and the embassy? How is it done from outside of the US, etc.? And what state would we file in? We are at the begining of researching the process, but any tips or advice would be much appreciated! Thank you!
  7. I don't believe so. The representative we asked to contact the NVC received an email that differed from what we were told by the NVC. This is despite the representative asking the exact same questions as us. I'm not sure the NVC always look at the facts of a case before responding (e.g., only respond to the subject matter [delay, etc]). The responses often appear auto-generated too.
  8. Judging from my current situation, I don't believe the NVC are doing what is asked. When I email them, I received the same template responses, even when I ask for a response that isn't a template. I'm not sure that the NVC are looking at our case at all, only responding to the queries.
  9. Hi @Ceycey, do you have anyone who can pursue the IL from another position? To put more pressure on the NVC. We've reached out to my wife's congressman, but will also look to go down the legal route (writ of mandamus) if that doesn't work. Like us, you might need them to look at your case more closely, but they refuse to when they think it's just a general enquiry about timelines
  10. I am, yes. Currently I'm travelling, but I will work out the full timetable when I return. We have contacted a congressman, and the NVC is sending the same copy and paste emails back to them too! Although, the NVC openly admitted in an email that they are processing DQ cases from June now - so we were definitely skipped (as DQd April). Hopefully that gives the congressman enough evidence to push back. @PACMAN82 maybe it's worth you trying to contact someone from a legal side if this is the case for you too?
  11. Yeah, perhaps it's not the error on the system I thought it was. But either way, a ridiculous delay. No we haven't transferred and we definitely got the DQ email on 11th April. The congressman we reached out to has said that they'll contact the NVC again this week. Fingers crossed!
  12. @appleblossom My spouse is a USC, yep. Ah okay, I didn't realise that - that gives me some hope that it's just a delay rather than an error with the system (which could last forever). How long does it take for the status change to happen? Is it once you've selected an interview date it goes to 'ready'?
  13. I'm sorry to hear you're in the same position too - although it's good to know we're not the only ones, so hopefully when they realise, we'll all get issued the IL! Thanks, hope it works out for you too!
  14. My wife has already made contact with her representative. Frustratingly, the rep is getting the same responses as us. The NVC just won't investigate further.
  15. Yes, thats what I'm thinking. It seems to be the only option left for us at this point if the representative can't get any further. Will have to look into how best to go about it.
