Hi @WaitingEB-1AJan23 My cross-border accountant explained that even if you pay taxes in Canada for your job, it doesn't really matter as what you pay in Canada will be taken off in the US side because of the tax treaty. So you end up paying the same as if you were in Canada (so a little more than just the US as Canadian taxes are usually higher). I don't understand his idea of being a US non-tax resident for 2025. You have to be a tax resident of the US when you activate your greencard which will be in 2025 for you? If you check non tax resident of the US it could be seen as abandonning your green card. -

If so, it seems the panel physician of the medical exam decides to give you a waiver or not. This CDC website gives info on waivers too. Hi @mrclutch31 , yes you are right that as of today you should expect a 1-year wait between the DQ and an interview at the Montreal embassy. Things might change though. On top of that, personally to get to DQ it took me over a year for an EB-1 and I am a well organized individual. Just gathering all the documents and letters were so much work, but I think you can probably do it in 6 months if you are super motivated. Make sure you have lawyers that are quick. I had to wait 5 months on mine to submit what I gave them. For getting a work visa, in the meantime, it really depends on your field. In the arts all my friends get a O-1 first, which also takes about 6-8 months last time I check. You should talk to an immigration lawyer to see your options. First call is usually free. I recommend finding a good one who he's used to working in your specific field as they have to prove your "extraordinarity" in your specific field, which leaves to a lot of interpretations. -

@WaitingEB-1AJan23 Tax residency status criteria differ per country. As soon as you activate your green card you become a US tax resident. It doesn't make you a Canadian tax non-resident automatically. It's simpler and easier to sell everything before activating your green card. Owning a house in Canada that is not rented to a third party makes you a tax resident of Canada (see CRA emmigration info). But know that if you sell after activating your green card, your house capital gain will be taxed in the US side too as you will be a US tax resident then. But the limit on the exemption for Principal Residences capital gain in the US is usually 250KUS per person or 500KUS per married couple. But that exemption to also be verified with the US state where you will become a resident. Cross border accountants can help you, but I found the same info on the internet as they said with a lot, a lot of research (CRA emmigrant, IRS immigrants and your State tax info immigrants). Know that Cross border accountants usually charge for phone calls (I got a 1000$ surprise invoice for the phone call with info that I already knew). -

@monk_yatso I haven't had my interview yet so I can't say on that front, but I've been to Cuba couple of times when I was younger. It's one of the main destinations for Quebecois as it's super close and cheap. As it's one of the main "all inclusive" destinations and so many people go and it's so common, I wouldn't worry about it too much. -

@sunnylank When you filed the DS-260, it asked you if you wanted to get a SSN. If you checked that you wanted one, you'll receive it at the same adress as the green card. Please note to not change anything to your DS-260 as changing anything will reset your DQ date. You can update the delivery adress at the interview if it has changed since then. It has nothing to do with the border agent. -

I wouldn't tell this at the interview. I would just say that you are planning on wrapping things up and moving to the US as soon as possible (which is true). It's the same for my husband, he needs to finish something with his degree and will stay behind for around 1 to 1.5 year. So we are planning to go to the US for a couple of months upon issuance of the greencard and get him an i-131 Re-entry Permit just in case before he goes back to Canada to finish things up (but we won’t say that at the interview). -
Hello all, I am getting a green card EB1, but my spouse needs an extra 1.5 years to finish up in Canada. We are planning on filing an i-131 Re-entry Permit. What are acceptable reasons for the “Information about your Proposed Travel” - are there any things that are good or bad to write there? Is there anyone in here that got the i-131 Re-entry Permit and would mind sharing what you wrote for the reason? My spouse needs to finish his 2 years of being part of the Psychologists Order so it can be transferable to the US. Could we write to “To finish his contractual agreement with his Quebec clients as a Psychologist?” Or keep it vaguer? Is there anything that would be bad to write as a reason? What are examples of acceptable or good reasons? Thank you so much for your help!
