    MFJ is irrelevant. That's why the instructions state one should submit EARNINGS statements (W2s or 1099s) to prove INDIVIDUAL income TO ACCOMPANY their Return Transcript. They will show her INDIVIDUAL income is enough to support your household size. Ensure you calculate that number correctly. Everyone will need to be included.

    Original sponsor (you): I864

    CO-SPONSOR (mom): I864a

     

    Her mom could only be a joint sponsor if the OP did not live with them.

    If that was the case, Mom would be the joint sponsor and file a I864 while dad would be Mom's CO-sponsor and file I864a IF his income was needed to meet the FPGLs for their own household size including the immigrant. 

    The living arrangements and the immediate familial relationship is the deciding factor.

    I (U.S Citizen / bride) live with my parents and my husband. So she will act as my co-sponsor. 

    Would that mean our household size is 3 or 4?

  2. Hi all. My husband (immigrant) and I (U.S Citizen) are handling the AOS paperwork (I-864). We are confused about what papers we should being filing.

    I am freshly out of university, so I do not make enough money and have to use my mother as his joint sponsor who makes 125% above poverty guidelines for our household size.

    However, my mother is married to my father and they file their taxes JOINTLY. 

    My question is, what forms need to be filed? I-864 for me and my mom, and I-864 for me and I-864a for her?

    My fiancé has his interview in Warsaw very soon. I am very nervous that we will be sent into AP.

    My fiancé has a career that isn't exactly on the TAL list, but it would likely raise some eyebrows although its not government related at all and he has 0 ties to the military whatsoever.

    I am writing to ask if anyone has been approved recently as an engineer or something tech related, or something perhaps on the TAL list to give me some hope.

    hi all. not sure if anyone has any advice for me, but i’ll appreciate anything!! 

    so, i’m the petitioner and my partner and i are waiting for NOA2. we are expecting it sometime in march. 

    i’ve been a college student the past 3.5 years, so the money i’ve made working part time isn’t enough to support my partner, therefor we are hoping to use my mom as the co-sponsor.

    however, my mom is married to my dad. they file taxes every year as MARRIED but FILE SEPERATE.

    my moms annual income (by itself) is higher than the poverty line requirement for our household size. so, is it possible to use only my mom, or do i have to use my mom and dad’s income together? i hope that makes sense.. thanks so much in advance ❤️
