  3. I know it's from a different country, but Jaycel and I did not fill out the DS-160 or schedule her medical until the status of our NVC Case showed "Ready" at the embassy. Note that the expiration date of the visa when it is issued will be 6 months from the date of the medical exam, not the date the visa was issued so you do not want to do the medical too early.
  4. Send ALL of the Bona Fide Marriage evidence you can put together, whatever they asked for in the RFE and include the original RFE letter (all pages of it) on top of your response. I would also make a copy of that RFE letter and a copy of the whole packet you send back to them for your own records. You do not send the I-485 again. I had an RFE on my I-129F and I also included a cover letter underneath the original RFE letter, itemizing all of the things I was sending to them in response to the RFE.

  6. This is perfect... Like Family said, bring it to a Notary Public and sign it in front of them so they can notarize it and send it in with a trackable express shipper. (USPS is probably the best here since I would bet the Service Center address at the bottom of your NOA 1 is a P.O. Box) I would even attach a copy of your NOA1 to the letter.
  7. This is actually better than what I wrote. You definitely want to do your best to protect any future potential victim of her scam by being 100% forthcoming about why you are withdrawing.

I would keep it simple - After being married, you discovered that you and your wife are physically and emotionally incompatible, she has now abandoned the marriage and disappeared and that you plan to file for divorce or an anullment. The links provided by @Melancholic Mage above give you a great template and since you just filed last month, I would send the letter to the service center listed at the bottom of your I-797C receipt notice you received for the I-130.
  9. OP - I can't tell you how important the last part of this is. PROTECT YOURSELF. Please. You even mentioned in a previous post that you realize what lengths someone as desperate is this will go to immigrate here.
  10. Like everyone said before me here.... waste NO time withdrawing the I-130 and I-864. Get the letter written today.
  11. Because while a "Legal Ceremony" makes you legally married, a big church wedding, with family, friends and community involved is stronger evidence of a bona fide marriage and intermingling of friends and families.
  12. The K-1 visa application will NOT have an invoice ID. You cannot create an account in CEAC as a K-1 visa applicant as you are not allowed to upload anything there. As asked before, when you check the status of your case in CEAC, does it say "Ready"?
  13. If this does happen, just make sure that you follow up with the medical office to be sure they send it to the embassy. I would also be pressuring them beforehand to try to get them to send it before your interview so that you can avoid this scenario.
  14. Assuming you are approved otherwise (i.e.: No other disqualifying issues), you will likely be given a 221g "Refusal" pending receipt of the medical exam by the embassy. Once they receive the medical, your application will go into the normal administrative processing necesary to issue the visa
  15. K-1 visa applicants do not create an account on CEAC as they do not upload any documents there. When it's time to create the DS-160 you don't need an account.

  20. After going through this whole process just to risk it all to have a party? Admittedly as @Crazy Cat said, the risks may be small but the consequences are huge. I would not even be in the same zip code of an event that could be misinterpreted and jeopardize everything I have worked for. Just my 2 cents since you asked
  21. Yes!! It’s the only way we knew when Jaycel’s EAD Card was going to arrive because even though the status on her I-765 says “Card Was Produced”, it still says the tracking number is “Unavailable” and she got the card delivered almost 2 weeks ago. LOL
  22. Yes they can include just the joint sponsor's income. They would include a tax transcript AND a W-2 form from the joint sponsor. Normally USCIS does not want a W-2 with the IRS Tax Transcript except in cases where they filed "Married Filing Jointly" and want to exclude the income of the spouse. See below from the I-864 Instructions: If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.
