  1. Hello, I am currently based in the US on an E2 (working for a British company out here) and about to apply for a Green Card, as I recently married my US Citizen husband. In regards to the the I-864 - my husband works in software sales. His base salary alone is a lot higher than the poverty guidelines but on page 4, question 7 where it asks for individual income, should he just put his base salary? Or should he put in his base amount plus how much commission he thinks he will make this year? Therefore, it being an estimate? If so, how does he note that he makes commission or show proof? As well as this, the following question says: "Income you are using from any other person, who was counted in your household size". Even though his base salary well exceeds the poverty guidelines, should I still include my salary in this box? And if yes, do I include proof of my salary? Finally, on page 5 it says it is OPTIONAL to include copies of the sponsor's federal income tax returns from the second and third most recent years - any thoughts on whether we need to? Or how to decide whether to?
  2. Hello! I am a British Citizen living in the US on an E2 visa sponsored by my company (I work for a British staffing company here in the US). I have just married my US Citizen partner and we are now submitting a green card application. We are planning to do a celebration with family in the UK in September 2025 as they were unable to be here for the legal ceremony earlier this year. I am concurrently filing I-130, I-485 etc. With form I-131, I believe when filling it in I am requesting advance parole. Page 2, Part 3, Q1 asks for date of intended departure - I was going to put a date one week before the celebration. If I do this, does this mean I won't be able to do any travel prior to this? There is a wedding in May 2025 I was also hoping to attend in the UK but I've heard if I put that the travel authorization is for multiple trips as opposed to singular this can affect things. As well as this, I have been told by some not to even bother applying for I-131 as it is taking so long right now, I might as well just wait for the Green Card. Not sure what the best route is as I obviously don't want to miss my celebration in September 2025.
  3. Hi! For question 7 on page 4 of I-864 it says: My current individual annual income is: - My husband works in sales and therefore gets commission, in this box should he just put his base salary? As I read that we need to provide proof of this number and obviously can't show proof of commission that hasn't been won yet. Below this question, it says: Income you are using from any other person who was counted in your household size, including, in certain conditions, the intending immigrant. As I am the spouse beneficiary, should I put my salary in this box? I am concurrently filing I-130, I-130A, I-485 etc.
  4. I am on a work sponsored E2 visa (work for a British recruitment company out here) and am married to my US Citizen husband. Am I right in thinking I am eligibility category (c)(9) when filling in form I-765 for my employment authorization?
  5. Hi everyone! I am on a work visa (E2) and have recently got married to my US Citizen husband. I am filling in I-485 and for question 24a on page 10 it says: Have you EVER been a J nonimmigrant exchange visitor who was subject to the two-year foreign residence requirement? 12 years ago I came to the US on a J1 visa to work in the US for 3 months during summer break at university. I have found the original form and on the form it says: The exchange visitor in the above program: not subject to the two-year residence requirement So for this question do I say no? If so, should I still include a copy of my J1 visa?
  6. Hello everyone! I am on an E2 visa sponsored by my company (I work for a British staffing company here in the US). I have just married my US Citizen partner and we are now submitting a green card application. After hours upon hours of research, videos etc. we are nearly ready to submit but I just have a few outstanding questions, which I would love help on! I am submitting: I-130 I-130A I-485 I-765 I-131 I-864 I-693 I-130 1. With previous addresses, should the dates match from the day of leaving the last address or day after? For example, first address - date to: 09/30/23 and then next address date from: 09/30/23 or next address date from: 01/10/23? I-485 1. For question 25a on page 3 it says: When I last arrived in the United States, I: was inspected at a port of entry and admitted as (for example, exchange visitor; visitor, waived through; temporary worker; student): Would I put E2 in this box? 2. For question 2 on page 4 it says: Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)? From my online research I believe I say no? 3. For question 24a on page 10 it says: Have you EVER been a J nonimmigrant exchange visitor who was subject to the two-year foreign residence requirement? 12 years ago I came to the US on a J1 visa to work in the US for 3 months during summer break at university. I have found the original form and on the form it says: The exchange visitor in the above program: not subject to the two-year residence requirement So for this question do I say no? If so, should I still include a copy of my J1 visa? I-765 1. For question 27 on page 3 it asks for my eligibility category, am I right in thinking it is (C)(9)? I-131 1. As I already live in the US, am I right in thinking I am applying for advance parole as opposed to reentry permit? 2. I am finding contradicting information on if I need to pay a fee for this form. Some places say if I am submitting the I-131 with the I-485 form that I don't need to but other places are saying, I have to pay the separate I-131 fee? I-864 1. For question 7 on page 4, it says: My current individual annual income is: My husband works in sales and therefore gets commission, in this box should he just put his base salary? As I read that we need to provide proof of this number and obviously can't show proof of commission that hasn't been won yet. 2. Below this question, it says: Income you are using from any other person who was counted in your household size, including, in certain conditions, the intending immigrant. As I am the spouse beneficiary, should I put my salary in this box? Thank you so much in advance for any help or guidance on any of this!
  7. Hi all, I have posted on here before about the fact I am on a work sponsored E2 visa (work for a British recruitment company out here) and am marrying my US Citizen fiance. Am I right in thinking that once I get the I-765 Employment Authorization form approved that I am free to change jobs? Or do I have to wait until the Green Card is completely approved?
  8. Thank you for the info! Yes, I work for a British recruitment company. It can be a little overwhelming with all of the possible forms to fill in, so I appreciate the help!
  9. Hi there! I am a British Citizen who has been living in California for two years on an E-2 visa (I work for a company whose headquarters are in the UK and therefore they could sponsor me to move to the US). My fiance is also British but is a US Citizen as he has lived here since he was a teenager and went through naturalization to get citizenship. We are planning to get married in the next few months and then start the Green Card process. I have been doing a lot of research into which forms we need to submit. From my research, it looks like: I-130, I-130A followed by I-485, I-765, I-131. After today's research, I am now wondering if I also need to submit form I-508 as I am currently on the E-2. Would anyone be able to advise? I-508 is free to submit, so I am also wondering if I'm unsure whether to include it in my immigration package "just in case".
