I did not hijack. I merely asked one simple question to Family's suggestion about using Zillow.  My question was on-topic and relevant for the original poster as well as for anyone else reading that thread.  I did not ask questions about my case. My question was to Family regarding his suggestion to the OP to use Zillow. Using Zillow did not sound right because it is different from I-864 instructions. It might have been bad advice to the original poster and I was trying to confirm whether it was good advice for them or bad.

Online filing is a combination of an online form and uploading supporting documents.  One supporting document is the I-130a.  Start by becoming an A-Student of the I-130 instructions you can download and the paper form, can be a helpful guide in preparing.  I still recommend filing on paper though unless you are living abroad.  Less form glitches.

My suggestion is based on hands on experience and success. It works. The property tax statement also shows assessed value even though that number is less , they have always accepted the informal market value  of Zillow or a free comp from a RE agent

Deang6 reacted to FolieADeux in Very confused about the i-134 Affidavit for Support
Hi everyone, I've got a few questions that I am struggling to find answers to and would appreciate some guidance.

Our visa petition has been approved, and my fiance (UK citizen) received a list of items that he needs to bring to the interview. I'm confused at some of the wording and verbiage from the letter he received and want to make sure we get everything right so there's no problems.

At the top of the letter, it says "Documents you are required to complete and provide for your K visa interview". The key words here are "you are required to complete and provide." We are not sure if the i-134 is a form that I, the American citizen, needs to complete or not because it says "You", while being addressed to my non-American fiance. So if someone could help clarify who is supposed to fill out this form (me, the American sponsor, or him, the UK citizen), I would really appreciate it.

And in relation to this question, I was looking at the form and the very first question is "I am filing this form on behalf of: Myself as the beneficiary. Another individual who is the beneficiary", where we must tick a box for one of these options. But that is where the problem lies because I don't know who is supposed to be filling this out to begin with. Also, what is the definition of the word "beneficiary"? Is my non-American fiance the beneficiary or am I?

Also, right after where it lists Affidavit of Support I-134 on the letter, it states "current tax returns". I'm not sure if they want my tax returns, his tax returns or both. They unfortunately gave little to no clarifying information for any of these things and I'm at a loss.

I did try to search on here to see if anyone had asked about these issues before and couldn't find any prior posts related to a UK citizen.

Any help would be greatly appreciated. Thank you!

Did you get an email and CEAC inbox message with the words "Documentarily Qualified" (DQ)?  Having your documents accepted is not enough.  Your case will only be queued for interview after you get that DQ email.

If you did get the DQ email, then you can just ignore that message about insufficient income until the interview.  As the message says, the CO will decide at the interview whether your income is sufficient.

A U.S. citizen living overseas and earning less than the foreign earned income exclusion amount should still file a U.S. tax return. Even if your income is below the exclusion threshold (which is $112,000 for 2023), the IRS requires U.S. citizens and resident aliens to report their worldwide income. This requirement applies regardless of where you live or where your income is earned. If your foreign earned income is below the exclusion amount, you may not owe any U.S. taxes, but you must still file Form 1040 and Form 2555 to claim the foreign earned income exclusion. Additionally, filing a return can help you establish a record of your earnings and protect your rights to social security benefits or other future claims. It's also important to note that there may be other filing requirements, such as reporting foreign bank and financial accounts (FBAR) if you have accounts that exceeded certain thresholds at any point during the year.

Also — if you need additional documents translated you don’t need to pay. Your English looks to be sufficient to self-translate for USCIS and presumably your husband is fluent in English and Spanish since he originally is from Peru and is now a USC.

You guys can self-translate and certify your fluency in both languages on your own.

Good luck with you application and process..  I also applied recently for my wife using the online form.  I found that it helped to have a copy of the printed form and the instructions for that form while I filled in the online form as some things were not as clear in the online questions as in the context of the online form.  I also found that reviewing the 'generated' form before submission was a valuable activity some things like addresses and such had to be adjusted to fit properly.

    1. Yes  2. Keep it simple.  Employer is the name of the store and her occupation is "store clerk" or something to that effect.  If the start date is more than five years ago, you're done with that section.  As you move forward, just tell the truth in the simplest way possible.

Seven threads on submitting I-130 merged together. To avoid cluttering of the forums, we do not allow members to start a new thread for each question regarding a broader topic, in this case filling out and submitting I-130 online. Please keep any further questions regarding this topic in this thread only.

That's correct.  Yes, tourists can easily extend their tourist stay in the Philippines for up to 3 years for most countries and 2 years for others.  However, those with one way tickets, do need an ongoing ticket for departure within 29 days.  Onward ticket is one way to do that inexpensively.  I just buy a one way ticket to anywhere from Orbitz/Expedia on my day of departure TO the Philippines, then utilize the 24 hour free cancel feature, once I have the confirmation email.  The email is good for the airlines, and may or may not be asked for in Manila or Cebu.  However, you won't get ON the plane without it.

The processing times for a K-1 and regular CR-1 are about the same.  My advice is to marry and try DCF.  If DCF fails, then go the CR-1 route.
Every couple has their own priorities, and each couple must decide which visa is better for their situation.
    K-1
      More expensive than CR-1
Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)
Spouse can not work until she/he receives EAD (approx 6-8 months)
Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period
Spouse will not receive Green Card for many months after Adjustment of Status is filed.
A K-1 might be a better choice when 18-21 year old children are immigrating also
In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice
A denied K-1 is sent back to USCIS to expire
K-1 entrant cannot file for citizenship until after having Green Card for 3 years.
Once an I-129F has been approved, delaying the case is difficult to impossible if the need arises.

    CR-1/IR-1/DCF
      Less expensive than K-1
      No Adjustment of Status(I-485, I-131, I-765) required.
Spouse can immediately travel outside the US
Spouse is authorized to work immediately upon arrival.
Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US
Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.
The clock for citizenship filing starts immediately upon entry to the US.
A CR-1/IR-1 case can be delayed indefinitely at NVC if the need arises.

Tell her stop watching YouTube videos, Facebook groups etc. I don't know if I will catch flack for this but Filipinos love to go out of their way to find things to worry about.

The other thing that is real in the Philippines is they "they said" culture. You will hear the strangest things you can imagine and ask where they heard that from. The answer is...They said. Who is this "they"? You can't let a baby get a drop of rain on them but you can give them a bath. You can't eat watermelon after a c section or your wound will open up. I have really considered writing a book and calling it, they said.
Stick to these forums whee you will get accurate information.

Secondary interviews are not uncommon for Filipinos traveling as tourists and can be harsh.  "Offloading" is real.  But not with K1 or immigrant visas.  CFO is more or less your insurance against that.  At least in theory CFO should have vetted your fiancee's relationship with you and if CFO said it's ok, than BI should accept the CFO certificate at face value.  It's more or less settled by CFO before she ever goes to the airport.

She will be interviewed by the US Embassy in the Philippines, assuming she currently resides in the Philippines.  I think you will be hard-pressed to find a Philippine Embassy within the Philippines, since there are none, so whatever TikTok said isn't even possible, or was misunderstood.

Also, CFO is not conducted by the embassy.  It is a class required by the Philippine government for Filipinos that will exit the country.  The passport stamp is also old news.  Now they issue a digital certificate.  The CFO interview can be similar to the embassy interview.  Take the same documents to CFO that she took to the interview.

$200 per pet for international is what Delta site says (with carrier)

To ensure the comfort of all customers, we have a first-come, first-serve policy for pets in the cabin, with a limit on the total number allowed on each flight. If your pet meets the above requirements and you have a reservation, please contact Delta Reservations as soon as possible to book your pet. We also ask that you have your pet’s kennel dimensions (length, width and height) available when you call.

‘Time will be short’? Is that to connect from international to your domestic flight to CLT?

The normal procedure when coming in internationally is to go though immigration, collect any checked bags, then a potential Customs check. There are lines for everything, depending on other flights. After that it’s back in line and security again for the domestic flight to CLT. It varies, often a minimum of a 2 hours planned timeframe.

I’d be so relieved to get through it all, I’d almost get a hotel room in Atlanta(that takes pets) and rest up some.

The reasoning is that USCIS already knows the original name of the person who changed their name upon Naturalizing.  It's in their file.  There simply IS no other record of the name change besides the N400 filed with USCIS to naturalize.  Tell your partner, truth is truth on its own merits.  Truth is not determined by consensus, or second opinions.  By the same token, falsehood does not become truth because a second source confirms the falsehood.

Start doing your homework on the NVC stage and onward.  When you do, read official forms and instructions carefully.  Avoid reading in extra things that are not there, like "apostille" etc.  Do pay attention to the little words, and, or, if, etc.  In a few months, your spouse can get her police report.

A complete copy of your latest federal tax return...or....a Tax Return Transcript.  Your current income AND the number you will enter in the tax section, is the same for the self employed.  See the lined named "Total Income".  This is clearly explained in the I-864 instructions.  It's critical you become an A-Student of that document AND the form itself.
