  1. Wondering any chance to let media know or write petition letters to Antony Blinken ,head of DOS ? LA times has some reporters on immigration issues.
  2. 1.From my observation, it is true that Canada goverment began more tougher background check to immigration appliciants since mid 2023. Similar as DS-5535 process. 2.Another thing is for their job security , tons of 66k DS5535 cases need 66000 working hours to clear (1 hour each case). An analyst working hours is ~2000 per year, so need ~33 staff at DOS to work one year , that is why they requested budget for it last year. Imaging if DS-5535 gone , where 35 positions gone ?
  3. Similar as mine. Actually they checked online then updated on CEAC web, based on the submited DS-5535. Some checks will be sent to DC.
  4. the IV cases stuck in Consulate (include MTL) cannot been released until closed. Usually if got visa issued, few people request FOIA to see why the VO rejected to issue visa in interview day and following process. for IV FOIA ,send to DOS. Not USCIS.
  5. Currently Supreme Court to hear case of Los Angeles man denied visa over his tattoos. Interesting , might it has some impacts to all VOs? The following excerpt from LA times: “The Supreme Court has never held that U.S. citizens and longtime residents have no right to due process, or even the right to a day in court,” said the couple’s attorney Eric Lee. “That would be a bombshell decision that would just explicitly give all of the consular officers and immigration agents all across the country carte blanche to violate the Constitution.” https://www.latimes.com/politics/story/2024-01-12/supreme-court-will-hear-case-of-los-angeles-man-denied-a-visa-over-his-tattoos
  6. From ***REMOVED*** immigration forum , exactly one IR1 case with DS5535,cleared in 3 months at MTL in 2022. I suggest if you have time , might read meeting briefs of DOS consular unit speaker with AILIA under Visa News,@ travel.dos.gov web site , very informative 😄
  7. But. as I knew in 2022, it takes ~3 months to clear AP/DS5535 for IV, even in 2023, DOS cleared most NIV visa security within 60-70 days. Fyi: https://www.checkee.info might they DOS change priority? Don't believe DOS under staff
  8. My friend, you already close to final stop. If I were you, just do whatever they requested and waiting to get back the stamped passport. No bother to create new issues. You might check the web page of MTL, as the page said on Nov 29, the roughly process time is 3 months. That may include case updates such as review, medical and clearance etc.
  9. Consulate VO can not identify you until finger print in interview. I think AP equalvent to USCIS process for green card application in domestic US (up to 180 days). Guessing VO return a few cases like us to USCIS to check again, if I were a reviewer of USCIS ,need to repeat task, my face also turning red.
  10. I am impressed by this case, DOS has so powerful resources to check a birth certificate issued at 70 years ago, found the evidence to turn down his passport renewal. Birth certificate also is an anchor stone for children or parent class IV, as we know
  11. Don't worry, just prepare well and pass in 90%+. My lesson is that should have paid more attention on mock interview, first impression was very crucial to VO, especially ladies' 6th sense you know. I had 8 US NIV visa interviews in my life, giving me pass were all gentlemen. Just for a holiday fun 😊. Another thing is check yourself on USCIS status portal with A# number in advance, which is in notice of action letter from USCIS. Make sure is clear without any flag comment. That number will be your Green card number , might you already knew. VO has no reason to reject IV except he/she has strong evidence to convince USCIS.
  12. From my understanding, if those cases that are inconclusive from DOS review should go WOM.Since VO keeps eye on fraud prevention, it hard to prove marriage is true or no, except have a child. Or how ex ordinary talent have etc. Even further they might challenge birth certificate authentic. Recently in News a senior 70s doctor was found his father was a foreign diplomat when he was born in US ,so his US citizenship revoked. By law for diplomat's children born in US, no citizenship automatically gained.
  13. how to determine the number of people stuck in AP? I checked DOS Immigrant Visa Statistics Report 2023 from below link. found 45,000 roughly visa issued world wide monthly. Also related to DOS requested budget for DS5535 in September ,their proposal to check 50,000 cases yearly , so odds is 1/12, 8% of people will be checking, under assuming DS5535 equalvent to AP, 40000-50000 in AP per year. Since a DS5535 check needs ~1 hour , as their proposal said, might be the longest checking. Other checks FBI ,CBP , USCIS much quicker, might you can check yourself online. I think Visa officer check these on the interview scene. So I prone to believe DS5535/ AP should not take that loooong time. Another interesting finding from the visa statistics report is,the neighbor Mexico consulate issued ~4000 IV visa issued every month, 10 times more than Canadian, even 10% people in AP already a heavy load to DOS. I don't know why Mexican are so lucky !!!😋 As to Montreal consulate, per DOS statistics, ±5000 IV issued yearly, i.e ~400 monthly . Thus per 8% odds, , 30 -40 persons be thrown in DS5535 / AP every month. 🥺 Ref: https://travel.state.gov/content/travel/en/legal/visa-law0/visa-statistics/immigrant-visa-statistics/monthly-immigrant-visa-issuances.html; https://www.regulations.gov/document/DOS-2023-0028-0001
  14. https://www.regulations.gov/document/DOS-2023-0028-0001 You might look the above link on the ds5535 process or page 168 of this thread. And find some clues. BTW DOS wants more budget from Congress to do DS5535, asked for public comments, actually they got near 800 feedbacks.
