  1. Thank you for the info! It makes sense. I know it's a bit of a specific question but do you think there will be an issue if we move forward with the US path and I don't end up studying given that's what I received an exception for?
  2. Hello! I am a US citizen while my husband has Iraqi citizenship. We both currently live in Sweden. I have a bit of an odd situation here. Earlier this year my husband and I applied for direct consular filing so I could go back to the US to study and he could join me. The embassy was amazing and I got my I-130 application through on exceptional circumstances based on my acceptance to university. An important additional detail is that my husband is an asylum seeker here in Sweden and we honestly didn't have much hope that he would receive residency, so, in another way the US rush was a desperate attempt to stay together. Shockingly, he recently was notified that his case is approved here in Sweden. I also learned I didn't receive as much funding for uni as I'd hoped. Basically, we have been going back and forth on what is best for us. I'm now thinking it's best if I go back to the US and apply for a Swedish marriage permit yet I am still trying to limit our time apart. Additionally, I'm really excited to show him my hometown/country so I thought he could come to visit me in the US while we wait for the Swedish documents to go through. Perhaps, in the future, after visiting the US we might even reconsider and continue with the US route. I've been told our case will remain at the embassy for up to a year of inactivity (Q. Does this mean I can email them every year to keep the case active and have the chance to continue from DS-260 etc. say in 5 years?). Here's the trouble. His initial permit in Sweden is only approved for 13 months and I'm thinking all the US case officer will see is someone in a temporary situation who doesn't want to return to their home country (Iraq). Will this get in the way of him applying for a visitor's permit or am I overthinking this? I would be grateful for any words of wisdom. Thank you for the read!
  3. Hello, In the I-130 form for a marriage visa question 53 asks "Was the beneficiary EVER in immigration proceedings?." I am wondering if this only applies to immigration proceedings in the US. My husband has past asylum proceedings in Sweden. He appealed a few times and these went up to a court level. He currently however has a new case and Sweden has dismissed all previous applications hearings etc. Basically, I was wondering how much detail I need to go into on this topic in our initial petition. Thanks for your time!
  4. Thank you so much for all your advice I will definitely go in and give the CR-1 a closer look. It seems getting a lawyer on board as well might be good given the details of our situation. Thanks again!!

  6. I understand the process itself is not fast by any means. What I meant is that compared to CR-1 it appears that K-1 is faster in terms of entering ths US. Per most websites I read.   7. Hi, First thanks for your reply. Since him coming to the US and K-1 was something we had discussed previously it seemed like a natural option. Also from what I'm reading K-1 is faster than the CR-1 route which is good for our situation. Sorry I don't know what MENA is could you elaborate on that question? As for the passport, it is my understanding you don't need a valid passport for the i-129f application. We are hoping in the meantime before any further steps we can sort it out.
  8. Hi! I am a US citizen and met my fiance in Sweden. I complete my bachelor's here and he has been in Sweden for 5 years seeking asylum. We met over 2 years ago and have plenty of evidence of our relationship. He even met my parents and friends from the US in person when they came for my graduation. We knew we wanted to be together long term and at one point had hopes we could perhaps settle in Sweden long-term. Things changed recently, I had started looking at graduate programs in the US and then he received negative on his case. Due to all this, we decided we would try to go to the US together but I have some concerns about how this all looks. 1. Will applying after his negative decision look bad/cause problems? He will try to stay in Sweden on asylum appeals until he can go to the US because he feels his home country (Iraq) is not safe for him. 2. Because this has all been a discussion between us we don't have any official looking proposal 3. For complicated reasons he can't get an updated passport at the moment 4. I just graduated this past spring and am working in Sweden. I don't think I can really prove financial support at the moment but I have a parent that is willing to take that responsibility. 5. We are also a bit young, I am 23 and he is 25. Thanks in advance for any advice you may have!
