  1. Thanks. I’m aware the government has 60 days to respond; was just wondering if there was any activity after a month since WOM filing. Given that a DS-5535 was provided almost a year ago, and that a WOM has now been pending for a month, I’m inclined to believe there has been a degree of SAO vetting which potentially might result in a denial, BUT that further security screening remains to be done which, depending on results, will in cause reconsideration of visa eligibility. I would say your case is moving along

  3. They couldn't make it any more confusing, even if they tried. So you’ve been in AP close to a year, and I am going to assume completed the dreaded DS-5535 form. The MTL Consulate now informs you of a DENIAL (not a REFUSAL) under INA 221(g) with ADDITIONAL security screening being conducted, and that based on outcome a CO may reconsider. Final but not final. It would seem you’re in AP, round two
  4. I’m so glad you took the time to share. What a long nightmare you’ve been subjected to! “Randomly selected” without reason makes absolutely no sense. Typically applicants are not given details other than “additional vetting required”, such SAO due to excessive travel, for instance.
  5. I highly doubt there’s immediate visibility (internet search) to the general public on any of that. Perhaps a Public Records Request to the DOS/NVC or maybe an immigration lawyer might be able to assist

Sounds as if in your case the refusal was simply given due to the missing medical results (not as a result of INA 221(g) refusal with the requisite DS-5535 submission), and that once medicals were received and approved, the visa was adjudicated. The Congressional Inquiries (two done in my case so far), have very little impact for those of us in AP due Security Advisory Opinion (SAO) review, commonly called "security clearance," "administrative clearance," or "administrative processing," refusals.

  8. Prematurely as to what time frame? I’ve inquired as to when appropriate after being in AP (and submitting DS-5535 answers) to proceed with filing a WoM. I’ve been told (all immigration lawyers) 6 months, 9 months, and one said “I have given up trying to determine the perfect time to file. If you wait until Trump is president though, that’s probably too late”. Another told me the government is bound by law to adjudicate ALL cases within 6 months of INTERVIEW, including those that fall into the AP category. It seems level of urgency (how long waiting plus personal circumstances) and being able to afford to file the lawsuit, are factors

  13. On Feb 21 I emailed the Consulate for “status”. Today, I received the identical response given for the Congressional Inquiry made in early February. It’s truly hopeless, disheartening and a waste of time and effort

  17. It is acceptable for your Dad to accompany Mom across the border with his valid Canadian passport while AP is pending. Perhaps a recently dated letter detailing Dad’s full time job situation on his employer’s letterhead would serve as proof of his intended return to Canada. If they were to be taking a flight together into the US his return flight information would be good proof.
  18. You are correct in that the DS-260 requests only US travel over a 5 year period, but if you get slapped with the DS-5535 you’ll have to provide ALL travel in the last 15 years, with details
