  1. Hi everyone, I did not do a mandamus lawsuit. After 21 months of Admin Processing due to Form DS-5535, my wife finally received the following email from the Embassy: Dear Sir, Please be advised that the case has finally reached a conclusion. Your beneficiary spouse needs to complete the following steps and come back to the embassy for a re-interview on March 18, 2025, at 10:00 -Resubmit DS-260, it is currently open. -Redo the medical exam (expired) -Resubmit a new Police Certificate with translation -New picture 5X5 -New affidavit of support I-864/Tax return transcript, as well as for a Joint sponsor I-864 /Tax return transcript A transcript can be obtained on the IRS's website: https://www.irs.gov/individuals/get-transcript It is important that you upload the missing documents and have your spouse bring them to the interview, to avoid any delay in the processing of the beneficiary’s application. Best, I have a couple of questions: Is it normal to be asked for a re-interview? Should we be concerned? At the first interview 21 months ago, they only requested Form DS-5535. Since her first interview 21 months ago, I’ve been filing taxes as “Single” because my wife didn’t have an SSN, but now I understand I should’ve filed as “Married Filing Separately” and listed her as a “Non-Resident Alien.” Given the embassy is asking for updated tax transcripts, will it cause major issues that I’ve been filing as “Single”? If I amend my taxes now, the IRS correction won’t be done before her interview. Would it be sufficient to give my wife a copy of the IRS request-to-amend form (1040-X) along with a cover letter explaining the situation? Thanks!
  2. Hi everyone, Would it be extremely abnormal to have been waiting 17 months for DS-5535 processing? I'm wondering if my case is special or if this is not unheard of, or if its on the rarer side. I'm starting to get concerned, not necessarily because of the wait itself, but the duration itself sounds rare.
  3. Hi, Anyone have their interview in April 2023 and still waiting? (CR1 marriage visa) Only thing requested was DS5535 and was submitted the same day as the interview.
  4. Hi everyone, I just crossed 15 months under DS-5535. Emails I send to the embassy receive generic responses (case is still pending). The same thing with Congressional inquiries. Being at the 15 month mark, I'm now ready to file a mandamus lawsuit. (We know it could be risking money, but we're willing to take it) My spouse is a resident of California, and I've read anecdotally that filing a mandamus in California *could* be better than other States. With that being said, I'm really not sure which lawyer to use for my mandamus lawsuit. I did some research about 10 months ago, but my information may be outdated. Who are people recommending these days for mandamus lawsuits?   5. I know how to contact the Consulate, but I have no idea how to contact CBP. How do I do that and what is CBP's email?
  6. Was hoping to get someone's guidance on my situation. My spouse's IR1 visa has been in Administrative Processing at the Montreal Consulate for 11 months (Form DS-5535). Spouse told me the interview with the Consular officer went well and they accepted all the documents (I-864 Affidavit of Support, etc) and only required my spouse to submit Form DS-5535, nothing else. That was about a year ago. I recently discovered my spouse was communicating with someone else while I was overseas and then later admitted to it. My spouse's is asking me for forgiveness but I don't have it in my heart to accept something like this. I've decided I want to withdraw my spouse's IR1 visa petition, but I'm worried that because it is already in Administrative Processing, we are too far in the process for me to cancel it? Is this correct? My understanding is that all I'd need to do is email the Montreal Consulate, tell them that my spouse is in AP for 11 months, and that I want to withdraw the I-864 Affidavit of Support I signed for my spouse. Is it likely that the Consular officer will actually read my email, understand what I'm asking for, and actually withdraw the I-864 Affidavit of Support I signed for my spouse and not Issue the visa? Or is it unlikely that the Consular officers will know how to handle a process like this and cancel it? If so, will the visa petition be immediately revoked and sent back to the NVC, or will it simply stay in "Refused" status and stay with the Embassy before it automatically is canceled due to inactivity. My fear is that my spouse will eventually be Issued the visa after the AP is over, and then I'll be legally on the hook after that.
