Hey Ds 5535 crew! I've officially hit a dilemma. I have a short term international contract offer on the table. My passport is at the MTL embassy. I'm about 2.5 months into this 221g process. I need a passport to travel for this contract. I went to the Canadian embassy. They said I can't get a temp passport, I have to do a renewal. If I do the renewal, I will have to send the new passport in to the US embassy. What delay in admin processing have people experienced from sending in a new passport? I recognize this is an almost impossible question. But any experience would be appreciated. I'm so torn whether to take the additional resume point and experience or scrap yet another opportunity as I sit in this black hole of a waiting process...

I see that you’re E2, but from what I understand your spouse got DS 5535…so it’s a E2 but they won’t do the same checks as employment based applicants (right?). It seems like IR/CR applicants that did interviews in January-March are next up. Is anyone on here waiting for their visa status to change to issued, and with documents at Montreal in the E category stream?

The new administration doesn’t take office until January. So I really doubt any mandate was passed to change any process. Trumps admin is anti illegal migration, not against legal migration. I don’t see any factual evidence to suggest it would at this time. People will point to mandates in 2020…when there was a strange unprecedented global pandemic looming. I’m not convinced that’s a valid comparison to 2024. If hypothetically they cut jobs in that department and or reallocate that labor to deal with illegal migrant paperwork, then we could make an assumption that it would affect us. Until that happens, I’m not playing doomsday pretend games

I've been holding my tongue on this but it does appear to be the trend. I've seen some folks get through in like 5 months now... I've noticed that most people get a bundle of case updates and then see radio silence for a few months- I think this radio silence time is being shortened. I had my bundled case updates. And now haven't heard anything for 3 weeks. I feel I might be in that radio silence period? So, I'm curious to see if it'll be 1 month or like...5. Idk, it's all an endless hypothesis haha. But it keeps the hopes high and maintains moral.

Agh, I see. My last update was on Oct. 22nd. So it’s been a little while now. I’ve just chalked it up as being in AP at this point. I feel as though no matter how trivial the stated reason on a 221g is, it means the same thing. But again, I hope I’m proven wrong.

This is so madly inconsistent. All three of us got 221gs stating we have to wait til Oct 1st. No additional docs required. They kept my passport. The requested your passport almost a month ago. and Quebekwa hasn’t gotten their passport requested yet haha. Im so curious to find out which order this all unfolds in. If I had to guess, you should be issued very soon. And I’m crossing my fingers for you.

Keep us posted on the outcome. I got refused on the same notion (Sep 4, EB1 interview, statement read that I’d have to wait until after Oct 1st) after getting verbal approval at the consulate. But from what I gather, they just snuck me into the admin processing queue. I hope it’s not the case for you. So Id be curious to know if you get a reply.

Hey squad, I need some advice/ past experience anecdotes. Passport is at the consulate (since my interview in September). I got a 221g without the added DS form. No further info or docs requested. I’m in negotiations for a short term contract for an amazing opportunity. It’s an international opportunity- I’d need to travel at the beginning of December. And would need that passport that’s stuck on someone’s desk at the consulate. Does anyone have an experience of rushing their issuance based on similar circumstances? Has anyone requested their passport prior to issuance? if so, what kind of delays did that cause on your application. Obviously, I’d love to take advantage of the contract offered without sabotaging my review process. Thanks a mil in advance!

I’m EB1a, I can confirm there was no priority given in terms of interview timelines. You’re waiting the rest of the employment cue. The only time your priority helps is if other category visa numbers run out or their priority dates shift further back than EB1. I thought and was hopeful for the same thing you were hopeful for. It’s not the way it works.

Hey Angie, Thanks for posting your update. I really hope you're right about point #1. I've read from other forum users that their visas got issued 1-2 months after their passport is requested. I don't recall a post showing a faster turnaround. *** CORRECTION- the post just before showed about a 2 week turnaround to "Issued" status! I'm an EB1A applicant as well (and had my interview on Sep 6th). I got a 221g (no DS 5535 requested). I'm a Canadian citizen but was born in Russia. I'm very curious to continue following your timeline because it would appear we may be under a similar type of processing (country of origin perhaps being the reason). The difference is that they kept my passport at the consulate...so I have no metric of timeline to go by. Anyway, congrats on the request to send your docs back in! I'll be on the look out for your updates. You're the closest example I have to gauge anything off of.

Hey there, I’ve had several case updates but status is still on refused. Last case update was Oct 22 for me. Based on the many pages I’ve read, I’m likely in AP after all. They still have my passport. And to this day, no additional info or documentation has been requested. It’s hard to judge anything at this point, but I suppose the decently regular case updates is a positive sign- nevertheless not a guarantee.

You get a confirmation when the doctor's office has sent the documents by the doctor's office. There is zero communication coming from the consulate.

You get a confirmation when the doctors office has sent the documents. But I don’t believe that there’s a way to confirm that the consulate received them. In my case, they checked at the interview to make sure everything was there.

I did. I got a case update date change and a reply stating that the case is pending review from an officer. a Google search of the exact quote prompted some optimism from a lawyer suggesting it means it’s likely back from the necessary security checks. but it’s all hypothetical at this stage it seems. They still have my passport- which I suppose is another positive sign. that form that was issued has some scary context on the online forums. But it’s different because it seems to have been issued on the visa shortage basis (as was the case for the @texasbound acccount). Just trying to gauge if this is a 2 week or 12 month setback…
