Based on what I’ve read in the declaration that was made by the acting Director, Carson Wu the decision of whether you’re going to be put into administrative processing is something the system decides and is not something that the consular officer decides. My interview went really well and the individual was typing notes into the system, and all of a sudden her face changed and I could tell something was wrong and that’s when she presented me the letter for 221(g). Also, regardless of whether you change your passport or not, you will need to provide a 15 year travel history so you will have to dig back. I would highly advise against that because they will find out, and the last thing you want to do is be denied for lying.

The first time I emailed them was the beginning of December and they responded within two weeks. The status update changed December 18 as a result of responding to my email. I emailed them again on January 31 and have yet to hear back from them. So I’m not really too sure what their protocol is in regards to answering emails because this would just be my second time inquiring

The constant scrolling around this is definitely not good for anyone’s mental health, and I find myself in the same boat as well. Today I saw a post on a Facebook group around the DS 5535 and someone from the Paris consulate said that they have been waiting for clearance for 17 months now. When you hear of news like that, it obviously does not make you feel any better, but we just have to be hopeful, and have some faith that it will all work out in the end.

I sent an email to the consulate on January 30 and never received a response back. Its been over two weeks. I don’t know if thats a good thing or bad thing. I did send an email in early December and they did end up responding to that within 10 days. Havent had a case update since December 18. Interview was Nov 28, 2023.

I recommend all of you to check out Curtis Morrison’s (Red Eagle Law Attorney) video episode 63. He goes over the latest declaration from Carson Wu in regards to the DS-5535 process. I found it very informative. You can find it on youtube. One thing that I found that stuck out for me from the declaration was that it is not a first come first serve basis for this process. We are all just in a pool, and anyone’s process can take shorter or longer than others. They are also possibly looking to move this process over to NVC for immigrant visa at some point in 2024. Hopefully this will help with the backlog. Our file is also sent over to DC and does not stay with the consulate. He also goes over in the video of why we got flagged and asked to provide this form.

It’s sad that no one can really help any of us. I’m a little worried about what will come out of the election that’s coming up and if this back up is just going to get worse. Some of you that have already been waiting 10 to 12 months will be out of it by the election (hopefully). However the rest of us that just got into this mess recently will probably have to suffer a lot longer.

I am feeling so defeated I just saw multiple stories on a lawyers, Instagram page for green cards approved for IR1 category for individuals who filed their cases with USCIS months after me. I have no idea how they prioritize these cases but I definitely do not think it is first in first out. You would think if a US citizen is filing your case there would be some form of priority given, but I guess not.

I think it depends on the consulate the individual is dealing with. I saw something on tiktok someone from the Manila embassy was only in DS5535 processing for 45 days. This issue of a heavy delay is specifically impacting the Montreal consulate. There are people on reddit posts that didnt have to wait 60 days for approval. In my opinion filing a WOM with my lawyers advice was worth while. I provided proof of spending over $8000 in the last 3 years on plane tickets to see my husband. The financial and mental hardship has taken a toll. I was charged $5500 usd for this but if this will open up a path for me then it is worth it. Otherwise my file is just in a pile with all the other files for an indefinite amount of time. I don’t know for sure if it’s going to work, but it is a path I’m willing to explore best case I get my visa. Worst case I will have to wait. Also, if you look at the Visa operations update that was issued on January 2, 2024, they have cited enhancing the process to make it more streamlined and this has dramatically reduced the number of visa applicants who are waiting and they have adopted new technology and enhanced coordination so based on that I can see they do have an interest in removing this backlog.

We filed with our lawyer from New Jersey. So the basis of the WOM is that our case processing time has been taking longer than USCIS quoted. It took me 1 year to get my case to NVC and then 8 months to get an interview. The website says within 60 days to get an answer and its been more than 60 days for the DS-5535. My lawyers other cases are taking max a year and our case is out of processing time. I know someone who filed for their IR1 way after me and already has their green card. Just been frustrating waiting.

Hello!! Looking for some insight into how long everyone is waiting for. I was interviewed at MTL on Nov 28, 2023 and asked to complete the DS-5535. I started my process with USCIS in Feb 2022. It has been almost 2 years of waiting for my IR1 visa. I have recently filed the WOM with my lawyer. I am curious to know when you all filed your cases. USCIS shows 14 month processing time and I am at 24 months now. I was separated from my now husband for 17 months due to the Canada/US border closure during covid and still struggling to be able to legally live together in the US. This is taking a toll on our mental health I just want to live with my husband
