  2. While true, I always go by the philosophy of sending the strongest case possible and with the AOS, hoping to get a waiver for the interview

  5. The only vaccine record Jaycel had when she went to SLEC was her COVID Vaccines so on day 2 of the exam, they administered 5 vaccines and she was all good to go. The cost of the vaccines is included in the medical exam fee so it is way cheaper than getting the antibody tests done.

  7. You would put any valid status she has at the time of filing which would be her CHP - Cuban humanitarian Parole as long as you file the application before it expires. You might even want to put "CHP - Cuban humanitarian Parole - AOS Pending Adjudication". I'm not 100% on that last part so if someone with more experience in these matters wants to chime in.....
  8. Like @JeanneAdil mentioned, hang onto your USPS receipt as proof that you filed. The overall risk is pretty low, but since the consequences can be serious I understand your concern 100%. Just try to avoid any encounters with law enforcement and stay away from areas around the border until you get your I-797 Receipt Notice just to be extra cautious.
  9. While technically true, they still are in legal status for 90 days after entry on that visa which is what they are concerned about. OP, do NOT resend the packet at this point. You do not want two AOS packets being processed. Give it a bit of time and remember that Monday was a Federal Holiday. Did you send a G-1145 in with your package to get e-notification of receipt?

  11. At this point the Adjustment of Status review is completed and approved and the Green Card is on its way according to your status update. No reason to worry over it affecting the application. It says case closed on the status because as far as USCIS is concerned, your spouse ment all the requirements to adjust status, approved it and printed the green card. Congratulations!

  13. Hmmmm I haven't seen any timelines around for a standalone I-131. I know when it's part of an AOS package, the biometrics usually comes 4-8 weeks after receipt of the applications

  15. No, this is saying you have to have completed a DS-260 application. You only need to bring the confirmation page with the barcode on it with you.
  16. When you scheduled your interview appointment on the US Travel Docs website did it not provide you with a confirmation letter to download?

And now it's back on the I-485 LOL The "My Progress" tab on Jaycel's I-765 was at 3 months before the biometrics appointment, right after the biometrics it went to 40 months for a week and then went to 7 months for a few days. Then 3 days before she got her approval it went to 14 months.... 🤣

  19. Just be aware, the Philippine Consulate in San Francisco requires the Utah Online Marriage Certificate to be apostilled by the Lt. Governor of Utah in order to file the ROM
  20. With the box checked and the blanket waiver code assigned to the COVID vaccine part of your DS-3025, that means your vaccinations are considered complete for the purposes of your AOS. The C3 code indicates the vaccine is contraindicated by the physician due to allergic reaction. Very rarely do USCIS Adjudication Officers overrule a physician on a medical decision. They will on procedural issues or incomplete paperwork but rarely on strictly medical judgement calls like vaccine contraindications. Just send a copy of your DS-3025 as supporting evidence along with your I-485 when you file. As far as filing the AOS within the 90 days, there is nothing that says you have to - HOWEVER if you do not file within the 90 days, once you hit day 91, you are out of status. It's all about your risk tolerance, especially in light of the incoming administration's promise to crack down on those in the country unlawfully. If you file the I-485 and have the receipt number, you are then in a period of "Authorized Stay" until it is adjudicated. I would highly recommend filing before your 90 days has passed.
