Hey everyone, this is specifically for the folks that had their interviews throughout September and possibly late August (in EB categories). I need some clarification on where I stand with this. I was approved on the spot but then about 4 days later emailed a 221g with an explanation in bold letters indicating that they need to wait until October 1st to process. No other documents or info was requested and my passport is still at the consulate. Did anyone else get the same runaround and get issued out of this September batch? I'm trying to figure out how much weight that 221g carries with it given its (stated) reasoning. Thanks.

We can only hope haha. I trust that you and your family will get through this soon as well! Being given timelines only to be held back additional months is absolutely soul crushing. I see. I'm sorry to hear that. Genuinely that's really frustrating. Your case is a bit different from mine. I was never handed a 221g in person. I had all my documents. I was sent a notice 5 business days after my approved interview with a 221g attached. But that 221g simply stated in bold that they must wait until October 1st to process this further. No further documents were required, no further instructions were provided to me. I got an email back from them this Monday indicating that my "case was pending review by a consular officer". That's it. On that note, I did find this forum where one attorney broke down the legal lingo. Maybe it will help you dissect that email you received once they confirmed receipt of your documents.

So, your 221g stated that you didn't have police clearance? This was stated in an email and letter? I wasn't told of any missing documents or any reason for that matter. The only reason mine got held up (as far as I know at this stage) is due to visa allotment to the fiscal year.

Hi there, Just checking in with you. Have you received any updates on your CEAC? I'm still in the same boat...I sent a follow up email again 2 days ago and everything has been silent. No correspondence, no case update, no change.

Hey, I'm in the same boat. Case last updated today. I sent an email on Thursday and received this reply this morning: "Hello, Thank you for your inquiry. We acknowledge receipt of your email. This case is currently pending review by a consular officer. As soon as the review is complete, the Visa Unit will advise of the next steps if anything else is needed to complete processing the case. Once the visa process is finalized, we will mail your passport by courier service. For questions regarding the courier service (including tracking the passport) we strongly encourage you to contact the Official U.S. Department of State Visa Appointment Service using the contact details available on the following webpage: https://ais.usvisa-info.com/en-ca/iv/information/contact_us. We hope that this information is helpful in replying to your inquiry. Please let us know if we can be of further assistance." It just seems like a standard reply.... For the record, I'm EB1A and interview was Sep. 4th with approval on the spot.

Interview Sep 4th. Approved at interview. Refused status since. Last updated yesterday. It looks like it takes them a few business days after that “last updated” date.

I can’t seem to find an answer anywhere online about similar cases. Someone on Reddit posted that apparently they receive new visa numbers on the 3rd of this month. I have no way of checking the validity of this.

I had my interview Sep 6th (EB1). I received a verbal approval from the officer at the consulate. Yesterday morning I received a notice indicating that they will be holding my passport until after October 1st because they’ve hit their limit of Visas issued for the fiscal year. I’m just hoping that this means they actually get to work on it in the first week of October and not closer to November.

Could I ask you where you read this information? Was that info specific to the Montreal embassy?

So in that case, would that mean that MTL would still schedule EB 1 and EB 2 categories for interviews?

Looks like they were referring to EB3 Unfortunately, I’ve sort of stopped believing that priority of EB categories has any play.

If we are following any sense of logic, I’m anticipating @Wincity to get their letter next, out of all active EB forum folks. So, I’m rooting for Wincity. That said, I’m chatting with my lawyers tomorrow and will share our (the forum’s) observations of what happened last year vs what’s happening now. I’ll see if they can advise on any action….

I imagine we will see some sort of movement over the next week or two. Them putting this information back on is some sort of indication that they are at least not falling behind where they were. It's not exactly a commitment to progress but it's positive communication nevertheless.

Those family based forums are very hard to read. People complaining about their 2-3 month wait after DQ is a tough pill to swallow for us employment based folks haha
