We plan to! But we're also having to wait til at least June/early July to even begin applying for the H1B (needs a state license, needs an ITIN for one, etc). Hoping IR1 is done before any of that, but the way we're seeing it is that we're at least "doing something" in the event it takes even longer. Also re: medical exams - I thought the IV ones are only valid for 6 months? The ones USCIS extended are for AOS I thought.

@MAN2023 or @APRIL2023 if you don't mind sharing which medical field you're in specifically? Did you worry about the annual max of 65-85k H-1B visas? And if the state you're moving to needs a state license to practice your field, did you apply before having that license or after getting it? As I understand it, some states need an SSN/ITIN to get the licenses. Nonetheless, I think we'd opt for completing the IR1 whenever it's done, but this is wild. Happy that you two got to move forward in another way to at least resume life instead of staying in limbo.

Can we not start a petition like others in other countries have done? After reading what others posted, my spouse and I are looking into the H1-B visa option, as the field would work for it... Bonkers. We're almost at 6 months since interview (would be early May), and it's insane. Not even asked a 5535, just CV...

WOOOOO!!! Congrats!!! About dang time! I'm hoping others get their good news soon 🙏🏼 For us, not having been asked a 5535, we're beyond annoyed that it's trending to taking as long as those who were asked a 5535, since my understanding was that it "should be faster". AP is AP. Just thankful that people are getting approvals again!

We had a case update yesterday, and now today (both unsolicited/not email replies).... Don't want to get my hopes up, but this never happened before.. Interestingly, CEAC status is obviously still "refused", but all this legal jargon going on I wonder if they'd eventually change the wording to "denied" to match the new email language?

All this made me go check our case, saw an unsolicited update for today. Been a month since the last unsolicited update, or maybe even longer than a month 🤷🏽♂️ I've learned to not get my hopes up, but I assume this means one of the agencies doing security screening finally gave results back and they just added it in, waiting on however many others..

Wow I've never seen this kind of email personally. 221(g) is the standard refusal, but not a final refusal. They're saying you're in AP for security screening (SAO) like most likely everyone here at minimum. The wording is... weird, but I'm pretty sure they're just saying once the security screening results come in you'd be eligible for the visa (as in the visa officer would "reconsider" your case and adjudicate it again, likely an approval). Anyone else can chime in though, this is the first time I've seen this wording.

We got an email reply on March 14, albeit the usual template. I have a list to myself of cases I'm following closely, and some have gotten approvals in recent weeks. They're doing things, just slow as always. Don't lose hope! (Plus for us, as agonizing as it is, we weren't even asked a 5535 just a CV but now over 4 months since interview when we were told here by other VJ members it'd be fast lol)

Just curious: to those who weren't asked for a DS-5535, does the consulate owe an adjudication by a given timeframe or not? My understanding is any refusal into AP means "no estimate" and also the consulate wouldn't owe a response by a given timeframe. People were saying the 5535 removed the timeline requirement for them, but I mean isn't that just AP in general? Once you're given a 221(g) that's it. To the black hole!
