FAM 302.3-2(B)(1) (U) Applying INA 212(a)(2)(A)(i)(I) (CT:VISA-2009; 06-11-2024) a. (U) Determining Ineligibility: When adjudicating a visa application for an applicant whom you have reason to believe has committed a crime involving moral turpitude, determine whether: (1) (U) The offense committed involves moral turpitude (see 9 FAM 302.3-2(B)(2) below); (2) (U) The applicant has been convicted (see 9 FAM 302.3-2(B)(3)below); and/or (3) (U) The applicant has admitted or may admit that they have committed acts which constitute the essential elements of a crime (see 9 FAM 302.3-2(B)(4) below for guidance on legally valid admissions). b. (U) Exceptions to Ineligibility: Certain statutory exceptions may prevent a determination of INA 212(a)(2)(A)(i)(I) ineligibility resulting from a conviction for a crime involving moral turpitude. These exceptions generally do not apply to other ineligibilities that may result from the same conviction , for example INA 212(a)(2)(C)(i) or INA 212(a)(3)(B). These INA 212(a)(2)(A)(i)(I) exceptions relate to: (1) (U) Crimes that fall under the "sentencing exception" (see 9 FAM 302.3-2(B)(6) below); (2) (U) Crimes committed before age 18 (see 9 FAM 302.3-2(B)(7) and 9 FAM 302.3-2(B)(8) below); and (3) (U) Certain purely political offenses and convictions (see 9 FAM 302.3-2(B)(9) below).

Awesome. I did read somewhere that any crime committed before the age of 18 will not be counted as moral turpitude as per US. I think it’s in one of the 212 clauses.

So it was 64 working days since my interview to issued. That was taking into account all the public holidays that the embassy was closed etc. Hang in there, that’s all you can do for now. Try to remain sane! You’ll get there soon enough. I’ll keep my fingers crossed for you!

Just to update, my visa was issued today….finally the nightmare is over!

Hey, thanks for the post. I have received nothing from the embassy or from ACRO or anything else. Literally the only contact I have had is from the vague responses to the emails I have sent. I will make sure that whatever happens I keep this thread updated. The AP is a complete vortex of emotions and all we can do is wait for the outcome. I have tried every avenue to get an update or a slither of information and yet it’s the same. All I can say is we need to just hang in there and trust the system.

So my case has now gone from “refused” to “ready” and now “administrative processing” any ideas?

So my case date was updated on the tracker 2 days ago but the status hasn’t changed and I’ve had no correspondence at all. Generally, what does it actually mean when the “case last updated” date has changed?

As always, thanks for the post. I can confirm that it wasn’t drugs related at all. If it’s a DoS check then I’ll have to wait longer. Standby to Standby and carry on waiting. Not much else I can do I guess. I’ll email them again in 4-6 weeks just to let them know I am still here!

Hi, thanks for the post. I emailed the embassy on 25th June and had a response yesterday. This was the response: “We are providing the current status of your case. Embassy records confirm that the review in your case remains ongoing. We understand your concern, however, please note we are not able to provide a specific timeline for the completion of the review process as it varies in every case. Please be assured that our Immigrant Visa Unit will contact you directly as soon as they have any news about your case.” I understand they can’t give a timeline as it varies in every case but I’m not asking about other varied cases, I am asking specifically about my case. It’s seems like a generic response that didn’t answer any questions I posed to them and very similar to the response I received mid May. It’s been a few days short of 90 days now. What review could possibly be taking 90 days?! It’s frustrating that they won’t give any details of what work has been done on your specific case and what they’re waiting for in terms of what will help them make a decision for whatever the outcome may be. Just an update such as “we’re waiting to hear back from….” Or “it is currently with….and they’re checking….” Just sat in limbo blind with no knowledge or end isn’t great! They haven’t advised they need anything from me at all.

I believe they don’t have timed appointments.

I had a morning appointment and I got there 30 mins before. You’ll probably find there will be a queue for the outside desk but just bypass the queue and tell them you have an immigration appointment and they will ask what time and want to see your interview letter or DS-260 etc. they will then fast track you through. once inside as before just bypass the queues and speak with the desk again. Be prepared to be glared at by people waiting as they don't understand that you have a timed appointment and may seem a little grouchy. 30 mins before will leave you plenty of time.

I provided the one that comes with the certificate, uploaded it and showed her the original. I did have a full SAR from the PNC but that was never asked for. I probably should have uploaded that but I figured the one that comes with the certificate would have been sufficient enough as that was the reason for the ‘No Live Trace’. It just said the offence and ‘reprimand’ with the year.

Thanks. That’s what I thought. I have a few friends that didn’t have any issues and everything progressed normally.

@Boiler @bonkane So you think it’s the Military background and hopefully will be done by around 60-90 days?? Is that’s what’s considered normal AP?

Thanks for the insight. I can confirm I am born and bred UK and I have lived here my whole life, my name is not a common one. I have been to MENA countries but only because I was military and after over 22 years service I left in March this year. I have friends who have been through this process with no issues on the MENA front so I’m not sure it’s that but you never know. I have worked with the US military both in the States and abroad and never had any clearance issues getting onto US bases etc. I’ve been married for over 8 years and have two young boys with my wife. They left to go back in Dec 23 so this AP is very frustrating, especially as they didn’t give me any reason whatsoever as to why or any indication of a timeline.

I had my IR1 interview at the US Embassy London on 17th April and have been in Additional Administrative Processing ever since. It’s been 70 calendar days since the interview. Is there anyone else that is in this situation? They said that there is no additional paperwork or information needed from me and they have retained my passport. On the green slip they handed me, it just has the box ticked that reads “Additional Administrative Processing” and nothing else. I do have an arrest when I was 17 which was over 23 years ago and I was issued a reprimand for that so have a “No Live Trace” Police certificate. I feel like if I was going to be refused outright they wouldn’t have retained my passport. What could they possibly be doing for the past 70 days with the case? Anybody who is or has been through this process with a similar case I would be grateful for your thoughts. Or anyone else that may have an opinion. I know of one other person that is currently going through AP from the same day but their circumstances are slightly different. Thank you all for reading.

@Deejee I have been in AP for IR1 since 17th April. The CO said to me all my docs are good and there is nothing more needed from me but it needs further processing. They also kept my passport. I have contacted them (about 2-3 weeks ago) and got the standard government department answer back that had no actual information of any use in it. It’s really really frustrating.

They only kept my passport none of my docs. I don’t know why I thought they had kept docs. They didn’t take any of my photos either but I did upload them to my case prior to today.

Hi Abena, I’ve had my interview this morning and they have said the same thing to me. Everything seems in order but they need more time, all my docs are good. Did they ever email you with any instructions at all and how did you find out whether it was issued or refused etc, was it just that visa tracker page where you type in your case number or did they email? They have kept my passport and some documents.

So our I-130 was approved 22 Dec and I had my interview letter sent on 5 March for a 17th April interview. Bear in mind that it was also over Christmas so that may have added a small backlog. Ive kept a close eye on the timelines and that seems to be the norm so from I-130 approval to interview you'll be looking at 3-4 months (ish). Naturally that will depend on how quick you get your docs uploaded and everything like that. Its seems like the whole process takes forever but it does come around, just have to be patient and trust the process as much as you can. So far everything has been pretty straight forward for us and we will know next week if it was all worth the effort.

Hi, Thanks for all the information, I have my Interview next week so all this is very helpful. I was wondering what the process is once you have been through immigration in the US and handed everything you need to over to the immigration officer, is there anything you need to do like biometrics or is it just a case of waiting for your SSN and green card to arrive to the address you wrote on the DS-260? A bit presumptuous of me but I have already got a job offer with a "projected" start date of 13 May (they're flexible on the start date which is nice). I am aware that I cannot work without my SSN so the sooner I can get it the better for me. Roughly how long does it take to get your SSN after arrival?
