If it was put in one of four bags, then that narrows it down significantly, no? So shouldn't be hard to find? If the packet wasn't forwarded to USCIS, then you need the I693, and will need to pay for a whole new medical. There's only digital records of things once USCIS scans it in. If they don't have the docs to scan, how are they supposed to know it exists? If you file for AOS without the medical, then there'll be an RFE. I don't know if it would result in automatic rejection. Maybe someone else can confirm that But filing now might actually work in your favour as if she arrived July 5th, Sept 5th (very soon) will be the 90 days of authorized stay on a K1 and beyond Sept 5th she will be out of status and at risk of deportation.

Why did she get her packet back? Are you absolutely sure that she did? Normal protocol is for the packet to be taken at POE and they forward it on to USCIS. If the packet is taken and sent to USCIS, the I693 isn't needed as it includes the DS3025, which she should have recieved a copy of. You just write a letter stating the medical was completed with 12 months and include a copy of the DS3025 for reference.

If you filled in your timeline then people would know the country you are interviewing at and could advise. -
Fiance K-1 Visa (August 2025) Thread
smilingstone replied to aRcAng3l's topic in K-1 Fiance(e) Visa Process & Procedures
It'd be helpful if you completed your timeline. -
I don't know what evidence there is to suggest that an EAD is only issued when an i864 is accepted. Other than a T2 officer who many times give incorrect advice. EAD takes on average a few months to recieve. I did my biometrics around 1 month after filing and my EAD was approved and delivered not long after. I'd think if anything factors into EAD approval, it would be your education and employment history. Maybe if you're an experienced professional then they are more keen to get you working than if you aren't. I think it's all just speculation though.

Getting a SSN card after a K1 marriage
smilingstone replied to Mer20250's topic in Social Security Numbers
The K1 expires upon entry, often long before marriage happens. OP, you can get SSN before or after marriage but be aware that if the beneficiary will be changing their name after marriage, they will likely struggle to do this on their SSN before they have received their EAD. -
It's best to include a seperate cover letter for each form that includes who it is addressed too, the applicants full name, A number, a full list of content (the form, itemized supporting docs), etc. You can also sign and date these covers with a wet signature. This will help give USCIS an overview of what's in each application, as well as seperating them.

There is no motion to reconsider as the denial was a result of you submitting incorrect/insufficient documents, not USCIS' mistake. Besides, if you have both been previously married, you should both submit divorce documents. Your only options here are to resubmit the I-129F with correct documents, or go the spousal route. People are trying to advise you best they can, but you have repeatedly avoided to answer very relevant questions.
-
I probably felt the same as you when it came to choosing the K1 over the spousal. It felt easier somehow to be apart while being engaged, not married, and saving the marriage for when we were able to be together properly. I hindsight, if we had married way back and done the spousal route, nothing would've changed, we would still be the same people and in the same situation we're in now, only some things would've been easier for me. After going through the K1, I really understand why people say spousal is just better. At the end of the day, you are still committed to each other, so really what difference does it make if you are away 2 years from your husband, or your fiance? They are still the same person and 2 years is 2 years. You need to focus on celebrating with family when you are well clear of the visa finish line. You can't do this in the conventional way, because this is not a conventional relationship. Unfortunately, family will get left out of the celebration because either they can't travel, or you can't travel, so maybe explore who would be able to come to the US once you are there and married, book an Airbnb, stay together, set aside 1 day for his family to come to the house and meet your family to celebrate together. If you book these places months in advance you often pay only a deposit and can get a full refund upto some weeks before the date, meaning it's much safer than planning 2 cross nation parties and travel with entirely different groups of people. Yes, it is hard, but nothing worth having is ever easy to achieve. Good luck!

Proof of residency can be used once you submit your AOS paperwork and they send you NOA1. Maybe it will be easier for you to hold off on SSN before now. VJ guides do say you should get SSN before marriage, and therefore before AOS, but in my personal experience, I don't see why that is. Maybe states vary, but for me, I wasn't been able to do much even with an SSN before marriage. Really everything got easier for me once I had my EAD.

1. Yes 2. You'll need to take your marriage certificate if you want to use your married name for SSA. If you don't have it yet, then stick to your maiden name and update it once you have your EAD. 3. Yes 4. Would be useful but you don't have to submit that with the initial application. You can submit additional evidence online once USCIS recieve your application and you activate your online account.

Late submission!
smilingstone replied to Westside27's topic in K-1 Fiance(e) Visa Process & Procedures
Along with meeting within the last 2 years, you would very likely need to redo the forms due to newer version of I-129F. You can't just send them something you prefilled over 2 years ago. -
Your K1 wasn't denied. Your I-129F was, likely due to the response to the RFE not meeting USCIS' request. Are you not able to travel to the US and marry? You can do this on a tourist visa but you CANNOT then stay to adjust status. If travelling on tourist visa for the purpose of marriage, you MUST then return to your home country to start the spousal visa. But, it does not sound like your fiance really wants to pursue your relationship. Many of us here have made huge sacrifices during our visa processes. If you have a genuine relationship, then you will find a way to make it work. If one side refuses to make an effort, then I suggest you move on with your life.

My opinion but I'd also have thought that a B is not the visa for this purpose. Even if unpaid, it will likely involve a contract and technically employment/internship. Sounds like something the company or organisation would arrange for the candidate, no?

South Africa K-1 interview process
smilingstone replied to fbgmlae's topic in K-1 Fiance(e) Visa Process & Procedures
How old is the petitioner, and how old is the beneficiary? How long have they been in a relationship? How many in person meetings between the two? Countries neighboring SA are likely high fraud. If there is a significant age gap between the two, and other red flags, then a lawyer might be preferable in their situation. -

Can't be a very good one if they're asking for advice on a DIY site... -
South Africa K-1 interview process
smilingstone replied to fbgmlae's topic in K-1 Fiance(e) Visa Process & Procedures
You think he does? Do you not know the English-speaking skills of the person you intend to marry? No, I don't have experience at that embassy, as you can see from my timeline. -
South Africa K-1 interview process
smilingstone replied to fbgmlae's topic in K-1 Fiance(e) Visa Process & Procedures
The questions are really very simple, and answers should be simple and succinct too. If he can speak and understand basic English, then there should be no issue. Document reviews are required to ensure all docs needed are available before interview. If anything is missing, they tell you then. If you don't attend the doc review, they will refuse your interview and you will need to reschedule both doc review and interview. Why can't he make the doc review? -
It's far more likely that your partner had a lapse in judgement and made a mistake that is now going to affect her timeline coming to the US. Maybe rather than admit fault, she is now trying to rectify things, going as far as to try and find someone who will make the positive test "go away". That's a far more plausible story than cat scratches being mistaken as self harm and embassy medical officials soliciting bribes.
