  1. thank you very much. Just one final question if you can answer. I'm trying to E-FILE this year's tax (spouse is abroad, non resident alien, with no SSN) Is it okay to e-file if a tax software allows me to? or is it illegal or wrong/incorrect to e-file taxes in this situation? I don't want to mail it again so I prefer e-file but it seems like only a few software is letting people e-file without SSN. i'm using taxAct(heard people used it without spouse's ssn) i appreciate if you have any thought on this.
  2. @W199 : I do not want to fil jointly because I need to apply for ITIN for my spouse, it takes time and needs more work. I'm looking for most simplest way plus I can amend it later. So I am filing "married filing separately" @JeanneAdil and @Redro : I am sorry about confusion. I just moved out of the usa(last week). I lived and worked in the USA entire year of 2023. And this is my taxes for 2023 which I lived and worked in the USA. I do not have foreign income. I only have US based income. I heard taxAct allows you to e-file without spouse' ssn. I filled everything on taxAct and so far it did accept everything. It looks like people e-filed in my situation with them. If I attempt to e-file it with that software, is it illegal or wrong? Am I legally not allowed to e-file by IRS or USCIS rule? I want to e-file if possible but I don't want to cause issues if it is not legal or incorrect.

  4. hi pga, i have similar problem. So you used Taxslayer to file "married filing sepeartly" with a spouse non resident alien, no ssn or itin? And it has been accepted? I hear people saying even if you use a software to handle this, IRS will reject it, but some people(like you)say they did it. Can you please explain?
  5. Hi folks, I have had bad experience with mailing my taxes last year because I could not e-file. I'm filing married filing separately and I'm trying to avoid mailing my taxes. i'm getting so many mixed reviews about the subject. Some people say, they did e-file. Some people say, they could only file by mail. Some people say, even if I try to e-file, my return can be rejected. I live outside of the country so I cannot afford rejection(its hard to track mail, and time lose) Is there a method/software/company(like hrblock) that I can e-file my taxes when my spouse is aborad, non resident alien, has no ssn or income)? Turbotax doesn't work. It is forcing me to mail again this year. Does HRBLOCK handle this if I visit their office? Does anyone successfully E-FILE tax return with NRA spouse?
  6. thank you both. i was worried that I have no proof of tax return because IRS hasn't processed yet. I'm just sending "whatever I mailed to IRS" as a proof. as a result, what I mailed to IRS with my signature(Form 1040, W2, etc) == Tax Return transcript which is sufficient for USCIS/NVC/Consulate. Correct? You can just give thumps up, if you agree. Thanks.
  7. thank you sir. I read that but I wasn't sure what "tax return transcript" or "copy of tax return" refer to. So copy is tax return = what I mail to IRS? So it is perfectly fine to send what I mail to IRS? It is 1040 tax form + my W2s. I was thinking that they would expect to see official letters from IRS (not from me). Thank you if you can clarify this one last time.
  8. Hi community. My husband has been waiting for I130 overseas and now we are just in NVC stage. I have my last 5 years tax return except for last year (2022) and NVC/Consulate is asking me to provide my tax return for last year as well (2022) Last year I(US citizen) had to mail my tax return because my husband lives aboard and had no SSN. I was told by turbotax to print my tax return and mail it to IRS and I mailed it with certified usps. Its been 9 months and IRS still hasn't been processed my taxes. I have a copy of my turbotax papers but not sure if it is enough to send. I tried to call IRS but its impossible to find someone to answer. I have official IRS returns for previous years but since they didn't process my 2022 return yet, I don't gave documentation for it. What should I submit to NVC/Consulate for 2022 tax return? Do I have to wait for IRS to process my taxes? But what if they take longer?
