  1. It's not whether the visit was legit but whether you had immigrant intent when you entered the US or had a really good reason to adjust status rather than go home and consular process.

Expect scrutiny at interview if you were out of status at the time you were married and remember the reason for the visit you told cbp. USCIS is cracking down on these types of basis of adjusting status.

  4. No you don't have to be together to file i130 but if you marry remotely you do need to meet again before filing. Also please complete your timelines. You may get lucky and receive interview quickly if you decide to stick with k1 and do AoS. In our case my now wife got her EAD quickly but are stuck waiting for interview for green card.
  5. No experience but you will have to pay new fees. Also you will have to be together when married or if you aren't then you will have to be together again when filing 130.
  6. Don't forget about I-864 obligations. Not sure about your previous spouses and whether they became US citizens, or left the US.
  7. You've already signaled immigrant intent with AoS. Seriously doubt you would be approved for B2.

  11. Actually it is probably a good idea to start over with the spouse visa since we don't know how long the pause will be. Yes it's wasted time but the immigrant would be a green card holder from day 1 and avoid AoS. Also the embassy can let the petition expire.

  13. You mean a Canadian citizen? Didn't realize a province has their own citizenship. Anyways it all starts with the I-130.
  14. K1 petitions are also allowed to expire after 4 months. They may at the discretion of the embassy be extended in 4 month increments up to a year. Probably better to start over with anyone spouse visa.

  16. Small outlier, tsa and cbp requires eac/ green card/visa for non us citizens to obtain airport badge for work in secured areas or areas controlled by customs.
  17. Whatever you do make sure you apply for the work permit. You can't predict how long the green card will take. My wife is still waiting after nearly 18 months. Absolutely nothing heard from uscis.
  18. She was able to get before marriage about a month after arriving. We tried a week after arriving and SS offirce didn't see the save info yet. We requested a new SSN card when filing AoS and received in married name. It's my understanding this is not done automatically any more. I'm going by our timelines back in fall 2024.
  19. Be advised you need appointment for SSN. Also birth certificate for foreign national. Not sure where you are but as soon as we got signed copy of marriage license from the wedding officiant, we went to the court house for certificate and received same day.
  20. File asap. From your dates she is already out of status. Not sure what state your in but she won't be able to get driver's license or state ID without the work permit. Strongly recommend to file for eac as you don't know when you will be called in for interview.
