I just dont get it. I filed a WOM it was dismissed. My interview was last Nov 2023 and I am still waiting but people with interviews after me are getting approved. Not to sound like a debbie downer but this process is ridiculous. I have a life on hold because of this process and it is the most frustrating thing ever. I want to buy a home and start a family but I am not allowed to because of this immigration process that is never ending.

I am hoping someone can help me clarify something about the medical exam. I read on the USCIS‘s website that anyone that got a medical exam after November 1, 2023 has an indefinite validity period. Its been 7 months since my interview and receiving the DS-5535 and still no progress. I filed a WOM which was dismissed last month citing that I haven't been waiting long enough. Luckily the lawyer gave me half my money back. I feel like the wait is never ending. I have talked to congressmen and no progress. Overall this process is defeating and I can’t help but wonder when this nightmare will end.

I received my DS5535 form in November 2023 and had not travelled to the US since. This past Sunday I crossed the border at Toronto Pearson without any issues. I was worried for the last 6 months and was separated from my husband out of fear. They asked me why I am going and when I am returning to Canada and let me through. This is for those individuals that have any doubts about travelling to the US during admin processing. I would also like to add that I did cross the border after travelling to three new countries since I submitted my DS-5535 form.

According to the declaration by Carson Wu, the choice of whether we are getting the DS 5535 form is determined by the system. There is a flagging that comes up with maybe a name match or some sort of a trigger in their database, which causes them to give us the form. Once that flag comes, and they give us the form the consular officer cannot do anything on our file until the state department does not finish their administrative processing. Once the processing is over, they send the file back to the consular officer at the consulate and re-adjudicate.

Hello everyone we have a new blog update from Red Eagle Law that speaks to a reduction in the amount of cases in AP DS-5535 since January 2024. I am attaching a link for the blog, and there is also a new declaration that has been made by the department of state that provides more information on the administrative process and what goes on behind-the-scenes. I’m hoping someone can shed light on this if you file a WOM and the government does not respond within 60 days. What happens then? I read somewhere on Reddit that if they do not respond within 60 days, the judge can just take action based off of your request. Is this true because the government only has about five days left to respond to my WOM I have still not received anything. When reviewing other peoples timelines, I am noticing that the government has been responding within a couple of weeks.

It is both comforting and heartbreaking to know that I have found a community of people experiencing the same emotions as my husband and I. This process is taking a toll on our mental health and marriage. Its scary because it seems like there is no end in sight. We just want to start our lives together. It angers me that the US government has no sympathy for individuals trying to legally immigrate with NO criminal record. My biggest sin is that I chose to fly back and forth throughout dating and marriage to see my husband. If i had never visited him then i would be questioned on the authenticity of our marriage. Either way we were going to be screwed. I am just praying for some positive news or change that will clear this backlog and issue me a visa.
