Petition for Fiancée - USCIS

Say what you will about the process, particularly the costs and requirements, but the duration in my opinion is an important component in keeping immigration to the US discerning and subjective to the variety of cases. I would not want to see it streamlined in a way that would expedite particularly the K1, even though my fiance and I are taking that route. Spouse visas and other family based visas, sure, but in terms of family-based immigration I personally think K1 should be the slowest. Not only is it a test of resolve and unity between two people before facing the stress of marriage, but also gives extra time for relationships that won't stand to dissolve. How many times does a person come to the US to marry, adjust status, then divorce? There's a process for a reason, and patience is a virtue. -

Hi everyone: My fiancé and I are trying to get information to my future mother-in-law, a former South African now living in Australia with a valid Australian passport, on how she can attend our wedding in Vegas this fall. I keep trying to research what she needs in preparation for the trip, and am absolutely stumped. One source says she needs to apply for an interview for a B2 visa. Another says she lives in a country covered by the VWP, so an ESTA needs to be completed. And yet another source says she doesn't need to file anything at all, and just have her valid passport, enough money on-hand for the trip, proof of return flight and other confirmations such as her hotel stay. I am concerned that if I don't understand what is needed in advance and give her the info she needs, that she's going to have issues at customs and not know what to say or do. She's in her 70s and this will be her first time visiting the US. How can I assist her in navigating this process?

Are you talking about your I-129F petition? You'll want to sign/date any official forms, as well as your declarations of intent. When you get to the embassy stage, updated declarations of intent should be included, which also should be signed/dated. Everything outside of those pieces of evidence, there is no requirement date them, or really any benefit to it, unless it somehow helps you keep things in order. Items such as I-94 travel records and tickets have the dates of validity on them already. Photos, it doesn't really matter if they're dated. They're considered the weaker pieces of evidence because they would have to take your word for it that the dates are accurate, unless they include elements in the photo that align with travel plans: such as a trip to Paris together corroborated with a picture of you two in front of the Eiffel tower.

I would appreciate it if someone could verify that this is correct. The RM 10211.530 is very hard to decipher and one of the requirements on the VJ SSN guide is "another valid form of ID". Is the above method acceptable?

HEAR HEAR. You should not for one moment be convinced that immigration attorneys can do this better than you. Trust the people who have been through this process before and are also personally invested in it. You can do this. For every visa there are checklist/flowcharts, not to mention people who have years of tracking your visa journey AND those who have up to date information based on their own experiences. Ditch the lawyer. We can help you. -
Uscis Sent back my birth certificate?

Yeah it's normal. If the USCIS agent feels like it, they will ship back originals once they have the copy they need for the case. Sometimes they will scrap it but in most states, people don't sweat this. I sent an "original" because it had the official watermarks. If they trashed it, no skin off my back. We had more issues with mysterious delays at NVC level. But we've seen the case move to the embassy this week, and have an interview scheduled. Other than the slight panic attack from receiving the bc back after a few weeks, USCIS was a well oiled machine. -

This is going to be highly dependent on what airline you guys use, above all else. As far as bringing a cat to the US, it's a lot easier than a dog. Rabies and health certificates are not required for entry of a cat into the US but they MAY be necessary based on the airline you fly with. If I were you I'd make a call to the airline customer service of your choice and verify what their requirements are. Could be a combination of health/vaccination records, pictures/ID of the cat, and verification of the crate dimension if your fiance plans to bring them on as a personal item for storage beneath the seat. There are also organizations such as PetRelocation and IPATA which can assist in shipping the cat separately. Good luck!

Proof of relationship/in-person meeting

I94 is a government issued travel record and very easy to look up. You got this! You seemed to start with concerns about meeting family. Ultimately the K1 is provided for bona fide relationships between two people who want to get married. Although it's nice, meeting family is not a requirement. -
Congratulations! We're certainly keeping an eye on any activity from our fellow Saffers. My fiance's K1 was finally sent to the embassy on Tuesday so we are anxiously awaiting the interview letter so we can work on getting things scheduled. Will have to poke you when AOS/removal of conditions become our next steps. Best! Heather & Jon

SABC TV license cancellation

So my fiance is preparing to sell his goods and pack up the essentials to move to the US, and the one string creating any amount of concern is the SABC tv license. In South Africa, any resident in possession of a television has to pay the government a little over 200 ZAR a year for the privilege. Although a pittance, if left unchecked there are horror stories of nonpayment schedules affecting credit and adding you to a blacklist. The SABC attests that it is very easy to cancel the license and one needs only to submit an affidavit attesting to you no longer owning a TV, or that you've immigrated to another country. However, depending on the conditions that make you exempt, the varied means of documenting that the license doesn't apply to you is ridiculously complex, and seems to be ignored--unsurprisingly. So, I'd love to hear from Saffers who have immigrated to the US. Did you successfully cancel your license? Have you heard the nightmare scenarios, and just continue to pay the ZA government from abroad just to avoid the headache? NVC to Embassy

Same here, took a total of 17 weeks (4 months, approx 120 days) and an additional NOA2 issued to us. But it finally went today. -
It was an honest mistake and a matter of semantics, and I would really appreciate you not picking apart my attempts to work on my case when this is a very painful experience for us. What purpose does it serve? I also didn't petition a minor league baseball team for assistance. Should I clarify that as well, in case people think I'm speaking about a different kind of senator?

I'll pop in your messages, thanks Doesn't seem to be universally applied, even within the same embassy. I'd be content if K1s going to the same embassy were being taken in order. This is very strange.
