  1. @FamilyMeaning that if they denied me with founding of 204c I would never be able to adjust status again ?
  2. Thank you all for your help. I guess I am just going to wait and see how everything involves. I am not sure if I want to sue for delays yet. I think I am going to give it a couple of months. thank you everyone again!
  3. @OldUser Taxes for the 4 years together. Joint bank account, joint lease ( that was missing some signatures since from 2018 to 2020 it was not the original ) this was one of the issues in the NOID 🙂‍↕️ my fault or lawyers since they should had check I guess. 4 affidavits, pictures, we have issues breaking the lease during divorce so proof of us dealing with the leasing office. Proof that we both were paying the rent after separation. More pictures, auto insurance. Proof that we transfer money back and forth to pay for bills and such. we did not have medical insurance so we submitted a medical power of attorney where he gave me power of his health if something happened. car insurance on his name and I was on it as a excluded driver. Reason for that it’s that the insurance was extremely expensive based on our age.
  4. @Boiler No! tourist visa. as I said I have a lawyer. I just been looking for more options and maybe another lawyer to sue USCIS for the delay. However, since I have a NOID it may get deny and I would just waste like 5k.
  5. @Family @Crazy Cat Got married 2016 got green card 2017 ( no interview) Submitted I-751 2019 updated I-751 joined to waiver 2020 apply for citizenship 2021 got combo interview 2022 for n-400 and I-751 waiver - decision could not be made during the interview. Got a NOID notice in the mail 2023 - requesting more bona fide evidence. He started to see someone during Covid and I found since we were more time together during lockdown… one day she got pregnant and that was it. We decided that it was time to let go. I move out back to my family house file for divorce and never really have a real conversation again. He has 3 kids now and 4 on the way with the same person. We were legally married for 4 years. it’s been 4 years and a couple months since the divorce he continued his life and I continue mine.
  6. @FamilyMy attorney says that he will file both I-130 and I-485 if I receive a denial. However, I am the one wondering if I could get a stamp while the new I-130&I485 is pending since I would be still considerate a permanent resident until I go to court. You are completely right tho. You polices are about to change and I guess I should wait and see. oh no! Waiting for that NOiD one more year 🙂‍↕️… I have been waiting two years since I sent the response. I just got married. 4 years after my divorce.
  7. @Family so let me see if I understand. I should be able to get the stamp even if I apply for new I-130 after I-751 denial ? I call them and I ask for the stamp just like I have been doing these past years only that this time I would have a I-751 denied and I-130 pending. when I ask for the stamp I said that is for my case I-751 that was denied and that I am waiting for my NTA ?
  8. @OldUseri dont think I realized that I was typing all capitals since I was on my pc. I will contact the user that you mentioned. Maybe he/ she can give me an input. I am just trying to figure out what my options are at this point.
  9. @Crazy CatI WOULD NOT APPLY FOR A NEW I-130 IF MY I-751 IS PENDING. IF MY I-751 WAIVER GETS DENIED I WOULD LIKE TO APPLY FOR NEW I-130 SINCE I WOULD NOT HAVE ANOTHER OPTION. YOU CANNOT HAVE TWO MARRIAGE CASES OEPN AT THE SAME TIME. I AM CHECKING WHAT ARE MY OPTIONS IF I GET DENIED. IF I GET DENIED CAN I GET A I551 STAMP WHILE WAITING FOR NTA LETTER ? CAN I SEND A NEW I130 APPLICATION?
  10. @Crazy Cat yes, they were the ones that mentioned that I could apply for a new i-130. However, while I wait for the new I-130 to be processed can I get an i-551 stamp that way I won't lose my job and get kicked out of school. according to him, I am a permanent resident until a judge says that I am not so, I am guessing that I would have the right to continue getting an i-551 stamp until either of the two cases gets a decision. i could be wrong tho.
  11. @Crazy Cat how can it be solved if I sent them all the proof that I have and still don't get approved? If the case results in denial.
  12. @Sam Walz I don't want to refile a new i-751. if denied I would like to start over since I already sent them everything that I have as proof. i just don't want to lose my job or get out of school while submitting the new i-130
  13. @appleblossom I am currently waiting for approval for the i-751 waiver. However, I got a NOID 2 years ago and I haven't heard back so I am looking at the worst case scenario. I am wondering if I get denied can I get a new i-551 while I file for a new i-130 and while I wait for NTA.
  14. - if the is I-751 denied for lack of evidence of bona fide marriage - can I submit a new i-130 with a new husband? Can I get a stamp while the new i-130 is being processed? to continue working and as proof of residence for school?
  15. -I got the NOID notice. If you read my post I got it after the interview and I responded to it a year ago. -I switch my I-751 joined to waiver and sent my divorce decree. - I also applied to N-400 in 2021 and the case has been pending since the interview. - what are you saying to apply for another I-751 without being denied ?
